Prosecutors say friend wanted to help accused Boston bomber

U.S. prosecutors argued that a friend of Boston Marathon bombing suspect Dzhokhar Tsarnaev wanted to help Tsarnaev when he took evidence from his dorm room, while a defense attorney described him as a college kid who did not understand what he was doing.
Kazakh exchange student Azamat Tazhayakov is the first of three friends of Tsarnaev charged with going to his room three days after the April 15, 2013, attack that killed three people and injured 264 and removing a laptop computer and backpack containing empty fireworks shells.
The visit occurred hours after the FBI released photos of Tsarnaev and his older brother at the site of the bombing and asked for the public's help in learning their identities, Assistant U.S. Attorney John Capin said in closing arguments at U.S. District Court in Boston.

"By the time the FBI searched the Tsarnaev dorm room, which was one of the first things they did when they identified Mr. Tsarnaev as a suspect in this investigation, it was too late,” Capin said. "Why did he do these things? He did these things to protect his friend, Dzhokhar Tsarnaev."
Tazhayakov, now 20, and his roommate, Dias Kadyrbayev, decided later that night to throw away the backpack after growing concerned that their friend Tsarnaev was a suspect in the investigation, contend prosecutors, who charged them with obstruction of justice and conspiracy.
But defense attorneys on Wednesday said Kadyrbayev had taken the items and portrayed Tazhayakov as not understanding the consequences of his actions.

Judge finds accused Boston bomber friend's words to FBI voluntary

A friend of the accused Boston Marathon bombing suspect did not speak involuntarily when telling FBI agents about the removal of a laptop and backpack from the suspect's room and his statements are admissible as evidence, a U.S. judge said on Tuesday.
Lawyers for Kazakh exchange student Azamat Tazhayakov had argued against admission of the comments he made during an hours-long interview that began when more than 50 heavily armed agents raided his apartment four days after the deadly blasts and continued into the next morning.

Tazhayakov's attorneys said he did not feel free to leave during the interrogation.
During six days of testimony at Tazhayakov's trial on obstruction of justice charges, FBI agents said he and roommate Dias Kadyrbayev admitted to taking the laptop and backpack from bombing suspect Dzhokhar Tsarnaev's dorm room at the University of Massachusetts at Dartmouth.
Tazhayakov spoke to the FBI for hours beginning the night of April 19, 2013, following the raid, into the predawn hours of April 20.

"While it may have been improvident, it was not involuntary," U.S. District Judge Douglas Woodlock said on Tuesday at a final hearing in Tazyahaykov's trial before closing statements are delivered on Wednesday and jury deliberations begin.

Jury out until Monday in Tsarnaev friend’s case

The jury in the trial of Azamat Tazhayakov, a college friend of Boston Marathon bombing suspect Dzhokhar Tsarnaev, has finished its first full day of deliberations without reaching a verdict.

The jury will not return until Monday because of a scheduling conflict that will prevent US District Judge Douglas P. Woodlock from presiding on Friday.

Also, as the jury adjourned around 4 p.m., Woodlock reported that one of the 12 jurors had fallen ill and was told by a nurse that it was best to go home for the day. Woodlock said the illness wasn’t likely to be an issue next week.

No verdict after Day 2 in Tsarnaev friend trial

The jury in the trial of a man accused of trying to protect Boston Marathon bombing suspect Dzhokhar Tsarnaev deliberated for a second day without reaching a verdict on Thursday.
Azamat Tazhayakov is accused of agreeing with another friend to take a backpack containing opened fireworks and other items from Tsarnaev's dorm room several days after the 2013 bombing. He is charged with obstruction of justice and conspiracy.
The jury began deliberations Wednesday afternoon, and continued deliberating Thursday until a juror became ill. The jury was dismissed about 4 p.m. and will resume deliberations Monday.
Tazhayakov, 20, who attended the University of Massachusetts-Dartmouth with Tsarnaev, denies the charges. His lawyer told jurors it was another friend, Dias Kadyrbayev, who took Tsarnaev's backpack and later threw it away. Agents recovered it in a landfill.

Marathon suspect's friend guilty of impeding probe

BOSTON (AP) — A college friend of Boston Marathon bombing suspect Dzhokhar Tsarnaev has been convicted of impeding the investigation into the attack.

Azamat Tazhayakov was found guilty Monday of obstruction of justice and conspiracy. Prosecutors say he agreed with a friend who removed Tsarnaev's backpack from his dorm room several days after the 2013 bombing. The backpack contained altered fireworks.

Friend of Dzhokhar Tsarnaev arrested, may have provided pistol used to kill MIT officer Sean Collier
Stephen Silva made an initial appearance in federal court on charges related to heroin trafficking and possession of a handgun with an obliterated serial number. The 9 mm Ruger pistol described in the indictment is the same handgun that was used to kill MIT police officer Sean Collier during the manhunt for the Boston Marathon bombing suspects, according to two sources.

Stephen Silva made an initial appearance in federal court on charges related to heroin trafficking and possession of a handgun with an obliterated serial number. An attorney for Silva, Jonathan Shapiro, said Tuesday evening that he received the case only a few hours earlier and was not in a position to comment.

Silva, Silva and Tsarnaev: A Confusing Story

Yesterday the feds arrested Stephen Silva of Cambridge, MA for heroin dealing and possession of a firearm with a partially obliterated serial number. Leaks from law enforcement claimed the gun is the one used to kill a Cambridge police officer days after the Boston Marathon bombings.

In June, the Judge in Dzhokhar Tsarnaev's case said he was very concerned about leaks but declined to issue a gag order. He should be more concerned now. As should the judge in Silva's case, since Silva isn't charged with anything related to the bombing, the Tsarnaev's or the officer's shooting.

He was charged with unlawful possession of a gun that had an altered or obliterated serial number. That police say it's the same gun that killed the officer says nothing about how the Tsarnaev's got it. Silva could have given it any number of people who might have given it to the Tsarnaevs. who ended up giving it to the Tsarnaevs. Maybe someone paid a drug debt with the gun and not being into guns, sold it the next day, and the person he sold it too sold it to Tsarnaev.

Marathon bomb suspect's lawyers seek leaks hearing



BOSTON (AP) — Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev (joh-HAHR' tsahr-NEYE'-ehv) have renewed their request for a judge to hold a hearing on leaks to the news media.

Last month, a judge issued a stern warning to prosecutors about former or current members of their team speaking to the media after Tsarnaev's lawyers objected to interviews retired FBI agents gave around the anniversary of the deadly 2013 bombings.

The request came after several news outlets this week reported that investigators believe a friend of Tsarnaev provided the gun authorities say was used by Tsarnaev and his brother in the fatal shooting of an MIT police officer several days after the bombings.

On Friday, Tsarnaev's lawyers asked the judge to hold a hearing to determine what instructions were given to law enforcement about not talking to the media.

NEW YORK (AP) — Boston Marathon bombing suspect Dzhokhar Tsarnaev's sister was arrested Wednesday on suspicion she threatened to bomb a woman who previously had a romantic relationship with her boyfriend.

Ailina Tsarnaeva, who lives in North Bergen, New Jersey, made the threat against an upper Manhattan woman via telephone on Monday, police said. She turned herself in at a Manhattan police precinct, and police charged her with aggravated harassment.

Several media outlets reported Tsarnaeva told the Harlem woman she had "people who can go over there and put a bomb on you."

Officers gave Tsarnaeva an appearance ticket and released her pending a Sept. 30 court date.

A telephone number linked to Tsarnaeva was disconnected. Her lawyer, George Gormley, said he had left his office and would speak Thursday.

Tsarnaeva has been required to check in with Massachusetts probation officers since prosecutors said she failed to cooperate with a 2010 counterfeiting investigation.

Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev asked Friday to delay his trial until at least September 2015.

"We recognize that the government and many members of the public, especially in the Boston area, may want the trial to begin quickly," the lawyers said in a court filing, but it is critically important that both sides have time "to uncover and present all relevant evidence."

Tsarnaev has pleaded not guilty in the April 2013 attack that killed 3 people and wounded more than 260. He could face the death penalty.

Tsarnaev's attorneys said his Nov. 3 trial gives them about 1/2 the median preparation time allowed other defendants facing a federal death sentence over the past decade.

The lawyers said they need more time to evaluate the "massive amount" of evidence, which they say prosecutors have been slow and disorganized in producing, and to explore mitigating factors that could lessen his sentence if convicted. The attorneys said at a hearing earlier this month they likely could not be ready for a November trial.

BOSTON (AP) — A push by Boston Marathon bombing suspect Dzhokhar Tsarnaev to move his trial outside Massachusetts has led to a war of words — and paper — between his lawyers and federal prosecutors.

The two sides have filed more than 100 pages of legal briefs vehemently arguing their positions for and against the move. After the defense filed a third brief, including a 40-page affidavit from a second expert, the judge struck it from the court docket, granting a request from prosecutors who said, "Tsarnaev has decided that there should be no limits on his right to litigate it."

The stakes are huge: Tsarnaev could get the death penalty if convicted.

Judge delays Marathon bombing trial, won't move it

BOSTON — A judge granted a two-month trial delay on Wednesday for Boston Marathon bombing suspect Dzhokhar Tsarnaev, but denied a defense request to move his trial from Boston.

Judge George O’Toole ruled that the trial will begin Jan. 5 instead of Nov. 3, but said there’s no reason to assume in advance that a fair jury cannot be selected in Massachusetts.

Defense attorneys had asked that the trial be moved to Washington, D.C., citing extensive media coverage in Boston and evaluations of public sentiment by their experts. They also asked for a trial delay until at least September 2015, saying they have not had time to prepare for a November trial, and had been given less time than was granted in many other federal death penalty cases.

Tsarnaev, 21, has pleaded not guilty to 30 federal charges. He could face the death penalty if convicted.

On Aug. 25, a New York City woman caught up in a messy child custody battle with her ex-boyfriend got into a fight on the phone with her former flame’s new girlfriend. According to the police, heated words were exchanged, and the girlfriend, who also has a child with the man, was subsequently arrested and charged with harassment after she allegedly threatened the other woman’s life.

It was an altercation that likely would have been buried in the reams of other ugly domestic disputes in New York. Except the accused was Ailina Tsarnaeva, the 24-year-old sister of alleged Boston Marathon bombers Tamerlan and Dzhokhar Tsarnaev. And, according to police, she allegedly threatened the other woman by telling her, “I have people. I know people that can put a bomb where you live.”

Tsarnaeva appeared in New York Criminal Court on Tuesday. She entered a not guilty plea to two charges of aggravated harassment, a misdemeanor, for allegedly threatening her boyfriend’s 23-year-old former girlfriend, who has not been named in the dispute. (Tsarnaeva's friends have said the man is her husband, but police have referred to him as her boyfriend.)

Opening arguments began today in the trial of Robel Phillipos, the third friend of Dzhokhar Tsarnaev to be charged with a crime related to the removal of items from Tsarnaev's dorm room after Tsarnaev was identified as a suspect in the Boston Marathon bombings.

He is charged with making false statements to the FBI. His defense: He was "stoned out of his mind."

Friend Azamat Tazhayakov was found guilty of obstruction of justice at a trial in July; Dias Kadyrbayev pleaded guilty to obstruction in August. Neither have been sentenced yet. A fourth friend, Steven Silva, is awaiting trial on gun charges.

(Reuters) - A friend of the Boston Marathon bombing suspect could not have lied to the FBI about visiting his dorm room and removing a backpack because he was too intoxicated by marijuana to remember what he did that day, his attorney said on Monday.

Robel Phillipos, a 21-year-old resident of Cambridge, Massachusetts, is one of three people who prosecutors say went to accused bomber Dzhokhar Tsarnaev's room at the University of Massachusetts at Dartmouth on April 18, 2013, after the FBI released images of the Tsarnaev brothers, and removed a backpack containing empty fireworks shells.

U.S. prosecutors said in their opening statements that Phillipos had repeatedly lied to FBI interviewers about his actions that day. His attorney, Derege Demissie, contended that his client had no memory of his actions that day.

The defence seeks several items from prosecutors, including any evidence linking Tamerlan Tsarnaev to the gruesome slayings in Waltham, where the bodies of three men were found with their throats slit and sprinkled with marijuana. The information was disclosed in the filing by the defence late Friday.

“Simply put, information and evidence tending to show that Tamerlan Tsarnaev participated in a triple homicide in 2011, and information depicting the brutality of those murders, is critical to the defence case in mitigation,” lawyers said in their filing. “Such evidence would tend to corroborate Tamerlan's dominant role in the charged offences and would place the brothers' respective personal characteristics and relative culpability into stark relief.”

Tsarnaev has pleaded not guilty in the 2013 bombings that killed three people and injured about 260 others. Legal experts say his lawyers may try to argue he fell under the murderous influence of his late brother.

The jury has found Robel Phillipos, a friend of Boston Marathon bombing suspect Dzhokhar Tsarnaev, guilty on both counts of lying to investigators.

Phillipos has also been found guilty of impeding a terrorist investigation by making false statements.

The jury deliberated for 34.5 hours before reaching a decision.

With this verdict, Phillipos faces a maximum of 16 years in prison. Sentencing has been set for Jan. 29.

A sister of Boston Marathon bombing suspect Dzhokhar Tsarnaev pleaded guilty Tuesday to misleading a police detective investigating counterfeiting.

Ailina Tsarnaeva entered the plea in South Boston Municipal Court.

The judge placed her conviction on file for 30 days, meaning that she may be sentenced to up to 2 1/2 years in jail if she gets in legal trouble during that period. Her plea also ensures that a conviction will appear on her criminal record and eliminates any appeals.

Prosecutors agreed to the deal because of the age of the case and because she has taken responsibility.

Prosecutors said Tsarnaeva had failed to cooperate in the 2010 counterfeiting investigation. They said she picked up someone who passed a counterfeit bill at a restaurant and "lied about certain salient facts during the investigation."

Her lawyer said she was not trying to protect the identity of the person who used the counterfeit money, but a third party.

Tsarnaeva, of North Bergen, New Jersey, is facing separate charges in New York, where she is accused of threatening to "put a bomb" on a perceived romantic rival.

Tsarnaev lawyers must disclose witness list before trial, judge rules

A federal judge ordered lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev on Wednesday to turn over their witness list by the end of December, resolving one of the last remaining legal disputes before the high-profile trial begins in January.

Lawyers for Tsarnaev had wanted to withhold the list until the end of January, about the time when testimony in the case could begin, contending that it would be tougher to persuade witnesses to cooperate if government prosecutors know who they are.

But US District Court Judge George A. O’Toole Jr. agreed with prosecutors that they should know who the witnesses will be before jury selection begins on Jan. 5.

“I don’t have any doubt of the court’s authority to require disclosure,” O’Toole said, ordering the defense to make their list available by Dec. 29.

Tsarnaev has pleaded not guilty to 30 federal charges in connection with the April 2013 bombings, and faces the possibility of the death penalty if convicted. Three people were killed and more than 260 injured when the two bombs exploded near the Marathon finish line. Tsarnaev’s older brother and alleged accomplice, Tamerlan, was killed days later during a confrontation with police in Watertown.

In addition to setting a schedule for the trial and ordering Tsarnaev to appear at the next proceeding, O’Toole said he will review the defense team’s request that prosecutors turn over more documents related to the case, specifically documents about Tamerlan Tsarnaev’s alleged participation in a triple homicide in Waltham in 2011.
