Bank teller sues for $350 million in Twin Peaks case

WACO - A bank teller filed a federal lawsuit Wednesday, demanding $350,000,000 as a result of the May 17, 2015 Twin Peaks shooting in Waco that killed nine people, injured 18, and resulted in 177 arrests.

Morgan English, of Brenham, is suing the City of Waco, McLennan County, McLennan County District Attorney Abel Reyna, Former Waco Police Chief Brent Stroman and Waco Police Detective Manuel Chavez.

Her attorneys say law enforcement used a "fill-in-the-name" warrant to arrest her, along with the others, even though she claims she was not wearing insignia representing the Cossacks nor the Bandidos motorcycle clubs, which were involved in the shoot-out that day.

English, a graduate of Stephen F. Austin University, said she was with her husband William in their car with two friends the day of the shoot-out. According to her attorneys, shots rang out before they even entered the restaurant, and the group immediately took cover. English claims she and her husband both spoke freely with police after the shooting. But, she was arrested anyway.

The first criminal trials in the Twin Peaks case are expected later this year. In response to Wednesday's civil lawsuit, McLennan County District Attorney, Abel Reyna, issued the following statement:

"The issue complained of by Morgan English has already been addressed by a District Judge, who found probably cause existed for her arrest. Unfortunately, our legal systems allows anyone who pays a filing fee to file a lawsuit, including those with ridiculous allegations."

I remember her name but don't know why.

IMO she is SOOL. They had a RICO case investigation going for over a year before the melee at Waco, they have every biker there over the barrel.

William and Morgan English of the Distorted Motorcycle Club, will be bound over for a Grand Jury appearance because their 7-member club, Distorted, wears a patch that says, “I support the fat Mexican”. (Bandidos)

The Englishes are members of a Bandidos support club named Distorted, a five-month-old organization, the membership roster of which numbers only 7.

Their colors are blue and white, but they wear a small patch called “cookie” on left shoulder area of their vests with a picture of the red and gold trademarked Bandidos logo, a man wearing a sombrero, brandishing a revolver and a machete, that says, “I support the fat Mexican.”

The club, like all others affiliated with the Confederation of Clubs, pays dues, and those dues are collected by the Bandidos Motorcycle Club.




They were there for the meeting. It's the Feds the Feds.




RICO investigation for over a year before the melee the Feebies know more about the Englishes than they know about themselves.

Back in the day I teed off a lot folks by saying that the bikers were SOOL lots of folks telling me I was ignorant of the law :98 and blessing my heart before I even knew it was meant as an insult, so I thanked them, and then when I figured out it was an insult I thanked them anyhow because IDGAHoot :28

A judge has postponed the first trial over a 2015 Central Texas gunfight involving rival motorcycle gangs that left nine people dead, 20 others hurt and more than 150 bikers charged.

The Waco Tribune-Herald reports the first trial had been set for May 22 related to the deadly shootout at a Waco restaurant.

But state District Court Judge Ralph Strother on Friday postponed the trial after a new attorney brought onto the case indicated she couldn't be ready in time.

A new trial date wasn't set.

The delay means a trial set to begin June 5 before a different judge is now scheduled to be the first to go before a jury.

Judge denies biker’s request for delay in Waco trial

FORT WORTH, Texas — The judge who would preside over the first trial of a biker allegedly involved in a shootout at a meeting of rival motorcycle gangs in Waco, Texas, that left nine people dead has denied a motion to delay the trial.

Christopher “Jake” Carrizal was among more than 150 bikers indicted following the 2015 shooting on charges of murder conspiracy and engaging in organized criminal activity. His trial is scheduled for Sept. 11.

In a motion filed Tuesday, Carrizal claimed state District Judge Ralph Strother “grossly abused” his discretion when he declined to enforce defense subpoenas for local law enforcement to appear and produce records in court.

Later Tuesday Strother denied the motion and ordered Carrizal and his attorney in court Thursday for a jury selection hearing.

Texas prosecutor dismisses 13 cases tied to biker shooting

FORT WORTH, Texas (AP) — A Texas prosecutor on Thursday dismissed 13 cases stemming from a 2015 shootout in Waco involving bikers and police and recused himself from two others, placing into doubt the criminal prosecution of the more than 130 bikers still awaiting trial.

The actions came hours before a scheduled hearing for Jorge Salinas, whose case was among those dismissed. Current and former staff had been due to speak at the hearing about corruption allegations against District Attorney Abel Reyna, who faces a Republican primary election in March. The hearing was canceled.

According to a motion filed Thursday, the prosecutor dismissed Salinas’ case “in order to focus its efforts and resources on co-defendants with a higher level of culpability.”

Nearly three years later, only one biker, Dallas locomotive driver Christopher “Jake” Carrizal, has been tried. Carrizal’s November trial resulted in a mistrial when jurors were unable to reach a unanimous verdict. The second biker set for trial rejected a plea deal in December.

More than 100 bikers, including 11 whose cases were dismissed Thursday, have civil suits pending against the district attorney’s office and the Waco police department claiming that they were wrongfully arrested.

A federal judge in Austin had stayed the cases pending the outcome of their criminal cases. Dallas attorney Don Tittle, whose firm is representing 122 bikers’ civil cases, said he hopes the dismissals mean “that there’s no longer any impediment” to proceeding in civil court.

Salinas, 27, a decorated Marine from Lometa, Texas, and his Fort Worth attorney, Brian Bouffard, both cried upon learning late Wednesday from the district attorney’s office that the case against him would be dropped.

Abel Reyna plans not to prosecute several more Twin Peaks cases
Prosecutors plan to dismiss more Twin Peaks cases.

WACO -- McLennan County District Attorney Abel Reyna announced Wednesday that he would refuse to prosecute 24 Twin Peaks shooting cases and request 13 more be dismissed.

Wednesday's announcement would bring the total number of disposed cases to 58.

Hearings were scheduled Thursday to consider disqualifying Reyna from at least 10 Twin Peaks trials. In a press conference Wednesday, Reyna confirmed those 10 cases were among those being taken off the table.

Defense attorneys have previously argued Reyna has dismissed cases in order to avoid testifying under oath at disqualification hearings. On Wednesday, Reyna again denied any wrongdoing.

Roughly 100 cases remain under investigation.

Reyna also said he planned to ask to be recused from the trial of William Aiken. But, he said Judge Doug Shaver had not signed off on anything related to that matter, as of Wednesday morning.

Cases against bikers flounder 3 years after Waco shootout

WACO, Texas (AP) — Texas prosecutors who have failed to convict a single person in the three years since a Waco shooting left nine bikers dead are trying a new tact of targeting fewer cases, but attorneys for the bikers say the evidence is so shaky and the lead prosecutor’s credibility so damaged that it will be difficult to make the remaining charges stick.

Prosecutors initially indicted 154 bikers, using a conspiracy law that is difficult to apply because it requires proof beyond all reasonable doubt that three or more people acted together to support a criminal organization.

In the two weeks before the anniversary on Thursday of the deadliest biker shooting in U.S. history, prosecutors in Waco dismissed 98 indictments and have narrowed the cases to 25. Three of those are murder charges against Bandido members Glenn Walker, Ray Allen and Jeff Battey.

A problem for the prosecution is that McLennan County District Attorney Abel Reyna is a lame duck, having lost a Republican primary race in March after being accused of mishandling the biker cases. A new prosecutor won’t be elected until November. Instead of resigning or keeping a low profile until then, Reyna has moved more aggressively.
