Prosecutor unleashes emotional closing at Tsarnaev trial

His voice trembling with rage, a federal prosecutor in the Boston Marathon bombing case played a gut-twisting montage of Dzhokhar Tsarnaev's blood-soaked handiwork set to a motivational jihadi CD in an emotional 80-minute closing argument today.

"This is the cold reality of what his crimes left behind," assistant U.S. Attorney Aloke Chakravarty said, near tears when he reminded jurors of the horrific death of 8-year-old Martin Richard outside the Forum restaurant on Patriots Day 2013.

"There wasn't a part of this boy's body that wasn't destroyed ," Chakravarty said.

"Krystle Marie Campbell, Martin Richard, Lingzi Lu and Officer Sean Collier are no longer with us. That's a result of the defendant's choices," he said after he had charged up to Tsarnaev, 21, face to face in a packed U.S. District Courtroom 9 to accuse the former UMass Dartmouth student of making the statement to America, "An eye for an eye. That's what he read, that's what he said, that's what he did," Chakravarty shouted at a stoic Tsarnaev.

The jury is expected to be pared from 18 to 12 later today to begin their deliberations after the defense delivers its closing remarks. The panel heard from 96 witnesses over 16 days of unforgettable testimony. The trial began Jan. 5 with jury selection.

Getting the jump on what will likely be the defense argument that Dzhokar was under the influence of his late extremist brother Tamerlan Tsarnaev, Chakravarty stressed the siblings "teamed up to terrorize the region in 2013," and, out to avenge U.S. military actions in the Middle East, "They had decided that justice for them was becoming holy warriors."

Before his closing the judge in the case gave the jurors instructions to follow during their deliberations.

Tsarnaev sat with his head hung as U.S. District Court Judge George A. O'Toole gave attentive jurors their instructions, which he called "a short course in all the law you need to know."

The jurors are expected to receive the case by day's end, when they will for the first time be be able to discuss the trial.

Jury deliberations begin in Boston bombing trial

BOSTON — A federal jury Tuesday began deliberating on the fate of accused Boston Marathon bomber Dzhokhar Tsarnaev.

Closing arguments concluded Monday in the guilt-or-innocence phase of the trial with prosecutors ratcheting up their case that Tsarnaev, 21, is not the "passive, go-along-to-get-along guy" they say the defense made him out to be.

Three people died and more than 260 were injured in twin blasts April 15, 2013, near the finish line of the marathon. If the jury of seven women and five men convicts Tsarnaev — and his lawyer has not denied Tsarnaev's involvement — a hearing would be held to determine if he is executed or is sentenced to life in prison.

Prosecutors described Tsarnaev as a true believer in the cause of radical, violent jihad to avenge what he saw as harm by the United States against Muslims.

"The plan was to make this bombing as memorable as it could possibly be," said Assistant U.S. Attorney William Weinreb.

BREAKING: Guilty on all 30 counts! He is death penalty eligible !

After deliberating over 11 hours, the jury in the Boston Marathon bombing trial has reached verdicts. It has been close to two years since the attacks left three people dead and far more wounded in the Boston Marathon Bombing.

The jury has found defendant Dzhokhar Tsarnaev guilty on charges of conspiracy to use a weapon of mass destruction and all 30 counts. Which means he is eligible for the death penalty.

BOSTON (CBS) – The image of three-year-old Leo Woolfenden being rescued after the second bomb went off appeared before jurors during day three of the sentencing phase of Dzhokhar Tsarnaev’s federal trial. His father, Steven, told the jury, “I was completely terrified because I didn’t know if I was ever going to see my son again.”

Woolfenden’s leg was blown off at the scene, and he was left alone on the sidewalk in front of Forum Restaurant, waiting for help. At that moment, the Salem man testified, he turned to his side and saw a mother hovering over her little boy who Woolfenden said he could tell was dead or dying.

That woman was Denise Richard, and Woolfenden said she “was just pleading with her son. I heard ‘Please’ … ‘Martin’… many times. I didn’t see a response.”

Fearing his own son might die, Woolfenden reached out to another parent in distress.

BOSTON (AP) — For the first time in court, Boston Marathon bomber Dzhokhar Tsarnaev dropped his blank, impassive demeanor and cried as his sobbing aunt briefly took the stand Monday in his federal death penalty trial.

Tsarnaev, 21, wiped tears from his eyes quickly and fidgeted in his chair as his mother's sister sobbed uncontrollably. He had maintained an uninterested expression since his trial began in January.

The aunt, Patimat Suleimanova, cried as she sat down about 10 feet from Tsarnaev. The tears began falling before she began to testify, and she was only able to answer questions about her name, her year of birth and where she was born.

After a few minutes, Judge George O'Toole Jr. suggested that the defense call a different witness so she could compose herself. As she left the witness stand, Tsarnaev used a tissue to wipe his eyes and nose.

Prosecutors urged the judge last week to press Tsarnaev's lawyers to make sure his relatives testify soon because 16 FBI agents have been assigned, at great expense, to guard and protect them while they are in the U.S. The family members arrived in Boston on April 23.

Will judge allow nun to testify for Tsarnaev defense?

While everybody in and around Boston is celebrating Mother’s Day and spring sunshine, George O’Toole has something weighing on him.

O’Toole is a judge and has presided over the trial of convicted Boston Marathon bomber Dzhokhar Tsarnaev with his typical geniality. But even genial judges have to make tough decisions.

The trial, which began with jury selection in the first week of January, and testimony in the first week of March, is winding down. If all goes to plan, and it seldom does in trials, the jury could be sent away by the end of this week, ready to contemplate sentencing Tsarnaev to death or life in prison without the possibility of parole.

But before any of that happens, George O’Toole has to decide whether a 76-year-old Roman Catholic nun can testify as part of the effort to save a 21-year-old Islamic extremist from death.

The nun in question is Helen Prejean, a Sister of St. Joseph, and if you ask what that means, you never had nuns.

Tsarnaev death sentencing could come in late June

Boston Marathon bomber Dzhokhar Tsarnaev will be formally sentenced to death at a one-day hearing, possibly in late June, that will include statements from survivors of the terror attack, US District Court George A. O’Toole Jr. said Tuesday.

At least 20 survivors and relatives of victims plan to deliver victim impact statements, according to a federal prosecutor who had asked O’Toole for a quick scheduling of the hearing. “I feel there’s a very strong interest in finality in all this,” Assistant US Attorney William Weinreb told the judge.

Tsarnaev was condemned by a federal jury to death last week, and although their decision is binding, only a judge can officially impose the sentence.

Lawyers for Tsarnaev had asked that the hearing be held in mid-August, to give them time to file motions for a new trial and a request to vacate Tsarnaev’s conviction and death sentence. Such motions are typical in any criminal case.

Quoting both Shakespeare and Verdi, a federal judge has sent convicted Boston Marathon bomber Dzhokhar Tsarnaev on the path to death row, telling him he will be remembered for murdering and maiming innocent people.

The words were a formality, but a stark one.

“I sentence you to the penalty of death by execution,” intoned U.S. District Judge George O’Toole. And with that, death row became Tsarnaev’s official destination, two years and two months after he and his brother triggered two bombs at the marathon finish line.

U.S. Attorney Carmen Ortiz calls the outcome gratifying. “I felt proud in that courtroom,” she said. “Not just to be a Bostonian but also to be an American, because you heard a number of victims say not only are we Boston Strong, but we are America Strong.”

The theatrical symbols were striking. Most extraordinary was the sight of 11 of the 12 jurors who just a month ago had condemned Tsarnaev to death. They were seated in the jury box.

The judge took pains to note the former jurors had no official role, that he had invited them to come back as individuals, and that they were sitting there in the box, in almost exactly the same order as they had for five months, because there was no other place to seat them.

Twenty-four victims delivered impact statements, and though they were not supposed to express their views on the death penalty, some, like the father of murder victim Krystle Campbell, told them, “You did the right thing.”

The statements reflected a range of emotions from unbridled anger, to sorrow, resentment and despair of those whose lives had been physically, psychologically and financially shattered.

Man arrested with meat cleaver outside Boston court during Dzhokhar Tsarnaev sentencing, sent for mental health evaluation

BOSTON - The man who brought a meat cleaver to the federal courthouse during Dzhokhar Tsarnaev's death penalty sentencing on Wednesday has been sent to the hospital for a mental health evaluation.

Patrick Carrerio, 24, of Woburn, was arraigned Thursday in Boston and held without bail for 20 days. During that time, he will be evaluated at the Solomon Carter Fuller Mental Health Center in Boston, according to the Suffolk County District Attorney's office.

He is scheduled to return to court July 15.

According to the Boston police, Carrerio drove past a security check point and jumped a curb to enter a restricted area outside the Moakley federal courthouse in Boston. At the time, the court was on a lunch break from the day-long sentencing hearing of the Boston Marathon bomber.

Carrerio told the officers that he came to the courthouse to express his opposition to the death penalty. The officers searched his car and found what appeared to be a meat cleaver. Carrerio never threatened anyone with the cleaver.

Carrerio was arrested and charged with failure to stop for a police officer, disorderly conduct and the unlawful possession of a dangerous weapon.

CNN Wire -- Boston Marathon bomber Dzhokhar Tsarnaev was behind bars at a federal prison in Colorado on Thursday, a day after a judge formally sentenced him to death.

Tsarnaev, 21, arrived Thursday at the United States Penitentiary in Florence, Colorado, U.S. Bureau of Prisons spokesman Edmond Ross said.

On Wednesday, Assistant U.S. Attorney William Weinreb said Tsarnaev would eventually be transferred to a federal prison in Terre Haute, Indiana.

Tsarnaev has been held under the tight restrictions usually reserved for terrorists; they include solitary confinement and no contact with other inmates or the outside world.

Most prisoners subject to those restrictions serve their time at the so-called Supermax prison in Florence, Colorado, which houses some of the most notorious criminals in recent U.S. history. But the federal government’s death row is at the prison in Terre Haute, Indiana, and the judge ordered him executed under the prevailing laws of Indiana.

The Colorado prison where Tsarnaev was transferred Thursday is in the same facility as the Supermax prison, but it’s a different prison.
