oralandar brand-wms Jurors for Wafer case all in jury room deliberating for second day Looks like jurors might be asking for a laptop..attys and pros might have to go on record regarding this request.. the request cld have to do with the taped police interview of Wafer judge on bench judge brining out juror number 6 before they bring up entire jury... juror #6 has a "committment on Friday" judge wants to know if he can be released before Noon..that issue resolved other jurors are out now..judge giving them "road map on how we will proceed"..tells them delibs. on Friday only from 9a-Noon.. jury gone back to jury room pros pat muscat making rec of digital info in case that have been burned onto disc looks like jurors will get laptop if they want one...the concern of internet browing not one cause no wi-fi in bldg |

Whatever faults Mr. Wafer may have had in how he acted that night, however imperfect it may seem in hindsight without the fear and adrenaline he had at the time... ...to call it "cold-blooded" is utterly absurd. And it's not just her father doing it. Lots of people are saying he WANTED to kill her, wanted to kill a black person, etc. There are no limits to peoples' stupidity. I think it's undeniable he shot her out of fear. There can be a debate had about the reasonableness of that fear, but not about whether it was fear he was experiencing. Personally, I'm inclined to give a productive home-owner and law-abiding citizen the benefit of the doubt, and not haul him off the prison for the rest of his life because he shot a repeat DUI offender and someone who was actively fleeing police at the time of her death. Him going to prison is a bigger loss for society than her being shot, if that was a loss at all. Likely was a gain. Whoever she was eventually going to kill with her DUIs is certainly better off as a result. |

I figured this would happen but only because the burden of proof doesn't seem to be up to a prosecutor anymore, and then we have this racist mentality that seemed to creep more and more into people's since our latest president took office. But then it's obvious someone wanted to divide the country. No way will I believe and I don't think many will believe that Wafer was cold blooded and shot her because she was black. She was a terror that night for sure. |

Now there's an excellent point the 'it was murder' folks tend to overlook... the person trying to enter Wafer's home at 4:00 in the morning WAS in fact a criminal, a fugitive who had fled the scene of an earlier crime. If McBride had been a male fugitive, Wafer would have never been charged imo... and I'm guessing that's why the defense fought so hard to get the photos of McBride with piles of weed and guns entered into evidence. It would have counteracted the inherent gender bias the jury no doubt brought to the table with them. |

I'm sorry to say I think the defense did a very poor job in convincing the jury of the real facts. Of course the judge played a large part in working with the prosecution to block a lot of info, and by not stressing the prosecution's burden of proof. Hope an appeal can be made soon. |

If this had been a white 37 year old male who looked like a fidgety meth head and had a bunch of tats, this never goes to trial and if it does Wafer walks. And is she any different? A serial criminal evading police at the time this took place, and high on illegal substances, including the alcohol which is illegal for her due to her age. It isn't right that he is going to prison because of what gender + age + race combination the shadowy figure he shot as a reflex due to the fear situation that person or persons had created HAPPENED to end up being. He had no concept of what or who she was at the time, he was simply reacting to the situation her drunken, high, law breaking behind had created. I also question whether the verdict is the same in an alternate reality where Zimmerman and Dunn never took place, and where the media has a lower level of interest in these split race self-defense cases. Lots of reasons to think that something other than a plain reading of the facts and law being at play in this verdict. |
