Olympian Oscar Pistorius today denied that he willfully killed his girlfriend, telling a South African court that he shot the woman through his bathroom door because he believed she was an intruder.

Pistorius, 26 and a double-amputee Olympian, was charged today with premeditated murder, or a Schedule 6 offense, which under South African law limits his chances for parole if convicted.

"I fail to understand how I could be charged with murder, let alone premeditated murder because I had no intention to kill my girlfriend," Pistorius said in a statement, read by his lawyer.

"I deny the accusation," he said. "Nothing can be further from the truth that I planned the murder of my girlfriend."

The court adjourned today with no decision on his bail and the hearing is scheduled to resume Wednesday.

I know rumpy, and I am my own favorite basher!!!

BUT, i can sort of read people, and I have watched just two things about
oscar, and I "feel" he is honest in what he says, watching him talk, his
body language, his "spirit & soul" say innocent to me.

BUT, I could be wrong. :95

Oscar Pistorius: the police case picked apart

The second day of the Oscar Pistorius murder case bail hearing saw the prosecution's previously "rock solid" investigation picked apart by the defence. Here is what was claimed and rebutted.

1. Investigators say they found two boxes of testosterone in a cabinet in the Paralympian's bedroom. Accompanying the product, which Hilton Botha, the police detective, initially called "steroids", before correcting himself, were syringes.

Responding to this accusation, defence lawyer Barry Roux stated that it was not testosterone which Pistorius had in his house, but a herbal remedy called 'testo compositum coenzyme' which is used to combat exhaustion and depleted energy levels.

2. Mr Botha told the magistrates that a second witness heard gunfire and went to his balcony to see "that the lights in the house were on". This was followed by a female scream before two more shots were fired.

Countering this, the defence said the screams were those of Mr Pistorius in distress after discovering he had shot Ms Steenkamp. In his statement, however, Pistorius had said the bedroom was pitch black and he was "too scared to turn the lights on".

3. A witness reported she heard "non-stop fighting" on February 14 from a house in the early morning, as well as a woman screaming. Initially, Mr Botha had said the witness lived 600 metres (600 yards) away.

However, it emerged that the witness could not clarify whether either of those voices were those of Pistorius or Miss Steenkamp, or in fact that the sounds came from their home. Mr Botha did however revise his estimate of how far away the witness's house was, saying it was closer to 300 metres (300 yards).

4. Mr Botha said he believed that Pistorius had a home in Italy and several offshore accounts. These interests outside of South Africa would make it far more appealing to flee and avoid imprisonment.

The defence flatly denied a home in Italy but did state there is an account he "forgot about" in Brunswick, Carolina which was initiated in 2002 but is currently dormant.

5. Four phones – two iPhone's and two Blackberry's – had been found in the Pretoria home and Mr Botha said the police have no records of any emergency calls from the devices on that morning.

Roux admitted this was the case. Pistorius however had used another phone to call security and he could be heard crying. Mr Botha admitted he failed to contact the paramedics to check whether they had been called.

6. Prosecutors had claimed on Tuesday that Pistorius put on his artificial legs and walked across the bedroom before firing four handgun rounds into the locked bathroom door, killing Miss Steenkamp. They insinuated that the model was hiding in the bathroom from Pistorius.

However, Steenkamp’s autopsy showed that her bladder was empty – unusual at 3am – suggesting that she was not hiding, but was using the lavatory.

The prosecution case against athletics star Oscar Pistorius suffered a blow on Wednesday as South African police admitted a series of blunders in their investigation.

Sitting in the dock, Pistorius looked more calm and composed than at any point in his bail hearing so far, while the smiles on his family's faces suggested that they felt momentum was shifting his way.

As the day wore on, Pistorius's brother Carl moved to the front desks and sat beside the defence team. At one point he turned to Pistorius and smiled.

Carl said later: "I feel like the court proceedings went well today. We trust that everyone has more clarity about this tragic incident."

Kenny Oldwage, Pistorius's lawyer, added: "We're very pleased with today."

The hearing was adjourned to Thursday morning when a decision over bail might be made.

The prosecution of Oscar Pistorius over the death of Reeva Steenkamp took a dramatic turn on Thursday after the chief investigator, Hilton Botha, was dropped from the case following the revelation that he was himself facing seven charges of attempted murder.

Shortly after the third day of Pistorius's bail hearing drew to a close, National Police Commissioner Riah Phiyega told reporters that Botha would be replaced by "the most senior detective" in the force, Lieutenant General Vineshkumar Moonoo.

"I have decided to assign this very important investigation under the leadership and stewardship of the divisonal commissioner, Lt Gen Moonoo," said Phiyega.

"He will lead the process of establishing a team of highly skilled and professional detectives. They shall continue with this investigation."

Earlier, the South African police service confirmed that Botha and two other officers were accused of firing at a taxi carrying seven passengers during an allegedly drunken incident in 2011.

The defence and prosecution in Oscar Pistorius’s bail hearing began to sum up their cases today; defence lawyer Barry Roux was able to finish his, but Gerrie Nel, for the prosecution, will continue tomorrow.

Here are the key points from today’s hearing.

• Defence lawyer Barry Roux said that the killing of Reeva Steenkamp should not be considered "schedule six" (ie premeditated murder). The evidence does not show it was premeditated, he said. The evidence does not even show it was murder. He said that investigating officer Hilton Botha had yesterday corroborated Pistorius’s version of events – that he thought there was a burglar in the bathroom and shot through the door out of fear for his and Steenkamp’s safety – and criticised the prosecution’s evidence. Botha has not a credible witness, he said. Pistorius’s version of events is the only one that made sense and in the interests of justice he should be released on bail, he said.

• But Gerrie Nel, prosecuting, said that even on his own version of events Pistorius deliberately killed a burglar. He could not have meant those four shots through the toilet door to do anything other than kill, Nel said. The defence had not proved the exceptional circumstances necessary for the granting of bail, Nel said. He said Pistorius had to prove that on the balance of probabilities he would be acquitted, in order to get bail.

• Attempting to prove Pistorius’s “burglar” story, Roux said the fact Steenkamp’s bladder was empty at 3am suggested she got up to go to the toilet, not to hide from Pistorius because she was afraid of him after an argument, as the prosecution suggest – although he did admit it was possible she could have emptied her bladder due to the trauma of events. Even if she was dressed when shot, it didn’t mean she didn't go to the toilet, he says. He said if Pistorius wanted to kill Steenkamp he could have done so in bed, not in the toilet. And he suggested that it made sense for Steenkamp to have locked the toilet door for protection when Pistorius shouted (by his account) that there was a burglar.

• Nel said the position of phones belonging to Pistorius and Steenkamp on the bathroom mat suggested they had been having an argument there. But the magistrate, Desmond Nair, said Pistorius might have put them there after the killing.

• Roux said that Pistorius’s fears of crime were rational. One was not immune from crime in a security complex, he said.

• Nel read from a magazine article that stated that Pistorius had a house in Italy, in order to demonstrate that Pistorius was a flight risk. When Roux denied Pistorius owned the house, Nel said it was on loan to him and the athlete spent four months a year there. He said Pistorius was a man of means who had shown no realisation of what he had done and was a flight risk.

• Roux is attempted to answer the prosecution's question: "Why would a burglar lock himself in the toilet?" by saying that Pistorius did not know the person in the toilet had locked the door.

• Nel expressed scepticism about Pistorius’s claim that he walked through the bedroom twice and went to get his gun from under the bed without noticing that Steenkamp was not in bed or trying to warn her about the “intruder”.

• Roux said the evidence of a witness who said there had been an argument between Pistorius and Steenkamp before the killing should be discounted because the witness was hundreds of metres away. Even if there was an argument, he said, that was a very different thing to premeditated murder. Nair, the magistrate, suggested that the witness who heard arguing could have done so even from hundreds of metres away. And Nel said they had given statements under oath.

• And he said Botha did not know enough about ballistics to have given evidence about the trajectory of the bullets that killed Steenkamp. And he said Pistorius could not have known where Steenkamp or the burglar was standing or sitting when he shot through the door.

• Desmond Nair, the magistrate who will decide whether or not Pistorius is released on bail, seemed very concerned about the possibility the defendant could seek to influence witnesses. Roux said a past incident in which Pistorius fired a firearm by accident in a restaurant did not prove he had a propensity towards violent crime, and it would be unfair to factor this in now. And he said Pistorius's threat that he would break a love rival's legs were just the use of an expression common among people in their 20s. Nair also raised a previous arrest of Pistorius over allegations that were later dropped, and threatening language the defendant had used previously. And he suggested that there might be public outrage if Pistorius was released.

• And he hinted that he was considering downgrading the charge to culpable homicide.

The court also heard from Botha, following the revelation that he is facing a charge of attempted murder himself. But Botha was not asked about the charges.

The hearing continues at 10am local time tomorrow (8am GMT).

Nair turns to Pistorius's statement.

He runs briefly through Pistorius's side of the story: that he did not mean to kill Reeva Steenkamp, taking her for a burglar, and the objective facts do not refute this. It was not premeditated murder, or even murder at all, according to Pistorius's statement.

Nair runs through Pistorius's version of events.

He and Steenkamp went to bed at 10pm. His legs were removed. Aware of violent crime, he slept with his pistol under his bed.

He awoke in the early hours to bring a fan in from the balcony.

He heard a noise in the bathroom. He knew contractors had left ladders outside. He was overcome with terror and believed someone had entered his house. He was too scared to switch a light on.

He grabbed his pistol, screamed that the person should leave, and shouted to Steenkamp.

He went to the bathroom and heard someone in the toilet.

He was vulnerable on his stumps and wanted to protect himself and Steenkamp.

He fired shots at the closed door and again shouted to Steenkamp to call the police.

When he reached the bed he realised she was not in bed and it dawned on him she may have been the person in the toilet.

He screamed for help at the balcony.

He switched on the lights, got a cricket bat, smashed the door, found a key, and found Steenkamp slumped over but alive.

He asked someone to phone an ambulance and he called Netcare.

He opened the door downstairs and then went back up to get Steenkamp.

The deceased died in his arms.

He believes she must have gone to the toilet while he was at the balcony.

He is mortified at having killed her.

He believes the facts will show he did not mean to kill her.

Pistorius granted bail

Nair grants bail to Pistorius.

Part of his reasoning is Pistorius's having given a detailed account of his version of events (improbabilities notwithstanding).

None of the factors for refusing bail have been established, Nair says.
