Um, doesn't murder (the unlawful killing) while committing a separate felony require a separate felony act? Otherwise, that's sort of tautological, isn't it?

IMO, it's inherent in the wording of the statute:

The unlawful killing of a human being, when perpetrated without any design to effect death, by a person engaged in the perpetration of, or in the attempt to perpetrate, any felony other than any [enumerated felony] is murder in the third degree and constitutes a felony of the second degree


The unlawful killing (i.e. the gun shot)... perpetuated without any design to effect death (not sure how that works, when a gun inherently represents deadly force)... by a person engaged in a felony.

It is plain from the reading: the act that caused the death had to take place while another, independent act was being committed.

My computer is already begging for a reboot and closing tabs/windows, but I will later if they don't cover it at the trial. If you think about it, if it didn't require a separate act then every murder would be felony murder. Felony murder is a capital offense.
