Robert Durst

From wikepedia
Quote:
Robert Alan Durst (born April 12, 1943)[1] is a son of New York City real estate mogul Seymour Durst and a brother of commercial developer Douglas Durst. He came to media attention in the 1980s when his wife disappeared, and again in the early 2000s when he was the subject of a multi-state manhunt and acquittal of murder.

On March 14, 2015, Durst was rearrested in New Orleans on a first-degree murder warrant issued by the Los Angeles Police Department. If convicted in California for the murder of Susan Berman, Durst could face the death penalty for "special circumstances of murder of a witness and lying in wait".

Quote:
Arrest for Berman murder
After a first-degree murder warrant was issued by the Los Angeles Police Department, Durst was arrested by FBI agents on March 14, 2015, at the Canal Street Marriott in New Orleans, where he had registered under the false name "Everette Ward". Durst, who was observed wandering aimlessly in the lobby and mumbling to himself, was thought to have driven to New Orleans from Houston four days before. In addition to a .38 Smith & Wesson revolver loaded with four live rounds and one spent shell casing, police recovered five ounces of marijuana, Durst's birth certificate and passport, a full-face latex mask, the fake Texas ID used to check into the hotel, and $42,631, mostly in $100 bills stuffed into small envelopes. Police also discovered tracking numbers and UPS documents “for a shipment of a large sum of cash monies". Bank statements found in one of Durst's Houston condominiums revealed cash withdrawals of $315,000 in little more than a month.

Douglas Durst said he was "relieved" and "grateful" in a statement shortly after his brother's arrest. He added, "We hope he will finally be held accountable for all he has done."

On March 15, 2015, New York State Police investigator Joseph Becerra, long involved with the Kathie Durst case and said to be working closely in recent months with FBI and Los Angeles detectives, removed some sixty file boxes of Durst's personal papers from the home of a Durst friend in Campbell Hall, New York, where they had been sent by Durst's wife three years before for safekeeping.

On March 16, 2015, attorney Dick DeGuerin, who also represented Durst during his 2003 trial for the killing of Morris Black, advised court authorities in New Orleans that his client waived extradition and would voluntarily return to California "to get it on". Late the same day, Louisiana State Police filed charges against Durst for being a felon in possession of a firearm and for possession of a firearm with a controlled substance, which could delay his return to California. Orleans Parish District Attorney Leon Cannizzaro commented that, in light of prior convictions which could influence Durst's sentencing, "[j]ust for those gun charges here in Louisiana, [Durst] could face up to life in prison".

Robert Durst Is Doing Well in Louisiana Jail Ahead of L.A. Extradition: Lawyer

Image

Millionaire murder suspect Robert Durst is "doing as well as can be expected" as he awaits extradition to California, his attorney told NBC News Saturday.

"He's in a good place," defense attorney Dick DeGuerin said of the jail where Durst is being held. "They have full medical facilities where he is being held ... I don't think it's unusual for a 71-year-old or a 72-year-old man to have medical conditions. He's a cancer survivor."

Durst, 71, is under suicide watch at a Louisiana jail after being arrested in New Orleans on March 14 on a warrant out of Los Angeles, where he was charged in the 2000 murder of his confidant, Susan Berman.

I watched the 6 part HBO documentary about Robert Durst. I'd never heard of him or the Dursts when I lived in NJ.

I'm amazed that the jury in the Morris Black case voted not guilty, even though they didn't seem like the sharpest knives in the drawer. I am even more amazed that he would jeopardize his freedom by participating in the documentary against his lawyer's advice. Stupid move for such a clever (or should I say cleaver?) man.

Robert Durst denied bail; new details emerge in case

A Louisiana judge ruled Monday that Robert Durst, the millionaire real estate heir charged with first-degree murder, will be held without bail.

That's no big surprise. In 2001 -- the last time he was accused of murder and released on bail -- Durst fled to Pennsylvania, where authorities caught him after he tried to shoplift a sandwich from a supermarket.

As the attorneys sparred in court and witnesses testified Monday, they revealed new details about the investigation that led to Durst's March 14 arrest, and set the stage for what will surely be a fierce legal battle.

Sorry, I'll move Moby.

No problem! - Mal

Actually the song, "Lie Down in Darkness" would be eerily appropriate for this thread.

But Hallelujah that Durst was denied bail, he would disappear again.

Authorities say Robert Durst linked to 1971 disappearance of Vermont college student

Authorities in Vermont say that real estate heir and accused murderer Robert Durst has been linked to the 1971 disappearance of a Middlebury College student.

Schulze, an 18-year-old freshman at Middlebury, was last seen on the afternoon of Dec. 10, 1971, across from a bus station and a health food store that Durst owned and operated with his then-wife Kathleen, who would disappear herself 11 years later. Earlier that afternoon, authorities said that Schulze had been seen outside Durst's store eating dried prunes that she had purchased there.

I agree Carm. He even said this in the HBO documentary "The Jinx". Per Durst: "You can't give someone charged with murder bail because they're going to run away, of course. Goodbye, $250,000. Goodbye, jail. I'm out."

Per the CNN article:

Last week, court documents revealed Durst had a loaded .38-caliber revolver, 5 ounces of marijuana, his passport and birth certificate, a neck-to-head latex mask with salt-and-pepper hair attached and more than $40,000 cash, mostly in $100 bills.

Among his possessions, he also had a UPS tracking number. The package was later intercepted by the FBI, prosecutors said in court Monday.

It contained clothing and more than $100,000 in cash.

Maybe this time he was going to flee the country.

Sounds like a lovely candidate to be denied bail.

Robert Durst continues to elude officials in N.Y. case

USAToday | April 16, 2015
By Jonathan Bandler, The (Westchester County, N.Y.) Journal News

WHITE PLAINS, N.Y. — He's been acquitted of murder in Texas and now faces a murder charge in California and gun charges in Louisiana. But a resolution of the case for which multimillionaire real estate scion Robert Durst has been a suspect the longest — the Jan. 31, 1982, disappearance and presumed death of his first wife Kathie — has eluded law enforcement. What evidence do Westchester investigators have against the Scarsdale, N.Y., native and what are they lacking?

Durst, 71, is an estranged member of a prominent New York City family that owns a multibillion-dollar real-estate company. He was arrested in New Orleans in March on a first-degree murder charge out of Los Angeles. A federal grand jury indicted Durst on April 10 on being a felony in possession of a weapon.

WHAT THEY DON'T HAVE

Federal gun trial for Robert Durst delayed until September

NOLA
By Jonathan Kaminsky | April 21, 2015

Reuters) - The trial of real estate scion and accused murderer Robert Durst on a federal weapons charge in New Orleans has been delayed until September after his lawyers requested more time to prepare his defense, court records show.

Durst's lawyers had sought his speedy extradition to Los Angeles County, where prosecutors want him in connection with the 2000 killing of a longtime friend, Susan Berman, in a case recently chronicled in the HBO documentary series "The Jinx: The Life and Deaths of Robert Durst."

But by asking for an extension in the weapons case, in which Durst has pleaded not guilty to a charge of being a felon in possession of a firearm, Durst's lawyers appear to have conceded he will be in Louisiana for the foreseeable future.

The request for more time was granted on Monday by U.S. District Court Judge Helen Berrigan, with a new trial date set for Sept. 21, court records show.

Millionaire Durst's trial pushed back January

ASSOCIATED PRESS
August 5, 2015

NEW ORLEANS - A federal judge has postponed real estate heir Robert Durst's trial until next year.

U.S. District Judge Helen Berrigan rescheduled the trial Wednesday from Sept. 21 to Jan. 11.

Defense attorneys asked in July for a later date, saying they'll need more time to prepare after the judge rules on pending motions.

Those include one seeking to dismiss as evidence everything taken from Durst's hotel room - including the .38-caliber revolver he's accused of possessing illegally after a felony conviction.

That motion is scheduled for argument Sept. 16.

Durst's lawyers contend, among other things, that the FBI and state police searched the room illegally, before they got a warrant.

Durst has waived extradition to California, where he's accused of murder. The weapons charge has kept the 72-year-old millionaire in Louisiana.

Federal judge: Prosecutors can use evidence obtained from Robert Durst's hotel room

By WDSU.com Staff | October 6, 2015, 5:56PM

NEW ORLEANS —A federal judge said prosecutors may use evidence obtained from the hotel room and during questioning of fugitive real estate heir Robert Durst.

The ruling allows federal prosecutors to continue with a weapon charge that is keeping Durst in Louisiana even though he faces a murder charge in Los Angeles.

Durst's lawyers said the warrant to search his hotel room was invalid because it was based on a previous warrantless search by FBI agents.

Judge Helen Berrigan ruled Tuesday that the judge who signed the warrant had other reasons to find probable cause for a search. She noted that the sworn statement supporting the search warrant was almost identical to one supporting an arrest warrant sworn out three days earlier.

Very interesting 5-min video of Judge Pirro on "Outnumbered" today, talking about her special airing this weekend and her involvement in the Robert Durst cases.

The Robert Durst murder case: My crusade for justice
By Judge Jeanine Pirro | FoxNews | November 6, 2015

Programming Alert: For 15 years, Judge Jeanine Pirro has searched for the truth. Now, she takes you inside her shocking investigation and lays out the case against Robert Durst. Don't miss "Robert Durst and My Quest for Justice," hosted by Judge Pirro, on Saturday and Sunday at 9p/12a ET on Fox News Channel.

Believe it or not, I was cast as the bad guy 15 years ago when I reopened the cold case of Kathleen Durst, a young and beautiful fourth-year medical student who disappeared without a trace in 1982, never to be seen again. Kathie Durst’s husband was millionaire real estate heir Robert Durst, son of one of the wealthiest families in New York City-- but though her friends and family suspected him of the worst, he escaped police investigation.

Robert Durst expected to plead guilty in New Orleans gun case
By Holly Bailey | Yahoo News | November 16, 2015

Robert Durst, the eccentric New York real estate heir who was the focus of HBO’s crime documentary “The Jinx,” is scheduled to be re-arraigned next month in New Orleans, suggesting he plans to plead guilty to a federal gun charge there.

Dick DeGuerin, a Houston attorney who heads up Durst’s legal team, declined to comment on a potential plea deal, but in a statement, he suggested the new development would speed up Durst’s extradition to Los Angeles, where he is facing a murder charge in the 2000 death of a longtime friend and confidant, Susan Berman.
[...]
Until Durst is transferred to California and formally arraigned there, his legal team cannot see what evidence prosecutors have against him in the Berman slaying. But in an interview with Yahoo News earlier this year, DeGuerin called their case “flimsy” and “weak.”

“They've got an entertainment show and 15-year-old evidence that wasn't good enough back then and is not good enough now,” DeGuerin said.

In a federal court filing Monday, U.S. District Judge Mary Ann Vial Lemmon set a Dec. 17 hearing for Durst to enter a new plea in the gun charge case.

Robert Durst is sued for $100 million by his first wife's family over her 1982 disappearance
By Molly Hennessy-Fiske | Los Angeles Times | November 30, 2015

Relatives of embattled New York real estate scion Robert Durst’s missing first wife filed a $100-million lawsuit against him Monday in New York, arguing he violated their right to bury her.

When Kathleen Durst, 29, initially disappeared from the couple’s suburban New York home in 1982, her husband told investigators that he dropped her off at the train station to take a train to the city, then spoke with her by phone once she arrived.

He denied having anything to do with her disappearance. She was pronounced dead in 1988, although her body was never found.
[...]
Durst, 72, remains in prison in Louisiana facing federal gun charges.

He is expected to change his plea in that case and could be sentenced Dec. 17 to more than five years in prison, then be extradited to California in the Berman murder case. He has insisted he had nothing to do with Berman's fatal shooting.

His Houston-based attorney, Dick DeGuerin, has refused to discuss the pending plea bargain in the gun case, and was in New Orleans on Monday.

“We’re not going to comment on it until the day it happens,” DeGuerin said via email, adding: “There is no evidence that Robert Durst had anything to do with Kathleen’s disappearance. Anybody can file a lawsuit, but eventually they’ll have to come with evidence.”

Delay in plea deal for real estate heir Durst in New Orleans
By The Associated Press | December 16, 2015

NEW ORLEANS (AP) — Court filings show that Robert Durst still has a plea deal with federal prosecutors in New Orleans but won’t sign it this year.

He had been scheduled for a change-of-plea hearing Thursday on a weapons charge.

But prosecutors and defense attorneys told Judge Helen Berrigan in a joint motion Tuesday that scheduling conflicts rule out all dates before a Jan. 11 trial date.

Berrigan rescheduled the trial for March, noting that will let both sides set a new date for the re-arraignment and plea agreement.

Robert Durst agrees to Los Angeles extradition
By Associated Press | New York Post | December 23, 2015

Robert Durst and his attorneys jointly filed an agreement with the Los Angeles County district attorney’s office. It stipulates that Durst will be extradited from Louisiana to Los Angeles no later than Aug. 18.

Court filings have shown that Durst has struck a plea deal with federal prosecutors on a weapons charge in New Orleans. The weapons charge has kept Durst jailed in Louisiana since March, even though he waived extradition on the murder charge in Los Angeles.

Robert Durst pleads guilty to Louisiana gun charges
By Jacki Jing | WGNO.com | February 3, 2016

NEW ORLEANS (WGNO) - Real estate heir and accused murderer Robert Durst pleaded guilty in federal court to a weapons charge in New Orleans Wednesday.

A weak, feeble Robert Durst shuffled into the courtroom wearing an orange jumpsuit and handcuffed chained at the waist. The 72-year-old repeatedly said he couldn't hear well when asked questions and said he was on a "whole slew of medications."

But when asked if he was guilty, he responded clearly and quickly, saying, "I plead guilty".

Durst has been stuck in Louisiana since March. Police arrested him after a revolver was found in his New Orleans hotel room. He allegedly was trying to flee the country. He is also accused of murdering a friend in Los Angeles 15 years ago.

[...] But Durst is not out of the woods yet. The judge has not agreed. The judge ordered that Durst meet with a probation officer in two weeks for a pre-sentence report.

Then sentencing will be on April 27, 2016.

Family Asks Judge to Declare Robert Durst's Missing Ex Dead
By The Associated Press | ABC News | April 1, 2016

Family of the ex-wife of troubled New York real estate heir Robert Durst have asked a judge to declare her legally dead 34 years after she was last seen.

In affidavits filed in Manhattan Surrogate's Court this week, Kathleen Durst's sisters and mother ask a judge to issue a death certificate.

They need a judge's declaration to pursue a wrongful death lawsuit against Robert Durst.

The family believes the 72-year-old millionaire killed Kathleen Durst in 1982. He hasn't been charged in connection with her disappearance.

Los Angeles prosecutors allege Durst killed a friend in 2000 to keep her from talking to authorities about Kathleen.

Judge accepts Robert Durst plea deal on gun charge
By The Associated Press | ABC13.com | April 27, 2016

NEW ORLEANS, LA -- A New Orleans judge has accepted Robert Durst's plea deal on a weapons charge.

Durst will serve 7 years and one month in prison on the charge that's kept him in Louisiana pending a murder trial in California.

Judge Kurt Engelhardt approved the sentence which Durst, 72, accepted as part of his guilty plea in February.

The most recent such statement was in a motion filed Monday asking U.S. District Judge Kurt Engelhardt to recommend that Durst serve his time at Terminal Island, California, about 30 miles from downtown Los Angeles, because it's near where Durst faces trial and it has medical facilities Durst needs because of his "advanced age and serious health considerations, including mobility challenges."
