Marilyn Mosby Is Facing TWO MORE Lawsuits From Different Baltimore Cops In Freddie Gray Case

Baltimore State’s Attorney Marilyn Mosby is now facing two more lawsuits from Baltimore police officers charged in the death of Freddie Gray.

A federal judge unsealed court documents Tuesday that show Officers Garrett Miller and Edward Nero filed a joint suit against Mosby and Maj. Samuel Cogen of the Baltimore City Sheriff’s Office, the Baltimore Sun reports. The suit alleges false imprisonment, defamation and violation of constitutional rights, claiming the charges filed against the officers were trumped up in an effort to quell anger after the Baltimore riots.

In addition to that suit, Lt. Brian Rice filed suit against Mosby and Cogen for false imprisonment, defamation of character, and violation of rights. The suit, which was unsealed Monday, points to the press conference where Mosby made heated rhetoric about the case.

These new suits come after news broke that Sgt. Alicia White and Officer William Porter filed suit against Mosby and Cogen of the Baltimore Sheriff’s office for defamation and invasion of privacy. The suit alleges Mosby and Cogen knew the charges were trumped up, but filed them anyway to quell the riots that had ravaged the city.

Oh good, this is great news. I am hoping the accused officers keep piling it on.

“These six officers were essentially sacrificed,” Glass told TheDCNF. “Alicia White, she’s accused of murder, she never touched Mr. Gray.”

And my favorite part of the article:

Glass argues that when Mosby used this rhetoric and filed charges to quell the riots, she acted outside her role as a prosecutor and thus should not be protected by the immunity usually due to the position. He said he believes new facts obtained through the discovery process will reveal damning conversations exposing the motives behind charging the officers.

A 20-year-old man who was seen in widely circulated photos squirting lighter fluid on a pile of propane cylinders during the rioting in Baltimore in April 2015 was sentenced Friday to 15 years in prison.

Donta Betts of Baltimore pleaded guilty in March to making a destructive device near the intersection of Pennsylvania and North avenues on April 27, 2015. He also pleaded guilty to shooting a woman in the leg over a $20 drug deal on July 2, 2015, federal prosecutors said in court Friday.

"Donta Betts engaged in arson, looting, assault and other mayhem during the Baltimore riots," U.S. Attorney Rod J. Rosenstein said in a statement. He said Betts' actions around the city during the riots included looting and throwing rocks at police officers.

In an email, Rosenstein said the case was not just about what happened during the riots, but also about the increase in violence across the city last year.

"This man was an armed drug dealer, and because he was carrying a gun, he used it to try to kill a woman over a $20 drug debt," Rosenstein said. "Too many of the 344 murders and 700 nonfatal shootings last year were over similar pointless beefs. That is what happens when criminals are allowed to carry loaded guns."

WASHINGTON (AP) — A George Washington University law professor is filing a complaint against Baltimore State’s Attorney Marilyn Mosby over the investigation and prosecution of six police officers in the death of a black man who was critically injured in the back of a police van.

John F. Banzhaf III says his complaint is being filed Wednesday with Maryland’s Attorney Grievance Commission. Among other things, Banzhaf says in his 10-page complaint that Mosby appears to have violated Maryland’s rules of professional conduct for lawyers, which requires that a prosecutor refrain from prosecuting a charge unless it is supported by probable cause.

BALTIMORE (WJZ) — Joining a panel discussion hosted by D.C. radio station WPGC Monday via phone, Freddie Gray family attorney Billy Murphy said one way to fix what he sees as a broken police force in Baltimore is to replace the “old white guys that are racist to the core.”

The “Yo Listen Up” event was held in the wake of the deadly shootings of Alton Sterling and Philando Castile by police in Louisiana and Minnesota last week, and the ambush that left five police officers dead at a Black Lives Matter march in Dallas.

Murphy was asked by one of the DJ hosts of the event why it’s been so hard to get convictions in the trials of the police officers charged in relation to the death of Freddie Gray.

So far, two of the six officers — both of whom chose to be tried by a judge rather than a jury — have been fully acquitted by Baltimore City Circuit Court Judge Barry Williams.

“The first reason is that the police are investigating themselves,” Murphy said. “And so you cannot rely on the integrity of those investigations, as the prosecution is forced to do. And so, routinely, police officers get up and testify in a way that sabotages a good case.”

Another reason, he went on to say, is “it’s hard to win cases that are based largely on circumstantial evidence.”

In the Gray case, “there’s no camera in the back of the van,” Murphy said. “And so nobody knows for sure what happened in the back of that van except that Freddie got a tragic injury that resulted in him having torn 80 percent of his spinal cord.”

DJ Flexx went on to ask Murphy “how can we fix this?”

“I believe that the essential personnel in the Baltimore City police force — the old white guys that are racist to the core, not that all whites are racist … they got to be replaced,” Murphy said.

Police: 65 arrested after blocking Baltimore expressway during protest

Sixty-five people were arrested on Saturday after participants in a march against police brutality blocked Interstate 83 just north of downtown Baltimore.

The arrests created a chaotic scene around Penn Station, where thousands milled around for the annual Baltimore Artscape festival.

The march, which was named and tagged on social media as "Afromation," began at Guilford Avenue and Chase Street, moved through Artscape on Charles Street, then to St. Paul Street and past Penn Station to the I-83 onramp, which was closed for the festival.

Two More Prosecutors Face Disbarment Complaints Over Freddie Gray Case

A law professor at George Washington University School of Law has filed two additional disciplinary complaints against Baltimore Deputy State’s Attorneys Michael Schatzow and Janice Bledsoe. Schatzow and Bledsoe are the two courtroom prosecutors involved in the trials against the six Baltimore police officers charged in connection with the death of Freddie Gray. Professor John Banzhaf filed the complaints on Tuesday with the Attorney Grievance Commission of Maryland. Last month, Banzhaf also filed a disciplinary complaint against Baltimore State’s Attorney Marilyn Mosby that seeks to have her disbarred for alleged unethical conduct in the prosecution of the “Baltimore Six.”

The two new complaints allege that Schatzow and Bledsoe violated multiple provisions of the Maryland Lawyer’s Rules of Professional Conduct, including a failure to turn over exculpatory evidence and the failure to refrain from prosecuting charges not supported by probable cause. Prof. Banzhaf’s complaints heavily rely in the findings of trial Judge Barry Williams.

Gray died by his own hand

I'm sick and tired of protesters griping about the not guilty verdicts in the Freddie Gray cases. Most recently, we have such comments as: "Somebody should be guilty of something … everybody's getting off" and "Something happened … It's not fair" ("Widespread doubt of any convictions," July 19). Tessa Hill-Aston, current president of the Baltimore branch of the NAACP, said during a TV interview following Officer Caesar Goodson Jr.'s acquittal that there's a "flaw" in the legal system. Others have said that the acquittals show that blacks can't get justice. It's as if the majority of the black community wants a judicial double standard: guilt by accusation for cops but guilt beyond a reasonable doubt for everyone else.

There are only two possibilities regarding Freddie Gray's death: Either he died as a result of a rough ride or he injured himself and did so far worse than he intended. The facts strongly suggest the latter. If it had been a rough ride, Donta Allen, who also was in the police van for part of the ride, likely would have been injured as well, but he was not. He also said that he heard banging in Freddie Gray's compartment. No friend of the police, Mr. Allen testified that his trip was a "smooth ride." Police officers would not likely think that they need to seat belt someone to protect him from himself.

Logically, Freddie Gray injured himself, intending to claim that he was given a rough ride, hoping to get an out-of-court settlement from the city. Yet the majority of the black community seems to have its mind made up and will not be confused by the facts. Is The Sun's editorial board so busy burnishing its liberal credentials that it cannot — or will not— fairly address the more likely cause of Freddie Gray's death?

Three Baltimore police officers cleared of criminal charges in Freddie Gray's arrest and death are being investigated by Montgomery County police, who are leading the internal affairs reviews that could determine whether the officers can return to policing city streets.

Officers from the Washington suburb — with help from Howard County police — are interviewing Baltimore police officers and witnesses and examining city policies to determine whether Lt. Brian Rice and Officers Caesar Goodson Jr. and Edward Nero broke department rules during Gray's arrest and transport.

Before next trial in Freddie Gray case, prosecutors face legal 'minefield' over immunized testimony

Before the next Baltimore police officer stands trial in the arrest and death of Freddie Gray, prosecutors will face a barrage of legal questions about whether they gleaned any evidence or strategic advantage from his forced testimony in the trial of another officer in May.

One state high court judge called the process a legal "minefield." An assistant attorney general representing the prosecution said it could present a "banquet of consequences" for them.

Officer Garrett Miller, 27, was compelled against his will to testify in the trial of Officer Edward Nero under a limited form of immunity that prevents prosecutors from using anything he said on the stand against him at his own trial.

Miller's trial is scheduled to begin Wednesday. Before it starts, Baltimore Circuit Judge Barry G. Williams is expected to hold a hearing to determine whether prosecutors took the proper steps to ensure the terms of that immunity agreement — designed to protect Miller's constitutional right against self-incrimination — have not been violated.

Prosecutors dropped all remaining charges against three Baltimore police officers accused in the arrest and death of Freddie Gray in a downtown courtroom on Wednesday morning, concluding one of the most high-profile criminal cases in Baltimore history.

The startling move was an apparent acknowledgement of the unlikelihood of a conviction following the acquittals of three other officers on similar and more serious charges by Circuit Judge Barry G. Williams, who was expected to preside over the remaining trials as well.

It also means the office of Baltimore State's Attorney Marilyn J. Mosby will secure no convictions in the case after more than a year of dogged fighting, against increasingly heavy odds, to hold someone criminally accountable in Gray's death.

Officer William Porter's trial ended with a hung jury and a mistrial in December, before Williams acquitted Officers Edward Nero and Caesar Goodson and Lt. Brian Rice at bench trials in May, June, and July, respectively.

In a hearing Wednesday meant to start the trial of Officer Garrett Miller, Chief Deputy State's Attorney Michael Schatzow told Williams that the state was dropping all charges against Miller, Porter and Sgt. Alicia White.

Mosby needs to be arrested.. locked up... prosecuted.....

She is so dumb.. she is supposed to be an officer of the court.. she will not accept the judicial process, let alone the overwhelming evidence. Her own incompetence makes matters worse. It is not surprising that uninformed, low IQ rabble dont get it... but she should be better.. or at least PRETEND she is not a dumb-ass.

One of Mosby's beefs is… “It is unfair that these cases were decided by a Judge” LOL

Yeah right….. it is often the case that a group of 12 idiots give a WRONG decision… Mosby thinks that is a great system.

THIS judge did great…. he gets it.. and that is not the case with many people involved in cases.. The prosecution often cheat.. play on emotions.. Judges are biased .. even defense lawyers play the system.. at the end Juries simply make the WRONG decision based on the evidence I see.
I am THANKFUL that this Judge was BLACK… not because I have any racial bias myself.. simply because RACE would have been hailed as the basis of his decision had he been white.

Well done Judge Williams.

I cannot look at Mosby, Hillary, Bill Clinton, and George Will. Even Mark Levine has made my stomach turn.

I cannot imagine applauding an impeached rapist president who takes bribes in a Democrat Convention; no America Flags and with "Palestinian" flags waving.

What a freak show!
