FAYETTEVILLE, N.C. (WTVD) -- Prosecutors have charged Mario McNeill with new charges in the death of 5-year-old Shaniya Davis.

Fayetteville, N.C. — Prosecutors have filed additional charges against a man accused of buying, raping and killing a 5-year-old Fayetteville girl in November 2009.

Mario Andrette McNeill, 32, has been charged with second-degree exploitation of a minor and third-degree exploitation of a minor. He previously was charged with murder, kidnapping and rape in the death of Shaniya Davis, whose body was found in a kudzu patch near the Lee-Harnett county line on Nov. 16, 2009, six days after her mother, Antoinette Nicole Davis, reported her missing from her Fayetteville home.

His trial on all charges is scheduled to begin April 8. If convicted, he could face the death penalty.

Antoinette Davis is charged with first-degree murder, indecent liberties with a child, felony child abuse, felony sexual servitude, rape of a child, sexual offense of a child by an adult offender, human trafficking and making a false police report. She will be tried separately, and prosecutors aren't seeking the death penalty against her.

Authorities say Davis was complicit in her daughter's death. Arrest warrants stated that she "did knowingly provide Shaniya with the intent that she be held in sexual servitude" and "did permit an act of prostitution with Shaniya."

An autopsy determined that Shaniya died of asphyxiation and that injuries she suffered were consistent with a sexual assault. A medical examiner noted in the autopsy that investigators believe the girl was used to pay off a drug debt.

Shaniya Davis' accused killer claims innocence in letters

Mario Andrette McNeill denies raping and killing 5-year-old Shaniya Davis in handwritten letters sent to The Fayetteville Observer.

McNeill, 32, is scheduled to stand trial April 8 in Cumberland County Superior Court. He faces the death penalty if convicted of the November 2009 killing.

He claims innocence in two letters postmarked Feb. 15 and addressed from the Cumberland County Detention Center. The Observer received the letters Wednesday.

In one, McNeill writes: "I did not take or kidnap Shaniya Davis. I did not purchase, buy, trade, sell or exchange Shaniya Davis. I did not molest, sexually assault, rape or ravish Shaniya Davis. I did not kill, murder, or take Shaniya Davis's life, nor did I have any prior or beforehand knowledge as to what was to and/or did occur."

In the second letter, he disputes two recent charges of sexual exploitation, which he says are related to images found on his cellphone.

McNeill's lawyers could not be reached for comment about his statements.

Reminder that trial was due to have started by now... but it was postponed to 8th April

FAYETTEVILLE (WTVD) -- The trial for the man accused of raping and killing 5-year-old Shaniya Davis has been postponed.

A judge granted Mario McNeil's attorney's request for a continuance until April 8. McNeil was originally scheduled to go on trail Feb. 18 in Cumberland County Superior Court.

The attorney said they need more time to evaluate the evidence and get an expert witness.

12 potenial jurors sent home in Shaniya Davis case Monday

Another juror was selected Monday in the Mario McNeill capital murder trial, bringing the number of seated jurors to 10.

Twelve jurors are needed, plus an additional three or four alternates, before testimony begins.

Jury selection resumes at 9:30 a.m. today in Cumberland County Superior Court.

McNeill, 32, is accused of kidnapping, raping and killing 5-year-old Shaniya Davis in November 2009. He faces the death penalty if convicted.

When the defense excused a white female potential juror Monday afternoon, Judge Jim Ammons expressed concern that the defense had shown a pattern of using peremptory challenges to block whites from serving on the jury.

It is illegal to dismiss a juror based on race.

The seated jury is split down the middle with five blacks and five whites.

Defense lawyer Terry Alford explained their reasoning behind the challenges, and Assistant District Attorney Robby Hicks told Ammons those reasons were sufficient.

"I want to make sure it's done properly," Ammons said.

On Monday, 19 potential jurors were excused.

One potential juror became emotional as the defense questioned her, remarking "that she (Shaniya) was so young." Another said he took medication that affects his concentration.

The trial, which began April 8 with jury selection, is expected to run about seven more weeks.

McNeill faces seven charges, including first-degree murder and first-degree rape of a child. Authorities say Shaniya's mother handed over her child to McNeill to settle a drug debt, then falsely reported her child missing.

McNeill is accused of taking the girl to a Sanford hotel and assaulting her before dumping her body off N.C. 87 in Harnett County.

The mother, Antoniette Nicole Davis, 28, faces similar charges and is awaiting trial.

Opening statements in Mario McNeill's capital murder trial are delayed until at least Friday so he can be evaluated by medical professionals.

McNeill, who is accused of raping and murdering 5-year-old Shaniya Davis in 2009, will be evaluated on his capacity to proceed with the trial. The decision was made Monday morning during a short hearing by Cumberland County Senior Resident Superior Court Judge Jim Ammons.

Responding to a defense motion on the matter, Ammons mentioned doctors from two out-of-town facilities who may evaluate McNeill - Central Regional Hospital, a psychiatric hospital in Butner, and Cherry Hospital, a psychiatric hospital operated by the state Department of Health and Human Services in Goldsboro.

In Monday's hearing, the judge referred to an evaluation of McNeill that was done earlier, apparently at the request of his defense lawyers. Neither the defense nor the judge said what prompted that evaluation.

According to the courtroom clerk, the defense motion and the judge's order "are sealed per order of the court."

A decision this week to stop the murder trial of Mario McNeill so he could be evaluated by medical professionals was unusual because of its timing, some legal experts say.

Questions about a defendant's competency to proceed are usually raised before a trial begins, said retired Cumberland County Superior Court Judge E. Lynn Johnson.

Superior Court Judge Jim Ammons delayed proceedings in McNeill's capital murder trial on Monday. A jury has been picked, and opening statements were expected that afternoon.

McNeill, 32, is accused of raping and killing 5-year-old Shaniya Davis in November 2009.

"You would have thought these issues would have come up at an earlier state. If it were observed by family members, the lawyer staff, jailers. There could be a host of things," Johnson said. "Was he on medication and has come off medication? Did incarceration lead to it?"

Carl Ivarsson, a longtime Fayetteville lawyer, agreed, calling it "fairly unusual" for questions about a defendant's competency to arise once a trial is under way.

"Usually, that issue is resolved much earlier. Competency doesn't come up often, but it's important," Ivarsson said. "The defendant has got to know the nature of the proceedings against him."

A motions hearing in the case has been recessed until 9:30 a.m. Friday at the earliest.

He claims innocence so not sure I understood if he is saying the picture of Shaniya being carried by a man is not him or what. This case is so heartbreaking.

I missed the trial actually starting... just catching up myself.

This was a case I saw unfold when it happened... so started posting about it back then at JQ. Having commited to a case I do retain an interest in "seeing it through"

Fayetteville, N.C. — A Superior Court judge ruled Friday that the man accused of raping and killing a 5-year-old Fayetteville girl is competent to stand trial, despite some psychologists saying he has been delusional in recent days.

Mario Andrette McNeill, 32, is charged with murder, rape and kidnapping in the November 2009 death of Shaniya Davis. He could face the death penalty if convicted of murder.

His capital murder trial was supposed to have begun Monday, but Judge Jim Ammons delayed it for a week after defense attorneys expressed concerns about his competency. Ammons ordered state psychiatrists to evaluate him in recent days.

Prosecution touts '21st century case' at Mario McNeill's murder trial

The district attorney prosecuting Mario McNeill in the rape and death of 5-year-old Shaniya Davis in 2009 says the state has a "21st-century case," and the evidence will prove it.

Cumberland County District Attorney Billy West told jurors Monday that evidence will be presented that would not have been available to the prosecution 15 to 20 years ago.

And the evidence, he said, will point to McNeill as the child's killer.

McNeill, 32, is charged with first-degree murder and first-degree rape of a child. If convicted of first-degree murder, he could be sentenced to death.

Defense lawyer Terry Alford told jurors that McNeill is innocent.

But West said his state-of-the-art case includes DNA evidence, FBI cellphone analysis and soil samples that implicate the defendant.

A second day of testimony begins this morning in the Mario McNeill capital murder trial in Cumberland County Superior Court.

The state called four witnesses to the stand Monday.

McNeill, 32, is accused of raping and killing 5-year-old Shaniya Davis in November 2009. He could be sentenced to death if convicted of the first-degree murder of the child.

Brenda Davis, the sister of Shaniya's mother, testified Monday that McNeill was in her mobile home at 1116A Sleepy Hollow Drive on the morning that Shaniya went missing.

Authorities say the girl's mother, Antoniette Davis, gave her to McNeill to settle a drug debt, then falsely reported her missing. McNeill is accused of taking the girl to a Sanford hotel and assaulting her, then dumping her body off N.C. 87 in Harnett County.

Davis, 28, faces similar charges.

On the morning of Nov. 9, 2009, Brenda Davis has testified she awoke at 5:30 a.m. when someone opened a faulty door outside her bedroom in the Sleepy Hollow Mobile Home Park. She said McNeill had pried open the door before, using a small knife.

Brenda Davis lived at the residence with her two children and the children's father along with Antoniette Davis and her two children, Shaniya and Carleseo.

Carleseo told Brenda Davis that "Mano" had been there that night, she testified. Mano is a nickname for McNeill.

Brenda Davis said that on Nov. 10, Antoniette Davis screamed at McNeill after he arrived at her aunt's house on Mary Street. He was in a black car that Brenda Davis said she had never seen him drive.

"I don't have (expletive) to say to you," Brenda Davis quoted her sister. "I just want to know where my (expletive) baby is."

The jury heard testimony from Jeroy Smith, the father of Brenda Davis' children; Ylanda Thomas, one of Brenda Davis' friends; and Fayetteville Police Officer William Bell, who was tasked with taking the initial missing child report on the child.

Mario McNeill is escorted back to his seat after a lunch break in his murder trial Wednesday.

Carl Davis, the brother of the slain Shaniya Davis, seemed to sink lower on the witness stand as lawyers attempted to gain a foothold in the 11-year-old's changing testimony Wednesday morning.

Carl switched his story after first saying he didn't recognize the intruder who entered the family trailer in the Sleepy Hollow Mobile Home Park in the predawn hours of Nov. 10, 2009. He told Assistant District Attorney Rita Cox that it was "Mario" - defendant Mario McNeill, who is on trial for the rape and murder of his 5-year-old sister, Shaniya.

But under cross-examination, the youth answered "Yes," when defense lawyer Terry Alford asked if he remembered telling investigators that he didn't know who had entered the mobile home.

"You don't really know who came in, do you?" Alford questioned the boy in a soft tone.

"No, sir," he answered with his head lowered.

Alford repeated the question: "You don't know who came in there do you?"

"No, sir."

The trial in Cumberland County Superior Court is scheduled to resume this morning at 9:30.

The prosecution anticipates presenting its case at least through the end of the week.

McNeil doesn't deny taking Shaniya Davis

FAYETTEVILLE (WTVD) -- Thursday, the jury deciding Mario McNeill's guilt or innocence watched surveillance video from a hotel where prosecutors say he took 5-year-old Shaniya Davis to rape her before killing her.

McNeil's defense does not dispute that he took the girl to the Comfort Suites hotel in Sanford on the night of November 10, 2009. But, McNeil claims he took her there at the request of family members and doesn't know what happened from there.

On the witness stand Thursday, hotel worker Jacqueline Lee told the jury she checked McNeill in around 6:11 a.m.

She said he told her he was with his daughter and wouldn't be at hotel for long because he was just stopping to rest on their way to Virginia to see the girl's mom. Said she saw the little girl wrapped in a blue blanket via the hotel's surveillance camera system and noticed her "kinky hair."

McNeill came down shortly after check-in to the breakfast bar where Lee said he got a banana, a muffin and some juice.

"He paused and stopped and looked at the [surveillance] cameras," Lee testified.

Lee got off at 7 a.m. She said the next morning, the breakfast attendant asked her if she had heard about an Amber Alert. Lee said "no" then headed to the check-in computer and saw Shaniya's picture.

She then called authorities, and told them the story.

A chance encounter on a business trip to Sanford led Seth Chambers to a face-to-face encounter with Mario McNeill and Shaniya Davis, the 5-year-old girl McNeill is accused of raping and murdering in November 2009.

Their paths crossed a mere two seconds or so, but Chambers, a general contractor from the town of Clyde, would be one of the last people to see the child alive.

Chambers testified Thursday afternoon in the McNeill capital murder trial in Cumberland County Superior Court. Most of the proceedings consisted of the jury watching surveillance video and still photography taken from the Sleepy Hollow Mobile Home Park off Murchison Road and the Comfort Suites hotel on Bragg Street in Sanford.

After leaving the hotel with the child, McNeill allegedly left a clear packet with white residue in Room 201 - the room that he appears to have shared with Shaniya. That's according to a front desk clerk who was working at the hotel Nov. 10, 2009, the day Shaniya went missing. Regina Marie Bacani told jurors that she thought the packet that she got from a housekeeper had contained cocaine or crack cocaine.

McNeill's defense admits their client picked up Shaniya from her aunt's trailer where she was living at 1116A Sleepy Hollow Drive in Fayetteville and transported her to the Comfort Suites in the early hours of Nov. 10. But his lawyers maintain that he did not harm or kill the child.

Jurors hearing forensic evidence today in Mario McNeill trial

A maintenance worker testified today that he saw Mario McNeill carry a child over his shoulder out of the Comfort Suites in Sanford on the morning of Nov. 10, 2009, and place her in a car.

Matthew Argyle, who testified in McNeill's capital murder trial in Cumberland County Superior Court, said he thought the child was asleep. He said the child appeared to be about 6 years old and female.

Argyle, who was picking up trash in the hotel's parking lot at the time, said the scene bothered him.

"I just had a feeling something was amiss, something wasn't right," he said.

Argyle said the child's legs moved as McNeill carried her but he saw no independent movement.

"I did not see any movement from the child," he said.

Much of today's other testimony has come from forensic technicians. William Hinton, a forensic multimedia examiner, said he looked at audio and video tapes of investigators' interview with McNeill and found no signs that they'd been tinkered with.

This morning, Trudy Wood, who works for the Fayetteville Police Department, testified she found stains on a child's pair of jeans in Mario McNeill's car.

Wood said she processed a jacket, belt and jeans belonging to Shaniya Davis that were found in the back of McNeill's 1997 Mitsubishi Galant.

Wood said she found light-colored stains on the jeans but did not say what they were.

A veteran FBI agent said accused rapist and murderer Mario McNeill surprised him when McNeill spoke of killing 5-year-old Shaniya Davis during a November 2009 interview with investigators

"After he talked about dropping her off," the FBI agent said during McNeill's capital murder trial this morning, "he suddenly stated that he was waiting to get a call to come to kill her. The interviewers, everybody kind of stopped. 'What did you say?' He actually said he was waiting to come to kill her. When we tried to get him to expand on that, we couldn't."

Authorities say McNeill assaulted Shaniya in a Sanford hotel room before strangling her and hiding her body not far from the Carolina Trace community on N.C. 87.

The case has entered its fifth week.

The five-hour or so taped interview with McNeill began about 9:30 or 10 p.m. on Nov. 12, before the agent was asked to assist in the interrogation about 1 p.m. on Nov. 13.
