Accused teen terrorist Dzhokhar Tsarnaev will make his first public appearance since being caught cowering in a shrink-wrapped boat when he's
arraigned tomorrow in a federal courtroom on charges related to the Boston Marathon bombings and manhunt that killed four people and injured 260.

All of the accused bomber's victims have been notified of the 3:30 hearing in U.S. District Court in Boston, but Christina DiIorio-Sterling, spokeswoman for the U.S. attorney's office, said she is unable to discuss how many plan to attend.

They did need to question him... so held off on the use of the red dot.

But as it turns out, especially with the dopey move to read him Miranda rights before being questioned.... seems a pity that the red dot was not used at the time.

I believe a head shot is called for in such circumstances... so that it is less likely he will remain alive for enough seconds to activate some explosive device etc.
It was mentioned in the discussion of TM remaining alive for seconds (minutes) after a heart shot. A head shot is preferred for situations requiring instant death (if possible)

Rumpole; I read an article at L.I. indicating that Radical Islam isn't responsible for motivating the deceased Boston Bomber but rather Conservative America was the motivation which caused the terrorist attack.

Tsarnaev friends indicted in bombing investigation

BOSTON (AP) -- Two friends of suspected Boston Marathon bomber Dzhokhar Tsarnaev were indicted Thursday for allegedly trying to throw away fireworks and other items police say they found in Tsarnaev's dorm room before his capture.

Authorities later found some of the items in a New Bedford landfill, the federal indictment says.

Dias Kadyrbayev and Azamat Tazhayakov, both 19, face charges of conspiracy to obstruct justice. The two, who shared an apartment in New Bedford, have been detained since they were charged in May. If convicted, they face up to 20 years in prison.

Azamat Tazhayakov and Dias Kadyrbayev have been indicted by a federal grand jury in Boston on charges of Obstruction of Justice and Conspiracy to Obstruct Justice. The Indictment is here.

Robelo Philliipos was not indicted. His lawyer says he is still negotiating with the Government.

What's missing from the Indictment? Any reference to what the two told the FBI during their early interviews. Did DOJ conclude their statements were inadmissible? The Complaint against them had alleged:

    KADYRBAYEV, TAZHAYAKOV, and PHILLIPOS were each interviewed during this investigation. As set forth below, all three have admitted that on the evening of April 18, 2013, they removed Tsarnaev's backpack from Tsarnaev's dormitory room, and KADYRBAYEV and TAZHAYAKOV have admitted that they agreed to get rid of it after concluding from news reports that Tsarnaev was one of the Boston Marathon bombers.

Tsarnaev Friends Plead Not Guilty at Arraignment

BOSTON (CBS/AP) — Two college friends of the surviving Boston Marathon bombing suspect were arraigned Tuesday on charges of disposing evidence from the suspect’s dorm room.

Documents detail Boston bombing suspect Dzhokhar Tsarnaev's injuries

(CNN) -- Boston marathon bombing suspect Dzhokhar Tsarnaev suffered multiple and severe gunshot injuries before his capture in April, newly released court documents show.

The most serious of the injuries was a gunshot wound that appeared to enter through the left inside of his mouth and exit through the lower left side of his face, said Stephen Ray Odom, a trauma surgeon who treated Tsarnaev at Beth Israel Deaconess Medical Center.

"This was a high-powered injury that has resulted in skull-base fracture, with injuries to the middle ear, the skull base, ... his ... vertebrae ... as well as injury to the pharynx, (and) the mouth." Odom said in testimony given April 22, three days after Tsarnaev was arrested following the bombing.

His testimony, unsealed Monday, does not say whether the 20-year-old college student inflicted the wound on himself or suffered it during his showdown with police April 19.

It was likely the most terrifying manhunt in Boston history. With the city under lockdown and armored vehicles rolling through Watertown, the alleged Boston Marathon bomber Dzhokhar Tsarnaev had seemingly vanished. While the rest of Greater Boston experienced the unfolding dragnet on April 19 as a series of indirect glimpses, Sergeant Sean Murphy, in his assignment as a tactical photographer with the Massachusetts State Police, was behind police lines, documenting the day’s events. Months later, Murphy walked into our offices and told us he was furious with the way Tsarnaev was being portrayed on the cover of Rolling Stone magazine. He turned over a number of his photos to us because, he said, the suspect in the pictures he took that night was the actual face of terrorism, not the “fluffed and buffed” image on the Rolling Stone cover. Murphy knew he was taking a risk by handing over his photos—and after 14 of his images were published on bostonmagazine.com, he was suspended for a day. (When the print edition of this story went to press, Murphy had been placed on restricted duty. He’s now been transferred to the State Police barracks in Athol, where he is assigned to the 11 p.m. to 7 a.m. shift.) “I hope that the people who see these images will know that this was real,” Murphy told us the day we published his images. “It was as real as it gets.” In the September issue of Boston, we published more of Murphy’s dramatic photos. Here, we present those images as well as a selection of others that did not run in the print edition.

Third Friend of Dzhokhar Tsarnaev Indicted

Robel Phillipos, the third friend of Jahar Tsarnaev who was arrested for making false statements to the FBI related to the terrorism investigation into the Boston Marathon bombing, has now been indicted. He's charged with two counts of making a false statement in a matter involving domestic or international terrorism. The Indictment is here. It alleges his false statements material and made knowingly and willfully.

His attorneys previously said they were working on a disposition. No more. They now say he will fight the charges. My translation: Negotiations over sentencing broke down

Interesting because I do think it was overkill with Aaron Swartz as mentioned in the article but to me the actions of the teens and those of Aaron are such different animals. But they may have just been teens helping a friend so I'm torn. Hmmm

Two friends of Boston bomber plead not guilty to cover-up charges

(Reuters) - Two college friends of accused Boston Marathon bomber Dzhokhar Tsarnaev pleaded not guilty on Friday to charges that they helped cover his tracks when the FBI was trying to find the people responsible for the April 15 attack.

The appearance in federal court in Boston of a third man charged in the same case was postponed until later on Friday. All three are charged with going to Tsarnaev's dorm room three days after the bombing, where they removed a laptop and a backpack containing empty fireworks shells after receiving a text message from him telling them to "go to my room and take what's there," according to court papers.

Dias Kadyrbayev, of Kazakhstan, pleaded not guilty to the charge of obstruction of justice and could face 25 years in prison or deportation. His lawyer, Robert Stahl, said after the hearing that Kadyrbayev did not understand what Tsarnaev had done.

"There was no criminal intent from him to help Dzhokhar, no obstruction of justice in any way," Stahl told reporters.

Robel Phillipos, of Cambridge, Massachusetts, pleaded not guilty to charges of lying to investigators and could face up to 16 years in prison. Lawyers and supporters of Phillipos ushered him out of the courthouse and into a waiting black sports utility vehicle.

FBI victim linked Tamerlan Tsarnaev to triple killing

At some point before he was shot to death in a confrontation with the FBI, Ibragim Todashev tied his buddy Tamerlan Tsarnaev’s to a triple murder in Waltham, according to papers filed in U.S. District Court in Boston.

“According to Todashev, Tamerlan Tsarnaev participated in the Waltham triple homicide,” reads a motion filed by federal prosecutors.

Prosecutors are trying to stop defense lawyers for Dzhokhar Tsarnaev from obtaining documents related to the elder Tsarnaev’s purported role in the Waltham slayings. In the filing, they state it could hurt the investigation into the Sept. 11, 2011 crime by the Middlesex District Attorney’s office.

Lawyers for bombing suspect Dzhokhar Tsarnaev are hoping to get a federal judge to lift “extraordinary restrictions on attorney conduct and communications,” according to a court filing submitted yesterday.

One item the lawyers argued for was the ability to discuss points of the case among their investigators, paralegals, and mitigation experts.

“It is impossible to imagine all of the circumstances in which the defense team will need to use or share information obtained from Mr. Tsarnaev and it would be a gross violation of defense autonomy, confidentiality, and work product to seek pre-approval from the government in every such instance,” Tsarnaev’s lawyers wrote regarding one point. “The restrictions on defense ‘dissemination’ of information are unconstitutionally restrictive and vague.”

In an affidavit attached to the filing, one of Tsarnaev’s lawyers stated that during a prison visit he was forbidden to show Tsarnaev photographs related to preparing his defense because they contained images of family members, which he is barred from seeing.

A hearing on this motion is scheduled for Nov. 12 in U.S. District Court in Boston.

BOSTON — The messages that accused Boston Marathon bomber Dzhokhar Tsarnaev wrote on the inside walls of the boat he hid in during a police manhunt four days after the attack were intended to explain his actions should he die, his lawyers argued.

The accused bomber, who faces the possibility of execution if convicted on charges tied to the April 15 attack that killed three people and injured 264, did not intend to incite further violence with messages including "the U.S. government is killing our innocent civilians" and "I can't stand to see such evil go unpunished," defense attorneys said in court papers filed late on Monday.

"On their face, Mr. Tsarnaev's alleged words simply state the motive for his actions, a declaration in anticipation of his own death. There is no express call for others to take up arms," the 20-year-old defendant's lawyers said.

Prosecutors have argued that Tsarnaev poses both a safety risk to prison officials and that his words could inspire others to plan attacks similar to the Boston Marathon incident, where Dzhokhar Tsarnaev and his other brother, Tamerlan, planted a pair of homemade pressure-cooker bombs at the crowded finish line.
