Attorney Joel Brodsky is addressing the court about the limits to the scope of witness Harry Smith and his testimony about Kathleen Savio. “If the statement leads to the fact that maybe he knows that Miss Savio lied under oath, that goes to the issue of her credibility.” Judge; “Well, I directed both sides to interview Mr. Smith if they wanted to. Did you do so?” Steve Greenberg: “I talked to him today . . .what she [Savio] told him about the incident is different from what she then testified in court.” Judge: “Well, then, you’ve got your impeachment.” Greenberg: “I think they should be asked to disclose that before he testifies.” The judge says that the defense may call Smith in an offer of proof prior to his testimony before the jury. Judge: “If he’s going to testify about something she said to him, and he knows that she testified under oath, they’ll be able to impeach her through cross-examination… if that alters your plans about calling him, then don’t call him now, and call the other witness.”

In Session The parties are still milling around in the hallway. It now appears that the next prosecution witness will be Nick Pontarelli, the son of earlier witnesses Mary and Tom Pontarelli.

In Session: The jury is now gone, and the witness leaves the courtroom. Judge; “One of the jurors has advised the bailiff that he or she knows the witness. I want to see all of the witnesses with the court reporter in the judge’s conference room. And then, Donna [the bailiff], I’ll want you to bring back the juror.” The judge and the attorneys leave the courtroom.

4:50 p.m. 'The issue has been resolved'
Judge Edward Burmila has returned to the bench.

"The issue has been resolved, and the juror will remain seated," he said.

Nicholas Pontarelli's testimony has resumed.

August 22, 5:50 p.m. Court adjourned for the day.
August 22, 4:53 p.m. Neighbor Nick Pontarelli was the last one to see Kathy Savio alive. Pontarelli said he saw Savio on the Saturday afternoon before she died, when he went over to her house and had lunch with her. Pontarelli was only fourteen at the time, but he says the families were close. “She was like a 2nd mother to me,” Pontarelli said.

9 a.m. Minister could be called to the stand
Among the witnesses who could be called today is the Rev. Neil Schori, who counseled Drew Peterson's fourth wife Stacy before she disappeared. But the defense is expected to object to his appearance on the stand.

Prosecutors want to call Schori to testify that Stacy Peterson told him during a pastoral counseling session that she saw her husband return home late, dressed in black and carrying a bag of women's clothing, not long before Peterson's third wife, Kathleen Savio, was found dead.

His testimony is critical to the prosecution because another witness who said he heard a similar story from Stacy Peterson was not allowed to testify last week because of missteps by the state.

Schori's account would be the strongest piece of evidence prosecutors have introduced so far that could show Drew Peterson behaved suspiciously the weekend Savio died. No physical evidence or eyewitness account ties him to the alleged murder, which a coroner's jury initially ruled was an accident.

Peterson's attorneys long have sought to bar Schori from the trial, but Judge Edward Burmila has ruled that marital privilege does not apply to his testimony because Stacy Peterson was relaying what she saw, not what she heard. Burmila has indicated that he still must decide whether the testimony is relevant to the case.

August 23, 9:26 a.m. Stacy Peterson’s pastor Neil Schori is expected to be first on the stand today. Schori's testimony could be the most damaging yet. Schori will testify that Stacy had told him that Drew was gone the night of Kathleen Savio's death and told Stacy if anyone asks she should say he was with her. Last week, a friend of Stacy's, Scott Rossetto, was to testify to a similar conversation he had with Stacy. But the judge barred his testimony just four minutes in after learning prosecutors allowed Rossetto to testify to a false date of when it took place. They also did not notify the defense.

Judge Burmila has taken the bench. Glasgow announces that the first witness will indeed be Neil Schori, and wants clarification as to what he may or may not say. Attorney Brodsky notes that there are issues of marital and clerical privilege at play with Schori. Judge: “I don’t think we addressed the issue of ‘no one will ever know’ [which Drew allegedly told Stacy].” The judge once again overrules the defense’s marital privilege objection to this testimony.

Attorneys: Savio's cat scratched her, not Peterson

Drew Peterson’s defense team said Thursday that the scratches found on Kathleen Savio’s body are from her cat and not a sign of foul play.

It’s their latest theory as to why Savio’s body was found with bruises and scratches.

Peterson’s attorneys argued last Friday that rough sex caused the bruises.

Brodsky and Glasgow continue to argue over the exact terminology that Schori will be able to say. Glasgow claims that “my hands are tied,” based on the judge’s prior rulings. “We have a right to have this witness tell the gist of what he was told . . . the words ‘perfect crime’ were used . . . he [the defendant] coached her for hours.” Judge: “We’ve revisited this on a number of occasions . . . the issue is what is legally admissible, not what makes the State’s case better, or what makes the witness more believable . . . I was told that the testimony was going to be that she was told to lie. ‘This will be the perfect crime’ is covered by marital privilege. I didn’t make up marital privilege . . . now you’re telling me that’s not really what the statement was. I guess we have to backtrack: did Rev. Schori say that Stacy Peterson told him that she was told to lie to the police?” Glasgow: “Yes.” Judge: “You know what . . . get the transcript of the argument that was made by me on the State . . . Stop! I want the transcript before we go any further. I want to make sure we’re crystal clear here as to what I was told by the State. When you find that, we’ll reconvene.”

9:50 a.m. Prosecution irks judge
Judge Edward Burmila is upset with the prosecution for allegedly misleading him about what the Rev. Neil Schori is expected to say on the witness stand.

Burmila has left the bench, demanding a transcript of testimony from Schori during a 2010 pretrial hearing, where Schori said that Drew Peterson’s fourth wife, Stacy, told him Peterson returned home late, dressed in black and carrying a bag of women’s clothing shortly before Kathleen Savio was found dead.

Jeff Ruby, the Cincinnati restauranteur who’s been following the Peterson trial, has just been ejected from the courtroom. His offense: mouthing some expletive words to defendant Drew Peterson during this unexpected recess. Ruby’s action was witnessed by a member of the courtroom security staff, and he was subsequently removed by members of the Will County Sheriff’s staff. According to media coordinator Ken Kaupus, he is permanently banned from the trial.

August 23, 9:50 a.m. Within minutes this morning, prosecutors find themselves in an unfavorable place with the judge. Judge Burmila has called a break to review transcripts, as to exactly what the prosecutors told him Neil Schori would testify to. It seems this morning that there was a difference in the phrasing that has upset the judge.
