Federal judge accuses Mueller's team of 'lying,' trying to target Trump: 'C'mon man!'

A federal judge on Friday harshly rebuked Special Counsel Robert Mueller’s team during a hearing for ex-Trump campaign chairman Paul Manafort – suggesting they lied about the scope of the investigation, are seeking “unfettered power” and are more interested in bringing down the president.

"You don't really care about Mr. Manafort,” U.S. District Judge T.S. Ellis III told Mueller’s team. “You really care about what information Mr. Manafort can give you to lead you to Mr. Trump and an impeachment, or whatever."

Further, Ellis demanded to see the unredacted “scope memo,” a document outlining the scope of the special counsel’s Russia probe that congressional Republicans have also sought.

The hearing, where Manafort’s team fought to dismiss an 18-count indictment on tax and bank fraud-related charges, took a confrontational turn as it was revealed that at least some of the information in the investigation derived from an earlier Justice Department probe – in the U.S. attorney’s office for the Eastern District of Virginia.

Manafort’s attorneys argue the special counsel does not have the power to indict him on the charges they have brought – and seemed to find a sympathetic ear with Ellis.

Mueller’s team says its authorities are laid out in documents including the August 2017 scope memo – and that some powers are actually secret because they involve ongoing investigations and national security matters that cannot be publicly disclosed.

Ellis seemed amused and not persuaded.

He summed up the argument of the Special Counsel’s Office as, "We said this was what [the] investigation was about, but we are not bound by it and we were lying."

He referenced the common exclamation from NFL announcers, saying: "C'mon man!"

Judge in Manafort case gets details of Mueller probe scope

WASHINGTON (AP) — A federal judge overseeing a case against President Donald Trump's former campaign chairman Paul Manafort has now joined the small group of Americans who know the details of special counsel Robert Mueller's investigation.

Mueller's prosecutors on Thursday provided U.S. District Judge T.S. Ellis III a copy of a memo written by Deputy Attorney General Rod Rosenstein last August. The memo goes into more detail than Mueller's public appointment order laying out the specific activities he is authorized to investigate, at least through the middle of last year.

Prosecutors had publicly filed in court a heavily redacted copy of the three-page memo last month, revealing that Rosenstein had given Mueller authority to investigate Manafort's Ukrainian political work in addition to Russian election meddling.

Ellis had bristled at the redactions and requested a full copy be provided to him under seal while he considers a motion Manafort filed challenging the special counsel's authority to prosecute him.

The Aug. 2 memo was drafted before any of the indictments and guilty pleas being filed by Mueller's office, so it likely contains references to some of those public cases.

In total, Mueller has brought charges against 19 people — including four Trump campaign advisers — and three Russian companies over the past year.

Judge delays Manafort's first trial — again

A federal judge in Virginia has again delayed the trial scheduled for next month for former Trump campaign chairman Paul Manafort on charges of tax evasion, bank fraud and failing to report foreign bank accounts.

In a new order dated Monday and released Tuesday, U.S. District Court Judge T.S. Ellis pushed back the scheduled start of Manafort's trial one day to July 25.

The move came at the request of prosecutors from special counsel Robert Mueller's office who said the earlier start date would conflict with a previously set hearing on another criminal case Manafort is facing in Washington.

Ellis originally set the Alexandria, Virginia trial for July 10 but recently postponed the trial by two weeks after he delayed a hearing on some key motions in the case.

The Washington case, set for trial Sept. 17, charges the longtime political consultant and lobbyist with money laundering and failing to register as a foreign agent in connection with his Ukraine-related work.

Manafort has pleaded not guilty to all the charges.

Mueller Seeks Limits on Manafort ‘Vindictive’ Prosecution Claims

ALEXANDRIA, Va. (CN) – Special Counsel Robert Mueller asked a federal judge on Friday to place limits on how and in what context attorneys for former Trump campaign chairman Paul Manafort can accuse the Justice Department of the “selective” or “vindictive” prosecution of their client.

In an 8-page motion filed in the federal court in Virginia, Mueller also asks U.S. District Judge T.S. Ellis III to bar any evidence “suggesting any government investigation into Manafort that preceded special counsel’s appointment, ended with a decision not to prosecute him.”

The request Friday was accompanied by a 122-pages of jury instructions for the July trial in Virginia where Manafort faces multiple counts of bank and tax fraud as well as conspiracy and making a false statement to law enforcement.

“Although Manafort’s challenges to the authority of the Special Counsel’s Office are an appropriate subject for a pretrial motion before the court, the issue of the special counsel’s authority is not relevant to the questions to be resolved by the jury,” the filing states.

The same goes for the issue of the “government’s motives or investigative mandates” that are not pertinent to the jury’s concerns, prosecutors argue.

Manafort bank fraud trial does have Trump campaign connection, Mueller's team says

(CNN) Prosecutors for special counsel Robert Mueller intend to present evidence at the trial of former Trump campaign chairman Paul Manafort that a banking executive allegedly helped Manafort obtain loans of approximately $16 million while the banker sought a role in the Trump campaign.
Manafort faces trial on bank fraud and other financial charges in the Eastern District of Virginia beginning July 25. Until now, there had been no indication that his role in the Trump campaign would become part of the trial, and he had asked the judge to keep details about his ties to President Donald Trump out of the trial. Prosecutors say any alleged collusion with the Russian government won't come up at the trial.
The allegation of a possible quid pro quo came amid several court filings Friday as both sides count down the remaining weeks until the trial. While prosecutors filled in the Trump campaign details, Manafort's team was busy filing requests with the judge to move his trial location and date, to look into possible leaks from the prosecutors and to keep Manafort out of the public eye

Paul Manafort, who has been held in solitary confinement in an eastern Virginia jail, will move to a facility closer to the courthouse where he faces a July 25 trial.

U.S. District Judge T.S. Ellis III on Tuesday ordered Manafort’s transfer to the Alexandria Detention Center from the Northern Neck Regional Jail in Warsaw, which is 85 miles away. Manafort, the former campaign chairman for President Donald Trump, was sent to jail after prosecutors accused him on tampering with witnesses.

The move addresses Manafort’s complaint that his lawyers were too far away, making it “effectively impossible” to prepare for the trial in federal court in Alexandria on charges of bank fraud and tax crimes. It was the basis for Manafort’s request for the trial to be delayed.

The judge hasn’t ruled on that request. He’s also considering Manafort’s bid to move the trial to either Richmond or Roanoke, Virginia.

Manafort also faces a Sept. 17 trial in Washington on charges of money laundering, obstruction of justice and failing to register as a foreign agent of Ukraine.

Special Counsel Robert Mueller asked a judge to give immunity to five people who may testify at the bank-fraud trial starting next week against Paul Manafort, President Donald Trump’s former campaign chairman.

Mueller didn’t identify the witnesses, who haven’t been charged. The five would invoke their constitutional right against self-incrimination and remain silent unless Judge T.S. Ellis III grants them immunity, prosecutors said Tuesday in a court filing in federal court in Alexandria, Virginia. Their names will be made public only if they are called to testify, according to the filing.

“Disclosing the motions would reveal those individuals’ involvement in the investigation and the trial, thereby creating the risk of undue harassment,” prosecutors wrote. “Such concern potentially would be heightened by the additional revelation that they have invoked their privilege against self-incrimination.”

Prosecutors asked Ellis to seal five separate motions about the potential witnesses and unseal any of them if they are called to testify.

Mueller reportedly grants Tony Podesta immunity to testify against Paul Manafort

Special counsel Robert Mueller has reportedly given a key Democratic operative immunity to testify against former Trump campaign manager Paul Manafort.

According to Tucker Carlson, speaking Thursday evening on his Fox News program, Mr. Mueller has offered immunity to Tony Podesta, founder of the Podesta Group and brother of former Hillary Clinton campaign chairman John Podesta.

Mr. Carlson cited “two sources” whom he did not name.

Both Mr. Manafort and the Podesta Group worked on a campaign named the European Centre for a Modern Ukraine, and most of the charges against Mr. Manafort relate to his work there and whether he laundered money for Russian oligarchs, worked as a foreign agent, disclosed his income and status, and related issues.

Manafort appeared in person at Monday's hearing, wearing a green jumpsuit with a rumpled collar.
Attorneys for Manafort said that they needed more time to review some 120,000 pages of documents, including documents and images taken from electronic devices belonging to Manafort's former business partner Rick Gates, that were "at the heart of the issue" in the case. Prosecutors pushed back and said most of the documents were actually images and notes from Gates' devices -- not emails.

About 70 people in northern Virginia took their first steps in the jury selection process for the case of Paul Manafort when they filled out written questionnaires exploring their personal lives and factors that may influence their attitude toward the trial.

Manafort, President Donald Trump’s former campaign chairman who’s been in custody, wore a dark suit to attend the 20-minute courtroom session Tuesday. On Monday, without potential jurors present, Manafort, 69, wore a green jail jumpsuit at a hearing for his bank- and tax-fraud trial in federal court in Alexandria.

U.S. District Judge T.S. Ellis III told the jury pool that the trial will last three weeks and that they would be asked in a questionnaire about whether they’ve formed any opinions based on news accounts about the high-profile case prosecuted by Special Counsel Robert Mueller.

U.S. Special Counsel Robert Mueller named 35 potential witnesses who may be called to testify in the tax- and bank-fraud trial of former Trump campaign chairman Paul Manafort, including his onetime right-hand man Rick Gates.

The list, filed Friday in federal court in Alexandria, Virginia, hints at how the first trial stemming from Mueller’s probe into Russian meddling may unfold. The jury is likely to hear about home loans, fine cars -- even Major League Baseball tickets. The three-week trial is scheduled to start on July 31.

Gates, who pleaded guilty and is cooperating with Mueller, is expected to be the prosecution’s star witness. He will guide jurors through bank records and other financial documents as prosecutors try to prove that Manafort earned millions of dollars as a political consultant in Ukraine, failed to disclose his income and offshore accounts to U.S. tax authorities and lied to lenders in borrowing $20 million.

The criminal trial of Paul Manafort that opens in Virginia Tuesday is just one part of special counsel Robert Mueller’s sprawling Russia probe — but its verdict could have an outsized impact on Mueller’s work.

A conviction against Donald Trump’s former campaign chairman, who is fighting major bank and tax fraud charges, would offer Mueller a powerful response to presidential taunts that he is waging a “witch hunt.”

But Manafort’s acquittal would deliver Mueller a political body blow, enabling Trump and Republicans to scoff at the federal probe ahead of the November midterm elections.

Never mind that Manafort’s trial — which will not be televised — will barely touch on Trump or the 2016 presidential election. The charges cover a period that includes political work the GOP lobbyist and consultant did in Ukraine years before he joined Trump’s campaign but also extend to more recent loan applications while he was staffing the future president. Experts call the stakes high all the same.
