FAYETTEVILLE, N.C. (WTVD) -- Jurors in the Mario McNeill trial looked visibly uncomfortable Tuesday as they were shown video of crime scene investigators recovering the body of 5-year-old Shaniya Davis.

State Bureau of Investigation agent Chad Royal testified he arrived at the scene at 2:50 p.m. on November 16, 2009 and the body wasn't removed until nearly 8:30. Royal said it took a lot of manpower to work at the scene because of thick vegetation and muddy ground.

Prosecutors allege McNeill took the Fayetteville child from her home in the early morning hours of November 10 to rape her at a motel in Sanford before killing her and dumping her body just off N.C. Highway 87 near the Lee-Harnett County line. Searchers finally located the child's remains after getting a tip on where to look from McNeill's former attorneys.

The area where the body was found is known to be a place where deer hunters dump animal remains, and Agent Royal testified Tuesday that Shaniya's body was partially under a log, near bags of deer carcasses and a river, with part of her feet submerged in the water.

"It took several people to remove the log," said Royal.

Fayetteville, N.C. — A 5-year-old Fayetteville girl was sexually assaulted before she was killed more than three years ago, a medical examiner testified Wednesday.

Shaniya Davis was found on Nov. 16, 2009, in a kudzu patch off N.C. Highway 87 on the Lee-Harnett county line, six days after her mother reported her missing from their Fayetteville mobile home.

Mario Andrette McNeill, 32, is charged with murder, kidnapping and rape in Shaniya's death. He could face the death penalty if convicted of murder.

Dr. Thomas Clark, the former deputy chief medical examiner for North Carolina, said the girl's body was partially decomposed and could have been in the overgrown area for days before it was found. She was wearing a only sweatshirt and striped underpants and was covered in leaves, twigs and vines, he said.

Clark said she had abrasions around her vagina that were "consistent with a sexual assault" that occurred shortly before she died. He also noted a bruise on her cheek that could have been left by a hand as she was suffocated.

Judge denies defense attorney's request for mistrial in Mario McNeill trial

A defense lawyer for accused rapist and murderer Mario McNeill asked for a mistrial before the Cumberland County Superior Court case recessed for lunch.

"My motion at this time is for a mistrial," lawyer Terry Alford said in an outburst that was not heard by the jury.

The request, which was later denied by Judge Jim Ammons, came after the state called Fayetteville Police Detective Chad Smith to testify. Smith is one of the department's two cybercrime detectives.

Assistant district attorney Rita Cox asked the witness what type of computer crimes he had investigated.

Alford then asked Ammons that he wanted to be heard, with the jury out of the courtroom.

Once jurors had departed, Ammons asked Cox, "Did you step on that mine?"

Before Smith was sworn in, Alford expressed concern over his testimony that could sway jurors into the area of McNeill's alleged child pornography crimes. The defendant has been charged with second- and third-degree sexual exploitation, but those charges are not being tried in current litigation.

North Carolina's former deputy chief medical examiner testified Wednesday that 5-year-old Shaniya Davis likely died from asphyxiation after someone held a hand over her nose and mouth, cutting off her air supply.

During the sometimes unsettling, clinical testimony from Dr. Thomas Clark, prosecutor Robby Hicks asked how long it would take the child to die from asphyxiation.

"It could take a few minutes," he said.

Clark was one of four witnesses called by the state to testify Wednesday in the capital murder trial of Mario McNeill in Cumberland County Superior Court.

McNeill, 33, is being tried on seven charges, including first-degree murder and rape. Conviction could result in the death sentence.

Shaniya's mother, Antoniette Nicole Davis, 28, is accused of giving her daughter to McNeill to settle a drug debt before reporting the child missing Nov. 10. Davis will be tried on similar charges, but she is not facing the possibility of execution.

Clark, who retired as the state's deputy chief medical examiner in 2010, testified about the condition of Shaniya's body, which was found Nov. 16, 2009, off Walker Road in Lee County. That was six days after she had been reported missing by her mother.

SBI agent describes tests for semen in Shaniya Davis murder case

A State Bureau of Investigation agent testified this morning he was not able to determine whether semen was present on the body or clothing of 5-year-old Shaniya Davis.

Also, tests failed to find DNA from Shaniya or the man accused of killing her, Mario McNeill, on blankets taken from a Sanford hotel where McNeill took her, testified Jody West of the SBI's crime lab.

Shaniya's DNA was found in a mixture of DNA from a rear seat fabric in McNeill's car, West testified.

The state has called West as an expert in forensic serology and DNA analysis.

The proceedings, in Cumberland County Superior Court, are scheduled to conclude for the week at 1 p.m.

McNeill is accused of raping and killing Shaniya and dumping her body in woods off N.C. 87 in Lee County.

Cumberland County District Attorney Billy West said the prosecution now expects to continue presenting evidence through at least Tuesday and perhaps into Wednesday.

The trial enters its sixth week Monday.

Scant evidence found to link suspect to Fayetteville girl's death

Fayetteville, N.C. — Forensic technicians said Thursday that they found little physical evidence linking a Fayetteville man to the 5-year-old girl he's accused of raping and killing more than three years ago.

Mario Andrette McNeill, 32, is charged with murder, kidnapping and rape in the death of Shaniya Davis. He could face the death penalty if convicted of murder.

Shaniya was found on Nov. 16, 2009, in a kudzu patch off N.C. Highway 87 on the Lee-Harnett county line, six days after her mother reported her missing from their Fayetteville mobile home.

Prosecutors told jurors at the start of the trial last week that a hair was found in a Sanford hotel room to show McNeill was there with Shaniya shortly after she disappeared.

On Thursday, however, three State Bureau of Investigation agents testified about what they didn't find as they combed over the evidence.

DNA analyst Jody West said he found no evidence of any semen on swabs taken from Shaniya's body and clothing.

A medical examiner testifying Wednesday that abrasions around the girl's vagina were "consistent with a sexual assault" that occurred shortly before she died.

Fayetteville, N.C. — Prosecution witnesses tried to explain Monday why they didn't find a Fayetteville man's DNA on the 5-year-old girl he's accused of raping and killing more than three years ago.

A State Bureau of Investigation analyst testified Friday that she found no evidence of semen on Shaniya's body or clothing, although a medical examiner said that she had injuries "consistent with a sexual assault."

On Monday, another SBI analyst said she found no male DNA on Shaniya but said that was "not unexpected."

"The longer the time goes on between the incident and testing, the DNA starts to degrade," analyst Kristin Hughes testified. "Seventy-two hours is usually the opportune time for us to collect DNA evidence."

An autopsy determined that Shaniya had been suffocated, but it's unclear how long her body was in the woods before it was discovered.

Fayetteville, N.C. — State analysts said Tuesday that soil found in a Fayetteville man's car likely came from a rural location where the body of a 5-year-old girl was found more than three years ago.

Shaniya was found on Nov. 16, 2009, in a kudzu patch off N.C. Highway 87 on the Lee-Harnett county line, six days after her mother reported her missing from their Fayetteville mobile home.

Heather Hanna, a geologist with the North Carolina Geological Survey, testified that she compared a sample of soil that investigators collected from the gas pedal of McNeill's car with samples from the kudzu patch and found metallic fibers in both.

Roberto Garcia, a materials engineer at North Carolina State University, said the fibers appear to have come from a braided metal wire, such as a truck winch.

Defense attorney attacks credibility of soil sample expert at Mario McNeill trial

A materials engineer testified this afternoon that the soil found in the gas pedal of Mario McNeill's car is a likely match to soil found near the body of 5-year-old Shaniya Davis.

Roberto Garcia, the lab manager at the Analytical Instrumentation Facility at N.C. State University, said he examined three soil samples with an electron microscope and found similar metals in the sample from the gas pedal and from an area beside Walker Road in Lee County, near where the girl's body was found.

"I would think it's highly unlikely they're not from the same source," Garcia said.

McNeill, who is being tried in Cumberland County Superior Court, is accused of raping and killing Shaniya and dumping her body in woods off N.C. 87 in Lee County in November 2009. He could face death if convicted of first-degree murder.

Mario McNeill tells judge he's OK with entire police interview being shown to jury

Mario McNeill told a judge late Tuesday that he wants all or none of a taped November 2009 interview with investigators shown to the jury in his capital murder trial.

The state had planned to screen an edited, redacted version of the five-hour tape during today's proceedings. The tape was recorded Nov. 12 and 13, 2009. District Attorney Billy West told Cumberland County Superior Court Judge Jim Ammons that the prosecution would devote today's trial to the defendant's interview with law enforcement officers.

Portions of the tape that were being redacted - including those that Ammons had ordered removed - involved McNeill's criminal past. He talks about his drug charges and dreaming of shooting two people before he served time for actually shooting three people. There's also a sequence that involves the discussion of a polygraph test, Ammons said.

Polygraphs are not admissible in North Carolina courts.

Man Accused Of Murdering Shaniya Davis Demands Jurors Watch Entire Police Tape

Fayetteville, NC -- The man accused in the kidnapping, rape and murder of a 5-year-old Fayetteville girl has gone against the advice of his attorneys and allowed jurors to see the entire videotape of his police interview.

Prosecutors had wanted to play the most relevant clips, but Mario McNeill demanded jurors see the entire tape. McNeill's lawyer didn't want the tape shown, saying the defense and its client were at odds over the issue.

In the interview, McNeill initially denies knowing Shaniya Davis, the girl he is charged with raping and killing. He said he knew the family, but didn't know that Antoinette Davis had a daughter.

The 32-year-old McNeill could be sentenced to death if convicted. Antoinette Davis is accused of giving her daughter to McNeill to settle a drug debt.

Fayetteville, N.C. — The fate of Mario Andrette McNeill, who is accused of raping and killing 5-year-old Shaniya Davis in 2009, is in the hands of a jury following closing arguments Wednesday morning.

If the eight-man, four-woman jury finds him guilty, they would hear evidence before deciding whether to sentence him to life in prison without parole or death.

During closing arguments Wednesday, defense attorney Butch Pope said the state failed to make its case against McNeill and could not prove where the child was assaulted or when she died.

Fayetteville man guilty of killing Shaniya Davis, not of raping her

Fayetteville, N.C. — A jury on Thursday convicted a Fayetteville man of kidnapping and killing a 5-year-old girl more than three years ago, but he was acquitted of raping her.

The eight-man, four-woman jury deliberated for about 7½ hours over two days before finding Mario Andrette McNeill, 33, guilty of first-degree murder, first-degree kidnapping, sexual offense of a child, indecent liberties with a child, human trafficking and sexual servitude in the death of Shaniya Davis.

McNeill showed no emotion as the verdicts were read in the quiet courtroom.

Shaniya's father, Bradley Lockhart, said sitting through the trial has been difficult – and it's not over.

"I've had to relive this whole thing again, and we've still got several more months of court proceedings to relive this," Lockhart said. "Then, I've got the rest of my life to kind of always look back on it. So, it's something that we'll never get over. It's something we've got to learn to deal with."

McNeill's family has declined to speak with the media during the trial.

Jurors will return next Tuesday to hear evidence before deciding whether McNeill should be sentenced to death or life in prison without parole.

McNeill won’t defend against death penalty for Shaniya Davis’ murder



FAYETTEVILLE, N.C.– Going against the advice of his legal team Tuesday, Mario McNeill will not present any evidence or call witnesses in the penalty phase of his trial, according to WTVD.

The jury in his case found the 33-year-old guilty last week of first-degree murder in the death of 5-year-old Shaniya Davis.

The jury will now be asked to decide if McNeill should get the death penalty or be sentenced to life in prison.

The jury will begin deliberations Wednesday after the state does closings arguments. There will be no closing from the state per McNeill's request.

Prosecutors have also charged Shaniya's mother, Antoinette Davis, with selling her daughter to McNeill to pay a drug debt. Davis hasn't been tried yet.

Mario McNeill was sentenced to death today for the murder of 5-year-old Shaniya Davis in November 2009.

McNeill, 33, declined the opportunity to speak before being sentenced by Senior Resident Superior Court Judge Jim Ammons.

Jurors deliberated a little more than a half-hour before reaching a decision.

"I can never get Shaniya back. You've taken that from me,'' said Bradley Lockhart, Shaniya's father. "You were the last thing my daughter got to look at.''

Ammons addressed McNeill before McNeill was escorted from the courtroom.

"You did not have to kill that child,'' Ammons said.

"Take him out of here now,'' Ammons told the bailiffs.

Ammons later apologized to Shaniya's family for not being able to bring them justice. He said the trial was the best that could be done.

Man convicted of killing Shaniya Davis kept separate from other inmates

The man convicted of murdering 5-year-old Shaniya Davis is largely being confined to his death row cell at Central Prison for security reasons.

Mario Andrette McNeill, who was sentenced to death in May for killing Shaniya in November 2009, will remain on intensive control status on death row indefinitely, said Keith Acree, a spokesman for the state Department of Public Safety.

"I don't know when it will end," he said Wednesday. "He has regular control reviews. He's evaluated periodically."

According to the state Department of Correction Division of Prisons, intensive control status is a long-term removal from other inmates for repeatedly disruptive behavior, noncompliance with instructions and orders, or a transition following assignment to maximum control status.

In June, McNeill was reassigned from maximum to intensive control status at the prison, Acree said.

"He's confined to his cell 23 hours a day. He comes out for a shower and brief recreation period," Acree said. "It's very limited contact with other (death-row) inmates, and he probably has reduced privileges."

McNeill, 33, was involved in an assault in January 2011 during a safe-keeping period at Central Prison before his trial in Cumberland County, Acree said, and there has been at least one other infraction since.

But those infractions, he said, are not the reason he is being held in confinement.

"It was a management decision based on security concerns," he said. "These concerns have existed ever since he has been there."

On May 29, a 12-member jury took 39 minutes to recommend that McNeill be sentenced to death. The same jury convicted him of kidnapping, sexually abusing and murdering Shaniya, whose body was found in woods off N.C. 87.
