I think he's guilty too but don't believe they proved it. I'm so colored by the fact that my state made that hearsay law in order to go forward. It makes me fire-eating mad to think they can use that and then a person cannot confront the accuser. They say something to the effect that it's used in the sense that someone killed someone to prevent them from testifying which to me seems to say they have formed the guilty verdict before due process.

I read this morning that they let him out for 30 minutes to go to the funeral parlor and say goodbye to his mom who just died.

Drew Peterson attorneys want sentencing delayed
Tuesday, September 25, 2012

(CHICAGO) (WLS) -- Attorneys for Drew Peterson want his sentencing date in late November delayed.

Peterson was convicted earlier this month of killing his third wife Kathleen Savio.

The former Bolingbrook sergeant appeared in court Tuesday with attorney Joel Brodsky. Brodsky asked Judge Edward Burmila for more time because "new issues have come up." Those issues include a bitter feud among defense team members.

On Monday, attorney Steve Greenberg, who was fired after the guilty verdict, accused Brodsky of single handedly losing the trial.

The judge told Brodsky to make his request in writing and scheduled another hearing for October 18.

Drew Peterson files appeal, cites ineffective counsel


In a post-trial motion filed this morning, Peterson’s defense attorneys asked Judge Edward Burmila to take the highly unusual step of either overturning the jury’s guilty verdict or granting Peterson a new trial.

Burmila on Friday took Peterson’s January sentencing date off the calendar, instead setting the case for a status update on Jan. 10. A date for an evidentiary hearing could be set then.

Lawyers claim Joel Brodsky botched case

Drew Peterson's lawyers are seeking a new trial on the grounds that his old lawyer did a poor job.

Attorneys Steve Greenberg and David Pielet filed a motion Friday asking the judge to throw out Peterson's guilty verdict or grant a new trial, the Southtown Star reports.

Peterson was convicted Sept. 7 of first-degree murder in the drowning death of Kathleen Savio, his third wife. Peterson's fourth wife, Stacy Peterson, disappeared in October 2007.

Friday's motion claims Peterson's former lawyer, Joel Brodsky, made a number of errors during the trial including putting Harry Smith on the stand. Smith testified that Stacy Peterson told him that she knew how her husband killed Savio.

Brodsky left the defense team last month

Drew Peterson’s attorneys accuse each other of ethical violations

The battle between Drew Peterson’s attorneys escalated Monday as Joel Brodsky claimed his co-counsel Steve Greenberg suffered from mental illness and had an “intimate relationship” with a TV reporter to draw more attention to himself.

Brodsky hurled those accusations and others in a court filing responding to a memorandum filed last week by Greenberg that charged that Brodsky botched the Peterson trial by spending too much time chasing publicity for himself and their client and that Brodsky committed a “smorgasbord of ethical violations.”

Greenberg is hoping to overturn Peterson’s conviction for the murder of his third wife, Kathleen Savio, on the grounds of incompetent counsel.

Brodsky’s biting rebuttal alleged that Greenberg did his share of chasing the media by leaking sealed documents to a newspaper reporter, and that Greenberg suffered “from a severe mental illness known as pathological narcissism.”

Brodsky also accused Greenberg of conducting an “intimate relationship” with a cable TV reporter “which he developed during the trial to get more attention for himself.”

Brodsky’s charges were made in a motion to withdraw from defending Peterson against a wrongful death lawsuit that Kathleen Savio’s relatives filed against Peterson.

Brodsky offered no proof for these allegations.

Drew Peterson to make court appearance Thursday

Drew Peterson is expected to appear in court Thursday along with his attorney’s for scheduling of post trial motions.

Judge Edward Burmila had initially set the January date for Peterson sentencing, but was forced to postponed the matter due to turmoil among members of the defense team.

That ultimately lead to Peterson firing his lead attorney Joel Brodsky.

Peterson was convicted of killing his third wife Kathy Savio this past September.

A two-day hearing was set to determine whether wife-killer Drew Peterson will get another murder trial.

Drew Peterson's murder trial lasted 24 days. Now the wife-killer's looking forward to a two-day hearing to see if he gets to do the whole thing over again.

Judge Edward Burmila scheduled the hearing for Feb. 19 and 20. If the judge decides after those two days not give Peterson a new hearing after all, Burmila said he will head straight to sentencing.

Peterson attorneys seek Brodsky’s financial records

Drew Peterson’s former attorney is fighting a move by his ex-colleagues to obtain his financial records regarding Peterson’s representation as part of their motion for a new trial.

Peterson’s current attorneys want the records to help prove their belief that Joel Brodsky was motivated in part by personal financial gain when he represented Peterson. Brodsky claims the subpoena violates attorney-client privilege.

Peterson’s attorney Steve Greenberg filed a subpoena seeking the records in preparation for a Feb. 19 hearing on a motion for a new trial.

Part of that motion claims Brodsky ruined Peterson’s chances of acquittal, not the least of which was orchestrating and sensationalizing the media coverage of the case.

Brodsky “paraded Drew across the airwaves as if Drew were a sideshow, suggesting carnival-like pranks to heighten public recognition of himself and his client, as exemplified by the ‘Win a Date With Drew’ and a Bunny Ranch Reality Show,” according to one filing in the case.

In December 2007, Brodsky and Peterson struck a deal with a publicist to get the duo photo ops and television appearances, magazine spreads and even product endorsements, including commercials. The men also wanted the publicist to get them book and film deals, Peterson’s attorneys say.

In a motion to quash the subpoena Brodsky filed Friday, he points out that Greenberg appeared on a court television show during the trial, and said Greenberg sought media attention for himself while he was representing Peterson by allegedly leaking impounded court documents.

Former Drew Peterson lawyer Joel Brodsky gave in and turned over his financial records, but attorneys for the convicted wife-killer want him to hand over even more.

The attorney accused by a former colleague of blowing the Drew Peterson murder trial has surrendered his financial records, but lawyers for the convicted wife-killer want even more.

Attorney Joel Brodsky at first resisted a subpoena for his financial records but eventually complied, to an extent. Attorney Steve Greenberg—who still represents Peterson and is fighting to get him a new trial—wants additional documents from Brodsky

"There's still more records," Greenberg said after a Friday morning hearing before Will County Judge Edward Burmila. "Hopefully we'll get them and that will be that."

If Brodsky doesn't cough up the records, Burmila will convene a hearing Wednesday. The judge ordered that Peterson—who has been locked up at the county jail since his May 2009 arrest—be present for the hearing.

Brodsky failed to respond to a phone message left at his office.

New Trial For Drew Peterson? Old Lawyer Thinks So

CHICAGO (CBS) — Drew Peterson’s former lawyer, Joel Brodsky, thinks he’s found a reason for Peterson to get a new trial.

It concerns attorney Harry Smith, who testified that Stacy Peterson asked him whether she could get more money in a divorce if she threatened to use what she knew about how Peterson killed his third wife Kathleen Savio.

WBBM’s Mike Krauser reports, it was explosive testimony that didn’t go the way Peterson’s lawyers intended.

Smith testified he didn’t warn Stacy Peterson she’d be committing extortion, only concealment of a homicide.

But in an interview with the DuPage County Bar Association, he contradicts his testimony and mentions extortion.

Brodsky caught it and thinks it’s grounds for a new trial.

“I read that article and I almost fell off my chair when I read that quote, literally. It was amazing.”

He’s turned the information over to the current defense team.

“You have to understand this is key,” Brodsky said. “If Smith had testified truthfully that he told her that this was extortion, it certainly would have confirmed the defense theory [that Stacy was making baseless threats for money]. [It] would have impeached Stacy’s credibility greatly and could have resulted in a totally different verdict at the trial.”

Brodsky target says lawsuit filed 'out of spite'

A day after his former colleague on Drew Peterson’s defense team filed a libel lawsuit against him, lawyer Steven Greenberg fired back in a news release, calling Joel Brodsky’s complaint “frivolous” and filled with accusations made “purely out of spite.”

Brodsky’s lawsuit, filed Wednesday in Cook County Circuit Court, alleged that a letter Greenberg gave the Chicago Tribune presented “a false narrative” that was designed to defame Brodsky as revenge for Brodsky's attempt to have Greenberg fired from the Peterson case.

Brodsky further alleged that Greenberg defamed him by claiming he was a liar and an incompetent lawyer in order to place the blame for losing the Peterson case solely on Brodsky.

Gearing Up For Drew Peterson's Big Week: Court Supervision

Drew Peterson is either getting a new trial or he's heading to prison.

On Tuesday, the attorneys for Drew Peterson will make a final push to keep him out of prison by securing a new murder trial.

Will County Judge Edward Burmila has set aside two days for the hearing, but some involved predict it will last much longer. If, at the conclusion of the hearing, Judge Burmila decides against calling for a new trial, he plans to head straight for sentencing.

During the week that just ended, Will County State's Attorney James Glasgow took steps to avoid having to testify at Peterson's hearing. Glasgow filed court papers claiming that, as a prosecutor, special steps must be taken to force him to testify. He maintains Peterson's attorneys have failed to take those steps.

That is just one of many issues to be addressed at the hearing. Check back Tuesday to see how things play out.

Lawyers will argue for new trial days before sentencing in murder case

Drew Peterson's longtime lead attorney could find himself on the witness stand Tuesday defending his decision-making and legal skills as the former Bolingbrook police sergeant's attorneys argue that their client deserves a new trial.

But before Peterson is sentenced, his lawyers will argue that last summer's trial was so flawed that he deserves a new one. And, as with most things in the bizarre, high-profile case, what would typically be a rote hearing could turn into an unusual, theatrical proceeding.

Besides the prospect of former Peterson attorney Joel Brodsky being questioned by his defense team nemesis Steve Greenberg, the hearing is expected to include testimony from a retired judge, Brodsky's former law partner, a Peterson murder trial observer, a law professor and perhaps even Will County State's Attorney James Glasgow.

Prosecutors have filed a motion seeking to bar defense lawyers from calling Glasgow, saying Peterson's lawyers have not specified why his testimony is necessary.

Peterson's defense team is alleging that Brodsky's legal leadership — including calling a witness whose testimony several jurors said convinced them Peterson was guilty — amounted to ineffective assistance of counsel, which can be grounds for a new trial.

Peterson's defense team also will allege that Brodsky had a conflict of interest that left him more concerned about getting national media exposure than protecting his client's interests.

Brodsky said he isn't worried about testifying, whether prosecutors or the defense team call him.

Drew Peterson case: Ex-partner says Brodsky attacked her

Joel Brodsky’s ex-law partner testified that Drew Peterson’s former lead attorney had physically attacked her in the past and tried to intimidate her this morning before she took the witness stand.

The testimony from Reem Odeh, a former attorney for Peterson, came during a hearing on a motion for a new murder trial filed by Peterson’s defense team.

Burmila has indicated that if he denies the motion for a new trial, he will immediately move into the sentencing hearing.
