Officer Goodson elects bench trial in Freddie Gray case, to begin Thursday

Baltimore Police Officer Caesar Goodson Jr., the driver of the van in which Freddie Gray suffered a fatal spinal cord injury, will proceed to trial Thursday before a judge, rather than a jury, and with prosecutors unable to present key evidence that Gray allegedly told officers "I can't breathe" during his in-custody transport.

Goodson is the second officer in a row to elect a bench trial in the case. Officer Edward Nero was acquitted of all charges by Circuit Judge Barry G. Williams last month.

Legal experts said Goodson's decision, which came during a pre-trial motions hearing in a downtown courthouse on Monday, may have been made easier by Nero's acquittal, but also noted the two officers' cases are distinct and that a bench trial comes with its own risks.

Smart move, IMO.

The Jury pools is tainted.. and comprised of a lot of morons anyway. The "judgement by peers" thing doers not work when you have ignorant peers, incapable of following "Innocent until proven guilty" and BEYOND reasonable doubt.. and evaluation of evidence and NOT corrup prosecution appeals to emotion. The Judge MIGHT get it? In with a chance since he got it right for Nero.

Judge Barry Williams will hold a hearing Thursday on the first day of trial for Officer Caesar Goodson about whether prosecutors wrongly withheld discussions they had with a potential witness in the Freddie Gray case, newly unsealed documents show.

Attorneys for Goodson are asking Williams to dismiss the charges against him, alleging the failure to disclose the information was a violation of his rights. Documents filed by both sides were filed under seal, but unsealed by Williams on Wednesday.

The 11th-hour filings revolve around Donta Allen, the second man who was placed inside the police transport van after prosecutors say Gray was severely injured. Police said Allen told investigators that Gray was thrashing around the van, but Allen has publicly recanted that statement and said he only heard a faint tapping, according to court documents.

Prosecutors dismissed the meeting as inconsequential, saying it produced no evidence because Allen was "consistent with his inconsistence." They say their meeting with him was "farcical" and "unproductive," and they do not intend to call Allen as a witness.

Goodson's attorneys say Allen's attorney, Jack B. Rubin, contacted them last week and said the state had concealed for over a year that they had met with Allen last May. The defense says Williams has twice determined that the state improperly failed to produce discoverable evidence in two prior occasions.

They SHOULD dismiss the case :stamp

In fact... they should dismiss all 5 cases remaining and ARREST Mosby and the rest of her team.

This is how I feel about the whole witch hunt.

I am very pleased that Goodson has opted for the bench trial. The defense is basically daring the judges to put their careers on the line. Bravo!

Judge Finds Prosecutors Withheld Evidence in Freddie Gray Officer Case

The judge overseeing the trial of a police officer charged with murdering Freddie Gray has determined that prosecutors withheld information that would have been beneficial to the defense.

Judge Barry Williams was visibly angry in the Baltimore court but he did not dismiss the charges against police officer Caesar Goodson, as his attorneys had requested. Williams is giving prosecutors until Monday to disclose any other relevant evidence they have withheld. Goodson was the driver of the van during the arrest of Gray, 25, last year.

Goodson's attorneys have argued that prosecutors withheld statements made last year by Donta Allen, a key witness. Allen was picked up by the Baltimore police van after Gray.

In his original statement to police in April last year, Allen said he heard loud banging coming from Gray's side of the vehicle. He gave a similar statement in a separate interview a month later, but the state never turned it over as evidence to defense attorneys. Judge Williams found today that prosecutors committed a so-called Brady Violation because Allen's May 2015 statement was deemed exculpatory evidence and it's the state's duty to divulge this information to the defense.

During the crucial last leg of Freddie Gray's ultimately fatal transport in the back of a Baltimore police van last year, there were only two other people present: the driver, Officer Caesar Goodson Jr., and Donta Allen, an arrestee placed on the other side of a thin metal divider from Gray.

Given his unparalleled proximity, Allen since has been a figure of considerable intrigue in the criminal cases brought against Goodson and five other Baltimore officers in relation to Gray's transport and death. That's in large part due to contrasting statements he has made — one to police in which he said he believed Gray was "trying to knock himself out" in the back of the van, and others to the media recanting that statement.

On Thursday, Goodson's trial began with an extended discussion on a motion by the defense, unsealed Wednesday, requesting that the entire case be dismissed because prosecutors had failed to disclose another, extended proffer session they had with Allen a year ago, not long after the charges against the officers were brought.

Andrew Graham, Goodson's attorney, said Allen repeated his initial statement to police at that meeting, and that the evidence was therefore exculpatory and required to be handed over by prosecutors. Short of a dismissal of the case, Graham asked that Allen's statement to police be allowed into evidence regardless of whether he takes the stand. He said such an allowance was warranted in part because prosecutors had already been reprimanded for not disclosing evidence in the case twice before.

Judge Barry G. Williams denied the motion and rejected the request to allow Allen's statement into evidence. But he also excoriated Chief Deputy Michael Schatzow and other prosecutors for failing to disclose the information, giving Schatzow until Monday to produce any and all exculpatory evidence that has not already been handed over in Goodson and the other officers' cases.

He repeatedly slammed Schatzow, Baltimore's second highest ranking prosecutor, for insinuating that Allen's statements during the proffer session were not exculpatory. "I'm not saying you did anything nefariously, I'm saying you don't know what exculpatory means," Williams said.

Schatzow argued that Allen provided nothing at their meeting in May 2015 that required disclosure to the defense, and described Allen's comments there as entirely unreliable and contradictory — so much so, in fact, that they don't intend to call him as a witness.

Schatzow also said Thursday that the state believes Allen was coached on what to say in his initial statement to police by another police officer, Officer Zachary Novak, who the state granted immunity in order to testify before the grand jury — where he denied the coaching accusation.

Hopefully Judge Williams has more common sense than the ME and can see right through an obvious "false guess". Based on what I have read of Gray's past, IMO, he tried to injure himself in the van so he would go to the hospital in lieu of jail... and he succeeded. He had a history of pretending he was hurt.

I take your point, boyntonstu, but in the context of what this ME is trying to PUSH... she is implying it was "homicide" (caused by a person other than Freddie himself.. she is ruling out an "accident" that Freddie caused to himself... which amounts to "suicide" (we presume unintentional) as opposed to her interpretation of "homicide"

natural
undetermined

If she had ruled "accident" or "undetermined" the lawsuits would be more difficult to try, esp. the latter. Mosby needed that "homicide" ruling to bring charges. I think the "week of weighing options" by the ME was most likely meetings with Mosby and her people. Of course I am just guessing. :roll
