RANDOLPH COUNTY, IL – Drew Peterson has been charged with solicitation of murder and murder for hire in an Illinois courtroom Monday morning. He is accused of tying to hire someone to kill Will County State’s Attorney James Glascow, the lead prosecutor in Peterson’s 2012 murder trial.

The Randolph County State’s Attorney writes in a statement to the media, “The charges allege that between September 2013 and December 2014, the defendant solicited an individual to carry out a murder-for-hire plot against Will County State’s Attorney James Glasgow. The defendant made an initial appearance on the charges today at the Randolph County Courthouse. A preliminary hearing is set for March 3 at 10am.”

A Randolph County judge on Tuesday set a July 6 jury trial for Peterson. The ex-Bolingbrook police sergeant is accused of enlisting another prison inmate whose identity has not been disclosed in a murder-for-hire plot to kill Will County State's Attorney James Glasgow. Peterson pleaded not guilty in March.

CHESTER, Ill. — A southern Illinois judge has granted Drew Peterson’s request to delay his trial on charges that the former suburban Chicago police sergeant plotted to kill the prosecutor who helped convict him in the death of Kathleen Savio, his third wife.

The Randolph County trial had been scheduled to begin July 6. But Peterson’s lawyer said Friday in a brief hearing that the 61-year-old ex-Bolingbrook officer needs more time to prepare.

“We’re just not going to be ready by then,” said attorney Lucas Liefer.

Prosecutors didn’t oppose the request. The trial is now set to start Aug. 28.

Peterson is scheduled to return to court in a July 7 hearing on three prosecutorial motions that were initially supposed to be discussed Friday.

Prosecutors have asked the court to allow prosecutors to cross-examine Peterson about his first-degree murder conviction should he choose to testify. And they want permission to discuss a 2003 attempt by Peterson to pay someone $25,000 to “take care of” Savio. The third seeks to limit discussion at trial about the details of the confidential informant’s own first-degree murder conviction.

Several irregularities surrounding wiretaps in Drew Peterson's murder-for-hire case — including a key eavesdropping consent form listing the wrong defendant's name — could put the recordings in jeopardy, according to newly filed court documents from Peterson's attorney.

In a motion filed this week, Peterson's attorney alleged that prosecutors made mistakes in how they got the recordings and questioned why a Will County judge met with a jailhouse informant nearly three weeks before authorities asked him for permission to record conversations between the informant and Peterson. The filing also claims that the investigation was tainted by a conflict of interest because of the involvement of prosecutors who work for Will County State's Attorney James Glasgow, the target of the alleged plot.

Peterson's attorney argues that the unusual circumstances surrounding the wiretaps, when taken in their totality, should render the recordings inadmissible at trial.

The nine-page defense motion suggests Will County prosecutors played a significant role in the solicitation investigation from its early stages as they interviewed witnesses, made prison visits and sought the legal documents needed to secretly record Peterson. Glasgow's participation was not mentioned when Peterson was charged.

The defense argues that Glasgow's office should have asked a special prosecutor to oversee the investigation because it had a conflict of interest. Legal experts said that neither Glasgow nor anyone who works for him should have been involved in the investigation.

The defense motion includes an allegation that the informant never signed the necessary consent form to record conversations between himself and Peterson. Instead, the consent form authorizes eavesdropping on conversations between Peterson and a man named Stephen Nardi, the filing states.

Nardi, a former Grant Park police lieutenant, was charged last year in Will County with criminal sexual assault. He has been out on bond since August 2014, records show, and has never been imprisoned. His attorney, Eugene Fimbianti, said Wednesday that his client was not involved in the Peterson case. He said he assumed a clerical error led to Nardi's name appearing on the consent form.

Peterson's motion also alleged that a Will County judge interviewed the informant in the case nearly three weeks before authorities asked him for permission to record conversations between Peterson and the fellow inmate.

Will County Chief Judge Richard Schoenstedt met with the informant on Oct. 3, 2014, at Stateville Correctional Center near Joliet, according to the filing. Schoenstedt authorized the eavesdropping application on Oct. 23 and then extended the court order on Nov. 20. The defense argues that the judge took on an investigative role when he interviewed the informant and, because of that, could not maintain the necessary neutrality in the case.

The part of the article I put in red is not correct. From the actual motion and another article I had read the defense says that the Consent form authorizes eavesdropping on conversations between informant A and the suspect Stephen Nardi.

Good catch, SheStone :) If putting the wrong defendant's name on the form is not confusing enough, oops! The motion sounds strong to me, but legal experts are saying it won't fly. The conflict of interest seems to be the best argument, the clerical error not so much. But who knows what the judge will do.

The court was closed to the public and the media for more than an hour as counsel for the defense and prosecution argued over “A people’s motion to admit relevant evidence of Peterson’s conduct and other acts evidence.”

Circuit Judge Richard A. Brown granted defense attorney Lucas Liefer’s request to close the court as the publication of the subject matter could affect potential jurors.

In open court, Brown heard arguments on several motions, including a defense motion to suppress evidence as it relates to eavesdropping.

Lastly, the attorneys argued a motion to suppress evidence related to the recordings.

Liefer said there was no reasonable cause for an eavesdropping device to be used as there were no affidavits (written, sworn statements that can be used as evidence in court) attached to the application.

The parties will be back in court on Sept. 29 at 9 a.m. to discuss one, possibly two more motions yet to be filed by the defense. If needed, a date of Oct. 2 was set aside as well.

Drew Peterson's murder-for-hire trial in southern Illinois has been postponed until early next year.

The former suburban Chicago police officer is charged with soliciting an inmate to kill Will County State's Attorney James Glasgow, who prosecuted the 2012 case in which Peterson was sentenced to 38 years in prison for the bathtub drowning death of ex-wife Kathleen Savio.

A Randolph County judge on Tuesday granted a request for more time by Peterson's court-appointed attorney. A trial set to begin in November is now scheduled to start Feb. 29.

The ex-Bolingbrook sergeant is challenging wiretap evidence he says was improperly obtained, with a Will County judge first meeting with a jailhouse informant before considering the request to secretly record Peterson.

JOLIET, Ill. (WLS) --Drew Peterson, former Bolingbrook police sergeant and convicted killer, is expected in court Tuesday.

He is accused of trying to hire someone to kill Will County State's Attorney James Glasgow.

Peterson is already serving a 38-year sentence for the 2004 murder of his wife Kathleen Savio. Glasgow prosecuted the 2012 case.

The Savio case was reopened after Peterson's fourth wife, Stacy Peterson, disappeared in 2007.

Peterson is challenging wiretap evidence he said was improperly obtained. A pre-trial hearing for the murder-for-hire case was canceled last month due to flooding at the courthouse.

A decision on future court dates is expected during Tuesday's hearing.

Back in court Tuesday for a case management hearing ahead of the scheduled Feb. 29 trial, Randolph County Circuit Court Judge Richard A. Brown denied a motion by the defense to continue the case once again.

Walker asked Brown for one more case management hearing prior to trial to clear up any remaining issues and revisit a motion still under consideration. That hearing was set for Monday, Feb. 8 at 1 p.m.
