Terror suspect Dzhokhar "Jahar" Tsarnaev was charged on Monday with two federal counts of using a weapon of mass destruction to kill, injure and cause widespread damage at the Boston Marathon a week ago. If convicted, the 19-year-old could face the death penalty.

Three people were killed and more than 200 others wounded when two powerful homemade bombs exploded near the race’s finish line.

The bed-ridden Tsarnaev was informed of the charges and read his rights in his hospital room Monday morning. The college student is in serious condition at Beth Israel Deaconess Medical Center, where he is under heavy police guard.

Tsarnaev, who is sedated and unable to speak, suffered apparent gunshot wounds to the head, neck, hand and legs during firefights with police before his capture Friday night, authorities said. His older brother Tamerlan Tsanraev, who investigators say was part of the terror attack, died in a firefight with police during their escape attempt.

In a 10-page criminal complaint against Dzhokhar, an FBI agent says investigators have overwhelming photographic evidence showing the brothers placing two backpack bombs in the crowd at the race finish.

A large pyrotechnic and clothing Dzhokhar wore during the terror attack were later found in his dorm room at the University of Massachusetts at Dartmouth, according to the charges.

The complaint sheds no light on a motive for the attack. Miriam Conrad, Dzhokhar's federal public defender, asked the court to also appoint two more attorneys who are, “learned in the law applicable to capital cases.”

Dzhokhar Tsarnaev, suspected Boston bomber, given bedside hearing

A federal magistrate, prosecutor and public defender held an extraordinary court session Monday in the hospital room of Dzhokhar Tsarnaev, providing the first glimpse of the accused Boston Marathon bomber since his arrest Friday.

The bedside hearing, according to an official transcript by a court reporter, began with Dr. Stephen R. Odom, a trauma surgeon, making sure that Tsarnaev was well enough for the hearing.

She added: “I find that the defendant is alert, mentally competent and lucid. He is aware of the nature of the proceedings.”

She set another hearing in Boston for May 30.

Thanks from me, too, credence! I was looking for some kind of official information like this, but got too distracted with real life.

I just cannot fathom how this 19 year old has wreaked so much destruction - of innocent others and of himself. Imagining what he is in for, I'm sure he will soon come to realize that his brother was the lucky one.

Judy Clarke Appointed to Represent Dzhokhar Tsarnaev

Dzhokhar Tsarnaev just got the biggest gift of his life -- Judy Clarke has been appointed by the court to represent him along with the Federal Defenders.

Among the lives Judy has helped save: Jared Loughner, Eric Rudolph, Susan Smith, and Ted Kaczinski.

I wrote a week ago that her phone must be ringing off the hook, and I'm so glad she accepted the appointment. There is no one more suited for the task and more capable. More on Judy here and here.

Tsarnaev has become the new poster child for "the worst of the worst." If anyone can gain his trust to be able to provide him an effective defense and save his life, it's Judy.

Judy rarely talks to the media but last week, she was the keynote speaker at a Loyola Law School conference, and spoke a little bit about being a death defense lawyer.

BOSTON — The defense team representing the Boston Marathon bombing suspect got a major boost Monday with the addition of Judy Clarke, a San Diego lawyer who has managed to get life sentences instead of the death penalty for several high-profile clients, including the Unabomber and the gunman in the rampage that injured former Arizona Rep. Gabrielle Giffords.

Clarke’s appointment was approved Monday by U.S. Magistrate Judge Marianne Bowler.

Bowler denied, at least for now, a request from Miriam Conrad, the public defender of 19-year-old suspect Dzhokhar Tsarnaev, to appoint a second death penalty lawyer — David Bruck, a professor at Washington and Lee University School of Law.

Tsarnaev has been charged with using a weapon of mass destruction during the April 15 marathon. Three people were killed and more than 260 injured when two bombs exploded near the finish line.

The suspect’s lawyers could renew their motion to appoint another death penalty expert if he is indicted, the judge said.

Clarke’s clients have included the Unabomber, Ted Kaczynski; Susan Smith, who drowned her two children; Atlanta Olympics bomber Eric Rudolph; and most recently Tucson, Ariz., shooter Jared Loughner. All received life sentences instead of the death penalty.

Accused Boston bomber Dzhokhar Tsarnaev's friends hid damning evidence, feds say

BOSTON Three college friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev were arrested and accused Wednesday of removing a backpack containing fireworks emptied of gunpowder and a laptop from Tsarnaev's dorm room three days after the attack to try to keep him from getting into trouble.

In court papers, the FBI said one of them threw the items in the garbage after they concluded from news reports that Tsarnaev was one of the bombers.

On "CBS This Morning" Thursday, CBS News correspondent Elaine Quijano reported from Boston that investigators recovered the laptop and the backpack last week in a New Bedford, Mass., landfill.

All it takes is for one or two unnamed federal law enforcement officials to make an unsubstantiated claim and every media outlet runs with it as if it is true. The latest: Claims that Dzhokhar Tsnarnev told the FBI the bombs for Boston were made in the apartment Tamerlan Tsarnaev shared with his wife and that the brothers initially planned on bombing Boston on the 4th of July but it was so easy to build the bombs they moved up their timetable

While rushing to publish the unsubstantiated report, the CNN article misses the mark on how and when the FBI obtained Dzhokhar Tsarnaev’s laptop.

What does it tell us that law enforcement is only too willing to leak Dzhokhar’s uncounseled post-arrest statements but refused to confirm for two weeks that it had his computer, and has said nothing about any incriminating information found on it? And that the only way we find out when and how the FBI got it is from defense counsel? Probably that nothing pertinent was on the computer, or they would have leaked that too.

The attorneys for Boston Marathon bombing suspect Dzhokhar Tsarnaev cannot take their own periodic photos of him, a judge ruled Friday, denying the request pertaining to "his evolving mental and physical state" and whether his statements to authorities after his arrest were made voluntarily.

U.S. Magistrate Judge Marianne Bowler found Tsarnaev's lawyers could not take their own photos, saying the Fort Devens prison where Tsarnaev is housed has a policy against visitors bringing cameras.

The motion from Tsarnaev's lawyers remained sealed Friday. But in her ruling, Bowler included excerpts from the defense filing which suggest Tsarnaev's lawyers may want to use the photos to argue for "sentence mitigation."

Tsarnaev, 19, is charged with using a weapon of mass destruction in the April 15 bombings. The two explosions near the finish line of the marathon killed three people and injured more than 260.

The lawyer heading the defense for the alleged Boston Marathon bomber in federal court in Boston is well-versed in capital cases and the long, emotionally charged process that would come if federal prosecutors seek the death penalty, according to legal observers and her own colleagues.

Judy Clarke, a former public defender now working as a private lawyer in San Diego, has been tapped to represent Dzhokhar Tsarnaev, the 19-year-old from Cambridge charged in the bombings that killed three people and injured more than 260. Three other public defenders from Boston have also been assigned to the case, including one who speaks Tsarnaev’s native Russian.

Cases involving the death penalty allow for the appointment of an outside lawyer “learned in the law applicable to capital cases,” according to court records, and Clarke has been at the center of some of the most high-profile cases that the country has seen in recent times — cases that often include emotionally charged public calls for the death penalty.

Dzhokhar Tsarnaev's Lawyers To Get Prison Files

BOSTON — A judge approved a request Monday by Boston Marathon bombing suspect Dzhokhar Tsarnaev's defense attorneys to receive records compiled on him in federal prison.

U.S. Magistrate Judge Marianne Bowler said in her order that prison officials should give attorneys the daily activity logs, suicide watch logs, psychology data files, photographs, commissary files they requested, and other records.

The judge said prosecutors also are entitled to the records, turning down a defense request that the records not be provided to the government until the defense had a chance to file objections to a judge. She also found no reason to keep private the defense's sealed request.

Bowler ruled Friday that defense lawyers couldn't take their own photos of Tsaraev in prison, but said prison officials could take photos of Tsarnaev with his lawyers present. Those also would be shared with prosecutors.

BOSTON (AP) — A federal judge has rescheduled a probable cause hearing for surviving Boston Marathon bombing suspect Dzhokhar Tsarnaev.

U.S. Magistrate Judge Marianne Bowler on Thursday scheduled the hearing for July 10.

Bowler earlier this week granted a joint request from prosecutors and defense attorneys to postpone the hearing originally scheduled for May 30 until July 2. The lawyers say they need more time to obtain and review evidence.

IN HIS FIRST phone call to his mother in Russia since he was arrested on 20 April, Dzhokhar Tsarnaev, the teenaged Boston bombing suspect who could face the death penalty, said his fate was now "in God's hands".

Zubeidat Tsarnaeva said she couldn't stop herself from crying during her first conversation with her 19-year-old son in more than a month. "He said: ‘I am absolutely fine, my wounds are healing. Everything is in God's hands. Be patient. Everything will be fine'", Tsarnaeva told Bloomberg.

The mother of Boston bombing suspect Dzhokhar Tsarnaev said he claims innocence in the attack that killed three people and injured more than 250 others at the finish line of last month’s Boston Marathon.

Zubeidat Tsarnaeva said her 19-year-old son told her in a phone call this week that he and his slain brother, 26-year-old Tamerlan Tsarnaev, are innocent of the April 15 bombings, despite authorities saying there’s strong evidence that the duo were behind the attacks and that Tsarnaev allegedly confessed to the attacks.

Dzhokhar Tsarnaev is being held in a federal facility that treats injured suspects and inmates; he is recovering from injuries he sustained in a shootout with authorities in Watertown, Mass., that left Tamerlan dead.

Report: Dzhokhar Tsarnaev says he has donors

Boston bombing suspect Dzhokhar Tsarnaev has told his mother that he is receiving donations from people and even has a bank account set up for funds, according to a new report.

In a recording of their first phone call from prison, Tsarnaev told his mother that he received about a thousand dollars in a bank account that someone set up for him since his arrest, according to ABC News. His mother, Zubeidat Tsarnaeva, has also said that the family received $8,000 from supportive donors. The details of the recording was originally released by Channel 4 News in the U.K.

Boston Marathon suspect Dzhokhar Tsarnaev downloaded bomb-making instructions from an al-Qa'ida magazine, legal documents revealed.

He also gathered online material on Islamic jihad and martyrdom and later scrawled anti-American messages inside the boat where he lay wounded, a charge sheet alleged.

The 30-count indictment contains the bombing charges, punishable by the death penalty, that were brought in April against the 19-year-old Tsarnaev, including use of a weapon of mass destruction to kill.

It also contains many new charges covering the killing of an Massachusetts Institute of Technology police officer and the carjacking of a motorist during the getaway attempt that left Tsarnaev's older brother, Tamerlan, dead.

"Tamerlan Tsarnaev's justice will be in the next world, but for his brother, accountability will begin right here in the district of Massachusetts," Suffolk District Attorney Daniel Conley, whose jurisdiction includes Boston, said.

The indictment provides one of the most detailed public explanations to date of the brothers' alleged motive - Islamic extremism - and the role the internet may have played in influencing them.
