COLUMBIA, SC - The man who opened his doors this spring to suspected Charleston church shooter Dylann Roof was arraigned in federal court in Columbia Friday morning on concealing evidence of a felony and lying to an FBI agent.

Joseph “Joey” Meek Jr., 21, of Red Bank, pleaded not guilty and is being held at the Lexington County Detention Center pending the posting of a $100,000 secured bond and a background check by federal probation officials.

An indictment made public Friday alleged that Meek knew about Roof’s plans to shoot African-American parishioners at Emanuel AME Church in Charleston before the June 17 killings and that he “did not, as soon as possible, make known the same to some judge or other person in civil authority under the United States.”

The indictment also alleged that on June 18, a day after the shootings, Meek told an FBI agent “that he did not know specifics of Dylann Roof’s plan,” to kill people at the church. The document alleged that “Meek’s statements and representations denying such specifics were false, fictitious and fraudulent when made.”

Meek, dressed in an orange Lexington County Detention Center jumpsuit, was manacled hand and foot in shiny metal chains. During most of the 20-minute hearing, he sat at the defense table beside his lawyer, Deborah Butcher of Camden.

Search warrants reveal discovery of camera, photos in Dylann Roof case

Investigators found photographs on a camera thought to be Dylann Roof’s, according to search warrants they filed in Richland County.

Roof was said to have posted dozens of images from historic places statewide on a website containing a manifesto that laid out his white supremacist beliefs. The postings, federal authorities have said, helped establish his alleged hate motivations behind the June 17 shooting that killed nine black parishioners at Emanuel AME Church in Charleston.

Fifth Circuit Judge Robert Hood released the search warrant returns Tuesday in response to a S.C. Freedom of Information Act request from The Post and Courier. Investigators are required to file returns in court after searching property. They typically list the evidence found during the search.

While the documents revealed investigators’ discovery of the camera, most of the findings were redacted from the paperwork. The documents also did not state whether the images matched the ones found on the website.

One of the returns lists three pages of evidence found in Roof’s Hyundai Elantra, but each item was censored from the photocopied document. Hood, Richland County’s chief administrative judge, said the redactions by his office were needed because the information “could reasonably jeopardize the ongoing investigation into these events and the future prosecution of the defendant.”

But Jay Bender, an attorney for the newspaper and the S.C. Press Association, said he didn’t see Roof’s prosecution as a law enforcement action that would somehow be foiled by the release of an evidence list.

“I find it interesting that there’s any prospective law enforcement action at all,” he said. “The guy has indicated that he’s willing to plead guilty. He’s in jail, and he’s never going to get out.”

Federal hearing for church shooter Dylann Roof, friend set for Feb. 11

The joint bar meeting for Roof and Joey Meek, both 21, will take place at 10 a.m. Feb. 11 in front of Judge Richard Gergel at the downtown U.S. District Court. Such hearings typically serve as a chance for opposing attorneys to talk about the status of the case and pretrial motions.

Dates for the men’s trials have not been set.

Roof could face the death penalty on nine of his charges if federal officials in Washington decide to pursue the punishment. If they decide not to, Roof likely will plead guilty and accept a lifetime prison sentence. A decision from the Department of Justice is expected in the coming weeks.

But a separate case against Roof in state court is likely to be tried first. Local prosecutors intend to seek his execution in the trial scheduled for July.

CHARLESTON, SC - A federal judge in Charleston on Thursday granted yet another continuance in setting a trial date for Dylann Roof, the accused killer in the Charleston church slayings last summer.

During a brief hearing, assistant U.S. Attorney Jay Richardson indicated to Judge Richard Gergel that the government would have a decision on whether it will seek the death penalty against Roof possibly by early April.

A lack of a decision so far has been the major stumbling block in setting a court date.

But Richardson said the U.S. Department of Justice is far along in a complicated decision-making process. “We have made significant progress.”

If the government decides to seek the death penalty, Richardson said, “Your honor, the government is ready for trial now.”

Roof’s attorney, David Bruck, told Gergel a trial could easily be avoided if the government decides not to seek the death penalty.

“He (Roof) has offered to plead guilty – everybody knows that,” Bruck told Gergel. “The only obstacle is whether the government will insist on the death penalty.”

Still, when Gergel asked Bruck if he was ready for trial if the government does seek the death penalty, Bruck replied, “No, your honor.”

Judge’s patience ‘running out’ as feds’ decision on death penalty for Dylann Roof looms

A judge on Tuesday said his patience was wearing thin as the federal government still has not decided whether to pursue the death penalty against Dylann Roof, the man accused of the deadly mass shooting at Emanuel AME Church in Charleston.

After the case went through a review process at the Department of Justice that typically takes 90 days, it now sits on Attorney General Loretta Lynch’s desk, a prosecutor told U.S. District Judge Richard Gergel. But without final word from Lynch, Gergel said he was forced to approve a fourth continuance, or delay.

He does plan to set a trial date this summer for Joey Meek, the friend accused of not alerting authorities of Roof’s plot before the June 17 attack that killed nine black parishioners.

[...] While Roof’s trial was pushed back, opposing attorneys said Meek, a Lexington County resident, could be tried in the coming court term — possibly in late June or early July. It would take up to two weeks, they estimated. The 21-year-old faces up to eight years in prison on counts of misprision of a felony and lying to FBI agents.

His trial, though, could conflict with Roof’s state proceeding that’s set to begin July 11. The local solicitor already has said she would ask for Roof’s execution if he’s convicted of murder.

[...] A factor for consideration likely is Roof’s willingness to plead guilty in exchange for a lifetime of imprisonment.

“If the decision is not to seek the death penalty, there will be no need for a trial,” Bruck [court appointed attorney] reiterated on Tuesday. “There will be a guilty plea.”

Neither Meek nor Roof attended Tuesday’s hearings.

Judge Delays Trial Against Charleston Church Shooter Dylann Roof Until January

CHARLESTON, S.C. — A South Carolina judge has delayed the state death-penalty trial of Dylann Roof, who is charged with killing nine people at a Charleston church last year.

Circuit Judge J.C. Nicholson on Wednesday granted a request by Roof's lawyers to delay the trial until next year while additional psychiatric testing of Roof is completed.

The defense presented information that a doctor said that he needed another two to six months to examine Roof.

No other details were released at the hearing because a judge has sealed information about Roof's medical records.

Nicholson said the trial will begin Jan. 17, with jury selection to begin in early December.

WASHINGTON D.C. -- The Department of Justice announced Tuesday they will seek the death penalty for Dylann Roof accused of shooting nine black parishioners to death in Charleston, South Carolina, last year.

Roof, 21, faces dozens of federal charges, including hate crimes, stemming from the June 17 shootings. Six women and three men were killed at the historic Emanuel AME Church in Charleston, South Carolina.

"Following the department's rigorous review process to thoroughly consider all relevant factual and legal issues, I have determined that the Justice Department will seek the death penalty," said Attorney General Loretta Lynch in a statement. "The nature of the alleged crime and the resulting harm compelled this decision."

Last month 21-year-old Joey Meek, a friend of Roof, pleaded guilty to lying to authorities and failure to report a crime.

Authorities said Meek failed to tell investigators all he knew about Roof's plans to shoot nine black parishioners at Emanuel AME Church.

Meek previously said Roof stayed with him before the shootings.

He also previously told CBS News that Roof had complained that "black people was taking over the country."

Judge rules jury will mull case of church shooting suspect

COLUMBIA, S.C. (AP) — A jury, not a judge, will consider hate crimes and other federal charges against the man charged in the shooting deaths of nine parishioners at a South Carolina church.

U.S. District Judge Richard Gergel ruled Monday that jurors will determine the guilt or innocence of Dylann Roof in his federal trial. If he’s convicted, a jury will also hear arguments on a possible death sentence.

Roof’s lawyers had requested a bench trial. Earlier Monday, prosecutors filed papers opposing a bench trial.

They have the right to request a bench trial, but the Judge must grant it, this one didn't.
I will try to find the ruling -- WHY. ;)

Tight security planned for Charleston shooting anniversary events

Security will be high at events in Charleston commemorating a mass shooting at an African-American church in which nine people died a year ago this week, police said on Tuesday.

An ecumenical service is planned for Friday morning to remember the slain members of the Emanuel African Methodist Episcopal Church and to honor survivors of the June 17, 2015 rampage by a white man who authorities said was racially motivated.

The Friday service will be held at a 5,000-seat arena a block from the church, the same place President Obama eulogized the church pastor and state senator Reverend Clementa Pinckney last year. Governor Nikki Haley and local, state and federal elected officials are expected to attend.

In addition, 12 days of remembrance events are planned, including a Bible study and service at the church. The attack occurred during a Bible study at the church.

Roads will be closed near events, and those attending Friday's service will be screened for weapons, Charleston Police Chief Greg Mullen said.

Uniformed local law enforcement, state police and agents of the Federal Bureau of Investigation will be "highly visible," Mullen said.

"We want people to know we are there," he said.

Dylann Roof’s attorneys challenge constitutionality of federal death penalty

Dylann Roof’s attorneys have filed a motion challenging the constitutionality of the death penalty, requesting that the government drop the penalty as a possible punishment in his federal court case.

Roof’s lawyers said their challenge is a result of the government’s pursuit of the death penalty instead of accepting his offer to plead guilty to all 33 federal counts and accept multiple life sentences. The charges against Roof, 22, of Eastover, include hate crimes and religious rights violations for the June 2015 shooting that killed nine black worshippers at Emanuel AME Church.

Roof’s attorneys argued the Federal Death Penalty Act constitutes “unconstitutional punishment” and violates the Fifth and Eighth amendments.

Judge Richard Gergel, who is presiding over the case, did not immediately rule on the filings.

[...]The motion calls on the court to declare the act unconstitutional and allow Roof to plead guilty in exchange for life in prison without the possibility of release.

Roof’s federal trial is set for Nov. 7 in U.S. District Court. A murder trial in state court is slated for January.

Admitted Emanuel AME shooter Dylann Roof attacked in jail shower

CHARLESTON CO., S.C. (WCBD) — A police report says a black inmate ran from his cell and down stairs to attack the white man charged with killing nine people in what police said was a racially motivated shooting at a Charleston church.

The Charleston County Sheriff’s Office report said 21-year-old Dylann Roof was in the shower when he was beaten around 7:45 a.m. Thursday at the Charleston County jail. Officials say the incident was unprovoked and was broken up by a detention officer.

The suspect is Dwayne Marion Stafford, 26, of Goose Creek. Stafford was jailed in January for a strong armed robbery and 1st degree assault and battery. He is now facing a charge of Assault and Battery 3rd Degree for the jail beating.

Roof has bruising on his face and back from the incident.

Lengthy jury selection in Charleston church shootings begins

Three thousand potential jurors from the Charleston area were summoned over the summer and asked to fill out a standard questionnaire about education, employment and the like. When jurors report Monday they will be sworn in, introduced to the defendant and attorneys and then the court will hear from any who want to be excused.

Those not excused will then fill out a second questionnaire asking specifically about the Roof case, a questionnaire the judge has sealed.

Once a pool of 700 jurors has filled out the questionnaires they will return Nov. 7 to be individually questioned by the judge.

Once that process produces 70 qualified jurors they will be presented to attorneys who can use strikes to dismiss those they don’t want. Twelve jurors and six alternates will be seated.

Police and FBI investigating anonymous letters that threaten violence, mention Dylann Roof

Charleston police have received nine reports of anonymous letters in recent weeks that contain general threats of racially and religiously motivated violence, with one note mentioning Dylann Roof by name.

The police department and the FBI have opened a joint investigation.

"We take all incidents of this type seriously and investigate them thoroughly," Charles Francis, spokesman for the Charleston Police Department, said in an email.

Several managers at hotels that received the letters told police the notes appeared to have been sent from out of the country. Some envelopes were postmarked in England, and a few had Canadian stamps. They did not include return addresses.

The majority of the letters were addressed to hotels in downtown Charleston, and one was sent to James Island County Park. Staff at Emanuel AME Church, where Roof, a self-avowed white supremacist, is accused of gunning down nine black parishioners in June 2015, also reported receiving two harassing letters in October.

A handwritten note sent to Renaissance Charleston Historic District Hotel last week said "Every one of the 9 lives sacrificed by his greatness, Mr Dylann S Roof, is one less I will need to sacrifice," according to incident reports. A pistol was drawn below the statement.

Jury selection postponed after closed hearing in Dylann Roof death penalty case

A secretive motion upended plans to begin jury selection Monday in the death penalty case against Dylann Roof, delaying the federal trial schedule as a judge huddled behind closed doors with the self-avowed white supremacist and his legal team.

U.S. District Judge Richard Gergel met for about an hour and 40 minutes with Emanuel AME Church shooter and his attorneys. Roof’s lead lawyer, David Bruck, declined comment when he departed at the conclusion of the hearing.

The delayed jury selection will resume at 9 a.m. Wednesday, the court announced.

Gergel barred federal prosecutors from the proceeding along with the public. He did not give any details about the sealed motion, but said he opted to close a hearing on the matter to protect attorney-client privilege and ensure Roof's right to a fair trial.

Through a spokesman, Gergel declined to say more after the hearing, and he indicated a transcript of the proceeding would not be released Monday.

Federal court records show Roof submitted a motion to the court on Sunday, but that document remains blocked from public view, as do two filings submitted Monday morning.

Jay Bender, an open records law expert who also serves as The Post and Courier's attorney, said Gergel was entitled to close the hearing if the subject matter went directly to matters of privilege between Roof and his legal team. But Bender said such decisions should not be taken lightly, and Roof's rights must be balanced with the public's right to see how justice is meted out in the judicial system.

From an initial field of 3,000 residents from across the Lowcountry, 747 people filled out jury questionnaires for the Roof case in September. Whites accounted for about 75 percent of those people and blacks, about 21 percent. Women outnumbered men 48 percent to 42 percent.

Currently, 512 remain in the pool as potential jurors, according to federal court officials.

Two panels, with 10 members each, will be questioned each day until 70 potential jurors are found to be qualified. The final jury will have 12 jurors and six alternates.

Competency hearing for Dylann Roof delayed until Thursday

CHARLESTON, SC (WCSC) - A competency hearing for the man charged in the shooting deaths of nine people at a Charleston church in June 2015 has been delayed by a day.

Dylann Roof is facing 33 federal charges in the June 17, 2015, shooting at Mother Emanuel AME Church. Results of a competency evaluation were slated to be the topic of a hearing on Wednesday.

An order issued by Judge Richard Gergel states the competency hearing will not be complete until Tuesday, requiring the hearing to be pushed back one day to Thursday.

The trial began on Nov. 7, but the process of jury selection was called to an abrupt halt when Gergel announced a last-minute motion required his immediate attention. After a closed-door motion hearing later that morning, he said jury selection was to have resumed the day after Election Day.

But the next day, Gergel said Roof was undergoing a competency evaluation, the results of which were expected to be delivered to the court on Monday in time for a hearing this Wednesday. With that announcement, Gergel pushed it back until Nov. 21.

Accused Emanuel AME Church shooter Dylann Roof is mentally competent to face his looming death penalty trial, a judge ruled Friday to the relief of the victims' distraught loved ones, who had expected the proceeding to begin two weeks ago.

U.S. District Judge Richard Gergel’s ruling followed a closed-door competency hearing that stretched through Monday and Tuesday as attorneys discussed a new psychiatric evaluation of Roof. Gergel ordered that evaluation two weeks ago after defense attorneys raised new questions about the self-avowed white supremacist’s mental state.

Jury selection will begin at 9 a.m. Monday.

A federal judge has ruled that accused Emanuel AME Church shooter Dylann Roof can represent himself in his federal death penalty trial, potentially allowing the self-avowed white supremacist to question the shooting survivors and nine victims' family members if they are called to testify.

Roof made the last-minute request as jury selection was set to begin this morning. U.S. District Judge Richard Gergel cautioned Roof against serving as his own attorney, noting his defense team's considerable legal expertise, but ultimately granted the request. He noted that Roof has a constitutional right to represent himself.

"I do find defendant has the personal capacity to self-representation," Gergel said. "I continue to believe it is strategically unwise, but it is a decision you have the right to make."

Roof, garbed in a striped grey-and-white jail uniform, answered the judge's questions with "yes, sir" in a quiet, raspy voice. After Gergel's ruling, he smiled slightly as he returned to his defense table but showed no other obvious emotion. He then sat in the front-and-center seat as his lead lawyer, renowned capital defense attorney David Bruck, scooted over. Roof told the judge that he wanted his attorneys, who will act as "stand-by counsel" now, to sit at the table with him.

At one point, Bruck stood to object to a potential juror after the court had moved on to consider others without Roof objecting. The judge admonished Bruck and told him to sit down and confer with Roof.

“Mr. Roof elected to self-represent,” Gergel said.

The first panel of 10 prospective jurors brought in Monday morning were all white and appeared to be middle-aged or older. Filling three rows in the audience, an all-black group of shooting survivors, families of the nine dead, and the pastor of Emanuel AME listened attentively with no outward reactions to news that Roof would be acting as his own attorney.

Best guess is that Dylann believes he will be able to use his trial as a platform. The judge is sharp so I think Dylan will grow weary of being silenced by the court pretty quickly.
