Rallies planned Monday one month after Walter Scott shooting death

By WCBD News | May 4, 2015

CHARLESTON, SC - A modest memorial marks the spot in North Charleston where Walter Scott was killed in April after a traffic stop turned deadly and eventually into a national conversation.

It has been a month since Scott took off running where he was later shot and killed by former officer Michael Slager.

[...]
Walter Scott's death gaining national attention and continuing a conversation of police brutality with rallies sprouting up around the Lowcountry, including more planned for Monday. Muhiyidin D'Baha will be at North Charleston city hall at a part vigil for Scott and part rally for citizen's review board. "We need to have trust and legitimacy between the community and policing," said Muhiyidin D'Baha, a community organizer.

Michael Slager indicted in slaying of Walter Scott

CBS News
AP June 8, 2015, 11:21 AM

NORTH CHARLESTON, S.C. - A white former North Charleston police officer has been indicted on a murder charge in the fatal shooting of an unarmed black man who was running away from the officer.

The April 4 shooting was captured on video by a bystander and showed officer Michael Slager firing eight times at 50-year-old Walter Scott. The shooting rekindled the ongoing national debate about the treatment of black suspects at the hands of white officers.

Slager was charged and fired from his job almost immediately after the video surfaced. Prosecutor Scarlett Wilson announced the indictment Monday.
"The jury will make up its own mind after it sees the video and hears the other testimony," Wilson said of Slager's trial.

No trial date has been set.

Wilson said earlier the death penalty does not seem to apply because there were no aggravating circumstances such as robbery or kidnapping as required under South Carolina law. In South Carolina, the investigating agency typically presents the case to a grand jury, not the prosecutor.

The 33-year-old Slager faces 30 years to life in prison if convicted.

Wait, Whut? – Hillary Clinton Calls Ryan Julison To Coordinate Call To Walter Scott Family….
Posted on June 17, 2015 by sundance
Clinton and Julison, apropos on so many levels….

SOUTH CAROLINA –
Democratic presidential candidate Hillary Clinton phoned Walter Scott’s family Wednesday, offering them her condolences following his death in a police shooting earlier this year.

Clinton called his mother, Judy Scott, while campaigning in South Carolina, according to CNN.

Ryan Julison, a spokesman for the Scott family’s legal representation, said Clinton promised his surviving loved ones that she was “going to work to make sure this doesn’t happen to another family,” it said.

“She told Mrs. Scott that she was very sorry for her family having to go through this,” Julison said of the five-minute phone call, the publication reported.

“Mrs. Scott asked if it was possible for them to meet, to which Secretary Clinton said they would try to make that happen next time she was in the area,” Julison said, according to CNN.

“Judy Scott was very appreciative,” he added. “Mrs. Clinton is the first presidential candidate to call the family and she was really impressed with what Mrs. Clinton has to say.”

Attorney For Officer Michael Slager Gently Outlines Investigative Flaws – How South Carolina Rushed To Judgment…
Posted on July 4, 2015 by sundance

The shooting of Walter Scott by Police Officer Slager was immediately broadcast to the world. Unfortunately, like many of those previous broadcasts, the narrative transmitted was fraught with manipulation and agenda. The Scott family brought in Ryan Julison to direct the media and tell a story. A very specific story.

Now, the attorney for Officer Slager has to begin a careful and deliberate process of bringing truthful sunlight upon the shooting.

SOUTH CAROLINA – Private investigators for the former North Charleston policeman jailed in Walter Scott’s death found two bullets that had been missed by state agents who examined the shooting scene two weeks earlier, according to court documents filed by the officer’s attorney.

But it was how the State Law Enforcement Division handled other evidence that has prompted a point of legal contention and a motion by Michael Slager’s attorney for a court inquiry into the agency’s destruction of evidence.

Walter Scott Shooting Update – Judge To Consider Bond August 27th…
Posted on August 7, 2015 by sundance

There’s still a better than 50/50 possibility Michael Slager will be acquitted because the prosecutor is only charging capital murder.

SOUTH CAROLINA – A judge will consider granting bail during an Aug. 27 hearing for the former North Charleston police officer charged with murder in Walter Scott’s shooting death.

Circuit Judge Clifton Newman will preside over the 10 a.m. bond hearing at the Charleston County Judicial Center at Broad and Meeting streets, prosecutors and attorneys involved with the case said Thursday.

The defense lawyer for Michael Slager, who has been jailed for four months since his April 7 arrest, asked the judge earlier this week to consider setting a reasonable bail. Without offering specifics, the lawyer, Andy Savage, cited “extensive” evidence that favored his client

Defense lawyers seek local chance to examine Michael Slager, Walter Scott clothing
Andrew Knapp
Aug 12 2015 5:40 pm Aug 12 6:02 pm

North Charleston police officer Michael Slager aims his pistol as Walter Scott runs. To the far right in this image, an object,
apparently Slager’s Taser, bounds along the ground. In the center are two cartridges from Slager’s Taser. Scott’s hat also is visible.

Defense attorneys for a North Charleston police officer have asked state investigators for a chance to inspect clothing that the lawman and Walter Scott were wearing as they fought moments before Scott’s death.

Former officer Michael Slager remains jailed on a murder charge after he fatally shot Scott, 50, in the back on April 4.

A cellphone video showed the two struggling on the ground — apparently over a Taser — before Scott and Slager stood. Scott started running away, and Slager fired eight times, hitting Scott from behind.

Attorney Cameron Blazer, who works at lawyer Andy Savage’s downtown firm, wrote in a motion filed Monday that Slager’s defense team should get an opportunity to examine the men’s clothes in Charleston instead of 100 miles away at a State Law Enforcement Division laboratory in Columbia. SLED is investigating the shooting.

It wasn’t immediately known when Circuit Judge Clifton Newman might rule on the motion.

Walter Scott Shooting Update – Michael Slager Attorney To Offer Evidence Similar To Our Previous Outline…
Posted on September 8, 2015 by sundance

Officer Michael Slager has been in jail since April charged with murder. The first judicial hearing for Officer Slager, and the possibility for bond, will take place this Thursday.

Today media reports begin to surface from attorney Andy Savage which glean a considerable similarity in defense to our initial research discoveries:

Walter Scott was “on top” of Slager during the initial struggle. (link) [we first discovered this in our initial research]
Walter Scott’s DNA is on the tazer Officer Slager deployed. (link) [this was anticipated as a result of the visible struggle identified ]
During the struggle Officer Slager was “tazed” twice by Scott using his own weapon (link) [our research previously identified this distinct probability]
Walter Scott was “fleeing” Officer Slager due to outstanding warrant (child support)
A strong possibility exists that a weapon was on the scene between the originating point of the initial chase to the final disposition where the video of the lengthy struggle begins. (link)

Here is the current media release containing defense attorney Savage comments.

Could new evidence get Michael Slager out of jail?
September 8, 2015, 7:06 AM

Defense lawyers in South Carolina are prepared to offer controversial new evidence in the deadly police officer shooting of a reportedly unarmed black man.

Cell phone video from April shows now former officer Michael Slager shooting Walter Scott during a traffic stop in North Charleston, but Slager's attorney says new evidence shows there is more to the confrontation, reports CBS News correspondent Jeff Pegues.

The 33-year-old's defense team now says it will present evidence at Slager's bond hearing Thursday that includes never-before-seen stills from the cell phone video that are said to show Scott on top of Slager.

Update: Walter Scott Shooting – Officer Slager Court Hearing – No Bond Decision Today….
Posted on September 10, 2015 by sundance

Reporter Andrew Knapp attended the first pre-trial hearing today. He filed the following reports:

UPDATE: Defense argued that Walter Scott got on Slager during a struggle and pummeled him. Attorney Andy Savage said Michael Slager looks forward to clearing his name. Prosecutor Scarlett Wilson, though, said Slager became executioner and planted evidence, lying to make it look like self-defense.

UPDATE: Michael Slager bond hearing is over. No decision by the judge in impassioned, emotional three-hour hearing for Michael Slager, the former North Charleston policeman charged with murder in Walter Scott’s shooting death.

Judge: “This matter is deeply important and will be treated as such,” the judge, adding he needs time to digest the arguments. He will not rule today. (Read More)

North Charleston reaches $6.5 million settlement with family of Walter Scott

By Greg Botelho and Sonia Moghe, CNN | October 9, 2015

North Charleston, South Carolina -- The family of the late Walter Scott and the city of North Charleston, South Carolina, have reached a $6.5 million settlement.

The North Charleston City Council approved the settlement on Thursday night.

Scott was fatally shot on April 4 by former North Charleston police officer Michael Slager after being pulled over, reportedly for a broken brake light, and later struck in the back as he was running away from police.

Slager was later charged with murder in the case. State Circuit Judge Clifton Newman denied him bond last month, writing that his possible release "would constitute an unreasonable danger to the community."

While that part of the legal process continues, the city of North Charleston faced the prospect of a drawn out and potentially expensive legal battle with Scott's family.

"This is the largest settlement of this type case in the history of South Carolina," said City Attorney Brady Hair.

Thursday's announcement means the threat of a lawsuit is over.

Walter Scott Shooting Update – SLED Agent Fired After Exposing Sketchy Investigation Adverse To Officer Michael Slager…
Posted on December 3, 2015 by sundance

This is interesting and deserves being back on the radar. In South Carolina the prosecution of Officer Michael Slager (Walter Scott Shooting) continues.

In a remarkable similarity to the fraudulent prosecutorial investigation of State Attorney Angela Corey in the ’12/’13 Zimmerman case, in South Carolina another rogue and racially inspired prosecution appears to be heading down a similar path adverse to Officer Slager.

Despite defense requesting “preservation of evidence”, and despite a judges order affirming the presentation, the State of South Carolina prosecutorial team shipped the Taser out of state without trying to protect DNA evidence:

Hearing Scheduled for Former Officer Michael Slager
By Bruce Smith, AP | WLTX | January 4, 2016

Charleston, SC (AP) - A state judge is hearing a speedy trial request by a former South Carolina police officer charged with killing an unarmed black motorist.

Attorneys for Michael Slager, who is white and charged with murder in the shooting death of Walter Scott last April, say they'll be ready for trial this spring.

Prosecutor Scarlett Wilson says the trial should be held next November at the earliest.

Circuit Judge Clifton Newman holds a Monday hearing on the matter.

I don't know about this last day in October trial setting. A speedy trial request by a Defendant is just that... and it is a defense strategy which is now moot in this case. IDGAF if the prosecutor has an earlier (high profile) scheduled trial. This is what "staff" are for. :Q44

Michael Slager granted $500,000 bail; trial set for Oct. 31
By Andrew Knapp | The Post and Courier | January 4, 2015, updated 4:33PM

UPDATE: Judge Clifton Newman ruled that the trial delay was a change in circumstance that allowed him to reconsider bail.

UPDATE: Judge said he was troubled by the delay in trial, which he set for Oct. 31.

UPDATE: Michael Slager has been granted $500,000 bail. He will be on house arrest if released.
---------------------------
A judge later today is expected to consider a trial date for the former North Charleston officer who fatally shot Walter Scott and whether the defendant should get a chance at bail.

Attorneys for Michael Slager, who is charged with murder in Scott’s April 4 death, have filed a motion for a speedy trial and asked Judge Clifton Newman to set the date in the spring.

But prosecutors have fought the request, noting that another judge has ordered them to try Dylann Roof, the man charged in the mass killing at Emanuel AME Church, in July. They need time to prepare, they said in asking for a November trial date for Slager.

Ex-S.C. policeman indicted on federal charges in shooting of unarmed black man
CHARLESTON, S.C. | By Harriet McLeod

Image

A white former police officer has been indicted in U.S. court on a civil rights violation and a charge of lying to investigators after he fatally shot a black man following a traffic stop in South Carolina last year, court records unsealed Wednesday show.

Michael Slager shot Walter Scott without legal justification in April 2015, a federal grand jury found, depriving the motorist of his right to be free from the use of unreasonable force by a law enforcement officer.

The grand jury also charged Slager with discharging a gun during a violent crime and obstructing justice by intentionally misleading state investigators probing the shooting.

The shooting in North Charleston was one in a series of incidents that drew national attention amid concerns about the use of force against minorities by police in cities across the United States.

The federal charges against Slager mark a rare instance of U.S. prosecutors taking action in a case involving alleged misconduct by a police officer, said Justin Bamberg, a lawyer for Scott's family.

"It sends a very strong message," Bamberg said in a phone interview. "That conduct is unacceptable."

The civil rights violation carries a potential maximum sentence of life in prison because the incident resulted in a death, he said.
[.....]
Slager, who was fired from the North Charleston force after the shooting, was previously charged with murder in state court. He maintains his innocence in that case, which is scheduled to go to trial in October.

His arraignment on the federal charges is set for 1:30 p.m. ET in Charleston on Wednesday.

Andy Savage, a lawyer for Slager, did not immediately comment on the federal case.

I can find SO little on the shooting case. Nothing on the July 7th hearing. Have read through many articles because the judge is also trying Dylann Roof (State trial) and he's combined several hearings for both cases. Trial is still set for October 31st.

Only info I could find on the July 18th hearing (mentioned in this article) is a single tweet: @SamInteractive No decision yet on the matter. Order will come at a later date from the judge. #MichaelSlager #CHSnews

Police group refuses to pay Slager’s legal fees, says Walter Scott shooting and lies not part of officer’s duty
By Andrew Knapp | The Post and Courier | July 15, 2016

A police advocacy group does not want to pay former North Charleston officer Michael Slager’s legal fees because shooting Walter Scott to death, planting evidence and lying were not in his job description, a court filing says.

Slager had been paying the Southern States Police Benevolent Association a $23.50 monthly fee for legal representation should he ever find himself fending off civil claims or criminal charges.

Slager sued in U.S. District Court, saying the group violated an insurance contract that promised unlimited legal aid if he were involved in a shooting. The association on Thursday asked a judge for “summary judgment,” an order that would end Slager’s claims before trial.

[...]U.S. District Judge David Norton is expected to take up motions in the lawsuit during a hearing at 2 p.m. Monday in downtown Charleston.

By Tori Bolt | July 15, 2016, 11:45 am

CHARLESTON, S.C. (WCBD) — Attorneys for Michael Slager are once again asking prosecutors for all documents, photographs and other materials related to his case.

Slager’s attorneys say their previous discovery motions have not been fulfilled, and want the solicitor to comply within 30 days.
