The defense appears to be challenging Dr. Duval's analysis .. she has said, that, based on what lay people have described, Lizzi Marriott died of strangulation. Joachim Barth asked her about the bags tied around Lizzi's neck... the Dr. says she recalled that Kat's grand jury testimony said they were tied loosely. He pointed out that Paul Hickok said they were tied tightly. She has said it would not have an effect if she was dead prior to the bags being tied.

I have yet to see these dismiss motions succeed at any trial. I have not followed details in this case, but I do have problems with anybody being convicted of anything based on Kat's evidence. She LIED in one version or the other. Has CLEAR reasons to lie now to save her own ass. She may well be (strictly speaking) the actual "murderer" herself

Lizzi Marriott's mother testifies in Mazzaglia trial

DOVER — Melissa Marriott choked up on a witness stand Thursday morning while answering, "No we have not," to the question of whether anyone has heard from her daughter Lizzi since Oct 9, 2012.

That's the day prosecutors allege Seth Mazzaglia, 31, strangled Lizzi to death inside his Dover apartment after she declined in an invitation to engage in three-way sexual activity with Mazzaglia and his then-girlfriend Kathryn "Kat" McDonough.

Melissa Marriott testified Thursday during the fourth week of trial for Mazzaglia, who is defending in the Strafford County Superior Court against murder charges. She said she last saw Lizzi two days before she died, that her daughter was not depressed, had no medical problems, no history of seizures and got along well with her family.

Prosecution rests in Mazzaglia murder trial
Victim's mother testifies about last time she saw daughter

DOVER, N.H. —Prosecutors have rested their case against Seth Mazzaglia, who is charged with first-degree murder in the death of a University of New Hampshire student.

The state called 30 witnesses over 17 days to build its case against Mazzaglia, saying he strangled Lizzi Marriott, 19, in October 2012. Mazzaglia's ex-girlfriend, Kat McDonough was on the stand for 10 days.

On Thursday, Marriott's mother took the stand, reminding the jury of the victim at the center of the case.

Dr. Jennie Duval of the state medical examiner's office was the last witness prosecutors called. She said she based her analysis of how Lizzi Marriott died on witnesses describing a swollen and reddish face, saying that was "very consistent with a ligature strangulation."

Defense attorneys challenged that analysis. The defense plans to call an expert witness next week to support the theory that Lizzi Marriott was suffocated by McDonough during a sex act involving bondage.

The defense will begin its case Monday morning. The judge gave jurors a three-day weekend and indicated they could be deliberating by the end of next week.

As the State rests, as with most trials, it looks like the Prosecution "are winning".. but remember we have only heard one side, the Defense response is yet to come.
I do see a strong case, though, but the "devil is in the detail"... exactly WHAT level of charge? There is as always the very high standard of "beyond reasonable doubt"
I do still have problems with the "plea deal" I think both Kat and Seth are equally guilty.... and I think there was evidence enough without the deal with Kat.

Its the 18th day of testimony, and the Defense begins calling witnesses today. There are seven names listed in court filings ... among them is the investigator from the Public Defenders' office that interviewed Kat McDonough and took her statement about Lizzi Marriott dying of suffocation during bondage sex with her. Seth Mazzaglia's mother is also on the list, along with a forensics expert.

Hinckley is asking her about details Kat gave in the unrecorded conversation... and he has a letter up on a large screen, that we've seen before, its from Seth to Kat, describing what happened that night. It includes illustrations of someone in ropes... now comparing it to one Kat drew on in their interview... and points out they looked different.
