JACKSONVILLE, Fla. - A circuit judge on Tuesday pushed back Marissa Alexander's retrial by five months to consider the implications of the so-called "warning-shot bill" passed by the Florida Legislature and awaiting Gov. Rick Scott's signature.

Alexander's 2012 conviction and 20-year sentence were overturned last fall. She was found guilty of firing of what she claimed was a warning shot during a fight with her estranged husband.

Alexander was sentenced under the state's 10-20-Life guidelines on charges that she fired a gun at Rico Gray and two of his children.

Before the first trial, Alexander's request for immunity under the state's self-defense law, better known as the stand your ground law, was denied. But as she awaited a new trial on charges of armed aggravated assault, her lawyers have filed a motion for reconsideration of her stand your ground claim.

Her attorney is now asking that Alexander should be granted a second "stand your ground" hearing prior to her retrial.

At Tuesday's hearing, the defense argued that with the pending legislation, it would be unrealistic to get everything together and organized for trial by the scheduled July 21 date, and the state agreed.

It was with considerable astonishment that I read the following headline in an ABC news post:

Marissa Alexander, who fired warning shot at husband attacking her, likely won’t see prison after Florida changes ‘Stand Your Ground’ law

One wonders if they had to work extra hard to get four errors into a single headline, or if it’s just a talent. Let’s take a look at them one at a time. I guess we’ll never know, because no authorship is associated with the piece. If I’d written this post, I’d want to be anonymous, too.
Alexander “Fired Warning Shot”

The article states:

She said she raised the gun and fired a warning shot into the air to scare him off, rather than hurt him.

Really. She fired a warning shot “into the air”? Well, I suppose any time one fires a gun without being either under water or in space, one is technically firing “into the air.” The impression they are trying to create, of course, is that Alexander fired upwards into the air, that is, in a harmless direction, because she wished “to scare him off, rather than hurt him.”

It’s curious then, then the forensics photos don’t show a bullet hole in the ceiling above where Alexander was standing. Instead, the bullet hole in the room in which she fired the gun is in the wall behind where her husband and his two minor children were passing. The bullet she fired “into the air” travelled through that air horizontally, past the heads of her husband and his children, into the wall behind them, through that wall, into the next room, and finally embedded itself into the ceiling of the next room.

One of the children who took the witness stand at Alexander’s first trial testified that he thought they were going to die.

That’s some “warning shot.”

JACKSONVILLE, Fla. -- Duval County Circuit Court Judge James Daniel has made a major ruling in the high-profile retrial of a Jacksonville woman.

According to online court records, Daniel on Friday, July 18 issued an order denying a supplemental evidentiary hearing on "Stand Your Ground" immunity for Marissa Alexander, 33.

Alexander is out of jail on bond facing three counts of aggravated assault with a deadly weapon. Her previous conviction on the charges was overturned on appeal before she was ordered released on home detention.

Defense attorneys had argued previously they could apply Florida's recently updated SYG legislation that was signed by Governor Rick Scott.

Alexander was denied SYG immunity during her initial trial.

Statement from Attorney Buddy Schulz:

"We have received Judge Daniel's order and we're in the process of reviewing his decision. We deeply appreciate his time and thought that Judge Daniel continues to give to the numerous, complex and difficult issues in Marissa's case."

No Second Self-Defense Immunity Hearing for Marissa Alexander

Marissa Alexander has been denied a second shot at a self-defense immunity hearing (often incorrectly referred to as a “Stand-Your-Ground’ hearing), reports by First Coast News.

Under Florida’s self-defense immunity statute (FL 776.032 Immunity from criminal prosecution and civil action for justifiable use of force) a person claiming self-defense can seek immunity from criminal prosecution and civil suit. To do so they generally request a hearing in court in which they present their evidence in support of self-defense.

If the hearing judge determines that there is a preponderance of the evidence in support of self-defense, immunity is granted. Given that a preponderance of the evidence is a vastly greater level of proof than the reasonable doubt required to sustain a claim of self-defense at trial, this approach only makes common sense.

Alexander sought and received a self-defense immunity hearing prior to her first trial (since reversed, and she now awaits retrial). Following that hearing, her motion for self-defense immunity was denied–no surprise, as there is scant evidence in support of her claim of self-defense (and that’s being exceedingly generous).

JACKSONVILLE, Fla. -- Rico Gray did not take the stand himself, but his allegedly volatile relationship with Marissa Alexander and several other women in his life was the focus of a lengthy pretrial hearing Thursday afternoon.

Alexander is accused of trying to kill Gray in August 2010 in what she claims was self-defense. She was convicted and sentenced to 20 years in prison at her original trial, but an appeals court overturned that sentence because the trial judge made a mistake during jury instructions.

Alexander had just given birth only ten days prior, and testified that Gray was in a jealous fury and threatened her life. The Marissa Alexander defense team had a terrible, awful, very bad day yesterday in a pre-trial evidentiary hearing. Much evidence that would have been favorable to their case was excluded by the trial judge, and the remaining evidence left undecided also seems unlikely to be admitted. The hearing was live-tweeted and reported on by Larry Hannan of the Florida Times-Union newspaper.

As has become in the norm in many of these cases a great deal of misinformation has been promulgated about this case in an effort to control the public narrative. We have previously debunked much of this in prior posts here at Legal Insurrection, most recently: Three Weird Myths About Marissa Alexander That People Think Are True.

Alexander’s defense counsel Faith Gay and Bruce Zimet wished to exclude evidence of Marissa Alexander’s domestic assault of Rico Gray. Alexander later pleaded guilty to criminal charges resulting from the case. She also had her bail revoked, and as a result spent several years in jail.

The defense also sought to exclude all evidence recovered by police in the immediate aftermath of the shooting, including the hole in the wall behind Rico Gray’s head that puts the lie to the popular “warning shot” narrative.

Marissa Alexander agrees to plea deal

JACKSONVILLE, Fla. -- Facing a possible 60 years in prison for firing a gun at her estranged husband and his two sons, Marissa Alexander agreed Monday to a plea deal that effectively ends the four-year old criminal case against her.

According to the terms of the plea, Alexander was ordered to serve three years in prison after pleading guilty to all three counts against her. The Florida Times-Union reports the Alexander will get credit for the 1,030 days she's already spent in jail.

That means she'll have to spend 65 days in jail. Alexander will return to Duval County Jail following Monday's hearing. She'll be released on Jan. 27.

Because the second count against Alexander is considered an 'open plea,' she could still be sentenced to five years in prison at the hearing on Jan. 27.

The case has drawn national attention, in part because Alexander unsuccessfully tried to invoke a Stand Your Ground defense, and later because, when she was convicted, Florida's 10-20-Life laws mandated a stringent 20-year prison sentence -- despite the fact that her shot didn't injure or even hit anyone.

Alexander herself became the focus of anti-domestic violence advocates, since she claimed the victim in the case, estranged husband Rico Gray, was a serial abuser who attacked her first.

Alexander was convicted by a jury in 2012 of three counts of aggravated assault, but that conviction was overturned on appeal because of an error in jury instructions.

Following her jail term, Alexander's been ordered to spend two years under community control, or house arrest, with a monitor.

Not the outcome I wanted, but I am happy she will no longer be able to own or touch a gun the rest of her miserable life without going down for it.
