Major Potential Setback for Mueller’s Trump-Russia Report

A court case–completely unrelated to the Trump-Russia investigation–could “torpedo” Special Counsel Robert Mueller’s report, according to Politico.

Next month, a Washington D.C. appeals court is set to hear arguments involving a decades-old, unsolved case of missing Columbia University professor, Jesus Galindez. If the court sides with the Department of Justice and finds that judges do not have the ability to release secret grand jury information, it may prevent Mueller from publishing his report on President Trump and his campaign’s alleged ties to Russia.

The ruling could also keep the special counsel from sending its report to Congress.

dam Lovinger, a former Defense Department analyst, never expected that what he stumbled on during his final months at the Pentagon would expose an integral player in the FBI’s handling of President Donald Trump’s campaign and alleged Russia collusion.

Lovinger, a whistleblower, is now battling to save his career. The Pentagon suspended his top-secret security clearance May 1, 2017, when he exposed through an internal review that Stefan Halper, who was then an emeritus Cambridge professor, had received roughly $1 million in tax-payer funded money to write Defense Department foreign policy reports, his attorney Sean Bigley said. Before Lovinger’s clearance was suspended he had taken a detail to the National Security Council as senior director for strategy. He was only there for five months before he was recalled to the Pentagon, stripped of his prestigious White House detail, and ordered to perform bureaucratic make-work in a Pentagon annex Bigley calls “the land of misfit toys.” His security clearance was eventually revoked in March 2018, despite the Pentagon “refusing to turn over a single page of its purported evidence of Lovinger’s wrongdoing,” Bigley stated. Conservative watchdog group, Judicial Watch, recently filed a federal lawsuit against the Defense Department to obtain the withheld records.

Reps. Darrell Issa and Matt Gaetz highlighted discrepancies between DOJ official Bruce Ohr’s Tuesday testimony before Congress and the testimony given by Lisa Page and Glenn Simpson.

“In the first hour of testimony, and it’s either Bruce Ohr is lying or Glenn Simpson is lying,” Gaetz told reporters Tuesday, continuing “in another circumstance, it’s either Bruce Ohr is lying, or Lisa Page is lying.”

Gaetz was supported later by Issa, who confirmed the Ohr discrepancy with Simpson’s testimony and said, “There’s also some ambiguity between Ohr and Lisa Page. We will have to go back to the loop to find out which one of them is able to change their story or face perjury.”

Judicial Watch report that there were NO HEARINGS in regards FISA WARRANT applications.

They were "rubber-stamped" by Judge each time, based on the written submissions (already released, heavily redacted). I suspect the judges did not even bother to read, but even if they did it was with a bias that shows almost all applications are approved.. a routine rather than much serious evaluation of merits/legality.

I said early on... but the point is never brought up...
(I'll leave a message on Judicial Watch YT) :cool

The document that would reveal a lot is the very first FISA WARRANT APPLICATION on Carter Page that was reported to have been turned down. The difference between that and the subsequent successful application(s) would clearly show what the FBI/DoJ added to hoodwink the judge.

Russian Oligarch Oleg Deripaska, a close associate of Vladimir Putin, has gone on record with The Hill‘s John Solomon – admitting to colluding with Americans leading up to the 2016 US election, except it might not be what you’re thinking.

Deripaska, rumored to be Donald Trump’s “back channel” to Putin via the Russian’s former association with Paul Manafort, says he “colluded” with the US Government between 2009 and 2016.

In 2009, when Robert Mueller was running the FBI, the agency asked Deripaska to spend $25 million of his own money to bankroll an FBI-supervised operation to rescue a retired FBI agent – Robert Levinson, who was kidnapped in 2007 while working on a 2007 CIA contract in Iran. This in and of itself is more than a bit strange.

Deripaska agreed, however the Obama State Department, headed by Hillary Clinton, scuttled a last-minute deal with Iran before Levinson could be released. He hasn’t been heard from since

Mueller Will Accept Some Written Answers From Trump

The special counsel, Robert S. Mueller III, will accept written answers from President Trump on questions about whether his campaign conspired with Russia’s election interference, Mr. Mueller’s office told Mr. Trump’s lawyers in a letter, two people briefed on it said on Tuesday.

But on another significant aspect of the investigation — whether the president tried to obstruct the inquiry itself — Mr. Mueller and his investigators understood that issues of executive privilege could complicate their pursuit of a presidential interview and did not ask for written responses on that matter, according to the letter, which was sent on Friday.

Mr. Mueller did not say that he was giving up on an interview altogether, including on questions of obstruction of justice. But the tone of the letter and the fact that the special counsel did not ask for written responses on obstruction prompted some Trump allies to conclude that if an interview takes place, its scope will be more limited than Mr. Trump’s legal team initially believed, the people said.

Ex-Trump campaign aide Papadopoulos sentenced to 14 days in prison

WASHINGTON (Reuters) - George Papadopoulos, a former aide to then-Republican candidate Donald Trump’s 2016 campaign, was sentenced on Friday to 14 days in prison after pleading guilty last year to lying to federal agents investigating whether campaign members coordinated with Russia before the election.

Prosecutors for Special Counsel Robert Mueller said Papadopoulos lied to agents about his contacts with Russians during the campaign “to minimize both his own role as a witness and the extent of the campaign’s knowledge of his contacts,” according to the government’s sentencing memorandum.

Robert Mueller Delays Flynn Sentencing, yet again, Until After The Election

In a court document filed on Monday, Mueller and Flynn’s attorneys agreed on November 28—well after the midterm elections—for a sentencing hearing, and effectively signaled that Flynn’s cooperation with Mueller’s team could be nearing an end.

A lawyer for a Russian company indicted by Special Counsel Robert Mueller continued his lonely legal assault on Mr. Mueller’s office Monday, saying it was prosecuting a “made-up crime” that the “real Department of Justice” would never have charged.

In a feisty, hourlong presentation in court, the lawyer for the firm, Concord Management and Consulting LLC, urged the judge to dismiss the indictment, saying the allegations didn’t fit the relevant statute and the legal theory could make a criminal out of anyone who posted a political message on the internet under a pseudonym.

“The special counsel’s office said we interfered with an election,” said the lawyer, Eric Dubelier. “There is no such crime.”

Mueller isn’t done with former Trump campaign aide Gates

WASHINGTON (AP) — Robert Mueller isn’t done with former Trump campaign aide Rick Gates.

That’s according to a new court filing from the special counsel’s team. Prosecutors say they’re not ready for Gates to be sentenced because he is continuing to cooperate with “several ongoing investigations.” And they’re asking a federal judge to give them until mid-January before they have to give another update about his case.

The filing confirms that the investigation will extend into next year as Mueller continues to probe Russian election interference and any possible coordination with President Donald Trump’s associates.

A federal judge on Thursday declined to toss a conspiracy charge against a Russian company that allegedly sought to meddle in the 2016 U.S. election – but also warned special counsel Robert Mueller’s team of the lengths it will need to go to prove its case against the Russian company at trial.

The decision by U.S. District Judge Dabney Friedrich, is a win for Mueller, but also signals that if the case goes to trial it will not necessarily be smooth sailing for the special counsel.

Federal prosecutors have accidentally revealed that criminal charges have been filed against "Assange"—an apparent reference to Wikileaks founder Julian Assange. The feds filed the revealing document back in August, but the slip-up wasn't noticed until it was flagged in a Thursday evening tweet.

The filing was in an unrelated sex crimes case in the Eastern District of Virginia. Federal prosecutors asked the court to seal its criminal complaint and arrest warrant against a man named Seitu Sulayman Kokayi—for "coercion and enticement of a juvenile to engage in unlawful sexual activity"—to avoid tipping the suspect off. But in two places, the document refers to "Assange" instead of the actual defendant in the case.

The document argues that the case should be sealed because, "due to the sophistication of the defendant and the publicity surrounding the case, no other procedure is likely to keep confidential the fact that Assange has been charged."

That claim makes no sense in the context of the Kokayi case—there's no reason to consider him a sophisticated defendant, and his case hasn't received significant publicity before now. But it obviously fits the circumstances of Julian Assange's case perfectly.

Federal Judge Randolph Moss denies a sentencing delay for George Papadopoulos

Papadopoulos will serve a 14-day sentence for ‘lying’ to federal investigators, starting tomorrow.

Papadopoulos argued it was possible the constitutional challenge in a separate case would result in his own conviction being set aside, and that he should therefore be allowed to remain free on bail. However, U.S. District Judge Randolph D. Moss noted Papadopoulos had not appealed his own conviction, having waived his right to do so when he pleaded guilty. Moss also noted Papadopoulos had not shown the appeals court case would likely conclude the special counsel’s appointment was unlawful.

I am no fan of Sundance, but his reference to NYT story is legitimate. We all have to get out basic FACTS from somewhere. That does not mean you accept the NYT analysis. The fact revealed by NYT article is "Federal prosecutors in Virginia are investigating a secret Turkish lobbying effort that once involved Michael T. Flynn"
