Ocala prosecutor Brad King to stay on Markeith Loyd case

Ocala-based State Attorney Brad King will remain the prosecutor for accused murderer Markeith Loyd while Orange-Osceola State Attorney Aramis Ayala, who was removed from the case after deciding not to seek the death penalty, appeals her removal in civil court. Ninth Circuit Chief Judge Frederick Lauten made the ruling at a hearing Tuesday morning.

Gov. Rick Scott asked Ayala to recuse herself from the case, and when she declined to do so, he issued an executive order appointing King.

On Tuesday, Loyd said he wanted Ayala to stay on the case.

Ayala said she still plans to appeal the governor’s order, and asked Lauten to halt proceedings for two weeks while she prepares an appeal. She appeared in court with Roy Austin, a former federal prosecutor and deputy assistant to the president for the Office of Urban Affairs, Justice and Opportunity under former President Barack Obama's administration.

Loyd’s family sat on the other side of the courtroom, wearing T-shirts with photos of Loyd on the front with the words “My security, my son." The backs of the shirts had a photo of a bandaged-up Loyd after his arrest, with the phrase “Stoppolicebrutality.”

Loyd, who was kicked in the head by law enforcement when he was arrested outside a vacant Carver Shores home in January, has in past court hearings complained of headaches and damage to his eye.

Lauten on Tuesday ordered that a doctor evaluate Loyd to see whether his injuries make him incompetent to stand trial or to decide whether he wants to represent himself. Loyd told the judge he will not cooperate with the doctor.

“I can't force you to speak to him, but I will ask you to speak to him,” Lauten said. The doctor will also be able to review some of Loyd’s medical records, Lauten said.

Markeith Loyd: Now I want a lawyer, but it must be my pick

Accused cop killer Markeith Loyd on today reversed course and told a judge that he now wants a lawyer, but only a specific one from Miami.

For weeks, Loyd had insisted that he wanted to represent himself. He did not want a lawyer, not even a stand-by attorney, someone who would answer his questions and help prepare his case.

Today, however, he asked Chief Judge Frederick Lauten to appoint Terry Lenamon, a Miami criminal defense attorney.

“He can do whatever he wants,” Loyd

If Lauten says yes — something he said he was inclined to do — he would be bending two local rules.

Typically indigent defendants can’t hand pick their attorneys. They get the one appointed by the court. Usually it’s an assistant public defender. In this case, however, the public defender has a conflict of interest. So does the “conflict counsel,” the public law firm that handles criminal cases when the public defender’s office has a conflict of interest.

The second rule Lauten may bend for Loyd is one that requires Orange and Osceola county judges to appoint attorneys who live in those two counties.

Lenamon does not.

Last week, despite Loyd’s objections, Lauten appointed Orlando attorney Roger Weeden as stand-by counsel.

Today Weeden encouraged the judge to appoint Lenamon, someone Loyd’s family has talked to. Weeden said he would work with Lenamon on the case.

Lauten made no final decision on Lenamon and set another hearing for April 12, saying he wants the South Florida attorney, as well as other attorneys in the case, to return to talk about scheduling, an exchange of evidence and other matters.

This is the judge's ruling on Loyd's motion to appoint a high profile attorney from Dade County (Terence Lenamon) to represent him, and the state pay for it. Judge denies motion, citing that Lenamon is not on the list of attorneys in Orange Co. There are two stand-by attorneys in the courtroom willing to represent Loyd .. Wheeden and a female atty.

The judge finally appoints Wheeden as counsel after Loyd agrees. BUT he agrees only after Wheeden mentions that he may get Lenamon on the case as co-chair defense. :doh

At 13:10m Lloyd interrupts and addresses the Judge about another motion he has filed, then he says "I'm done" and attempts to walk out of the courtroom. :eek

This is an hour long hearing, but the issues that they discuss are interesting. Newly appointed attorneys now have trial date conflicts, motions are tossed in the air to land on a certain day. :roll

This judge is one of the most lenient and accommodating judges I have ever seen. This is going to be a trial to watch.

Another hearing is set for next Monday.

Markeith Loyd emails to police chief confirm blindness in one eye

An email sent to Orlando police Chief John Mina by one of his lieutenants confirms that accused cop killer Markeith Loyd is blind in one eye because of the force used by officers who arrested him.

At 5 a.m. Jan. 18, Lt. Dan Brady sent Mina an update on Loyd’s condition at the hospital.

“[Orlando Regional Medical Center] needed to perform surgery on his left eye and as a result the doctor said he will be permanently blind in his left eye,” Brady wrote. “This was as a result of the injuries Loyd received during his response to resistance.”

Police released a tape of Loyd’s Jan. 17 arrest that showed one of the officers kicking Loyd in the head after he crawled out of the home in which he was hiding, saying that they used force because he resisted. The email confirms what Loyd has said in court about the extent of the injury to his eye.

Minutes after shooting his pregnant ex-girlfriend, Markeith Loyd sent her a text message saying he hoped she died, court records released Monday show.

“Don’t know if you go make it hope you don’t,” he texted Sade Dixon about 20 minutes after the fatal shooting. Hours later he texted, “you caused this” and blamed her brother — who also was shot — for intervening.

Investigators found a 10-page letter in the house where Loyd was hiding after, they say, he shot and killed Orlando Police Lt. Debra Clayton. It was signed by Loyd and gave a detailed account of why he shot Dixon and said killing their unborn child was an “unintended consequence,” according to a summary of the letter.

The text messages and account of the letter were part of hundreds of pages of evidence filed by the Orange-Osceola State Attorney’s Office in the case against Loyd in the slayings of Dixon and Clayton.

Loyd wrote he was upset she was smoking while pregnant, while she accused him of cheating on her.

He told her that he wanted to talk with her about the situation.

“All you had to do was answer my calls but you was doing you,” he texted.

About 20 minutes later, Loyd showed up at her house on Long Peak Drive, shot her to death and critically wounded her brother, Ronald Stewart, prosecutors allege. He also shot at her mother and another brother, according to court documents, but they were not injured.

Not one bit of news on Loyd for months, only ...

He received two red-light tickets while sitting in jail. (an error)

Two white cops stopped Aramis Ayala on a traffic matter. (millions of articles on this)

Aramis Ayala is the black State Attorney who announced she would not be seeking the death penalty for Loyd, then Gov. Scott gave 23 of her homicide cases to another state attorney, one being Loyd's.

She is suing Gov. Scott.

I did read in one of the most recent articles about the lawsuit that Loyd is suspected of SIX other murders. :eek

When Markeith Loyd is in court, a heavy security presence follows. Those in the courtroom brace for what the garrulous murder suspect will say. At past hearings, he has been profane, demanding and uncooperative.

Not Tuesday. Loyd displayed a new kind of defiance by refusing to attend his court hearing.

Chief Judge Frederick Lauten told attorneys that he could order Loyd to be forcibly removed from his jail cell and brought to the courtroom if they wanted.

Markeith Loyd to judge: 'I don't wanna talk to you'.

Loyd’s lawyer, Roger Weeden, opted to proceed without his client since they were discussing administrative issues. He told the judge Loyd communicates with him during jail visits.

Loyd is slated to stand trial for Dixon’s death in September 2018. On Tuesday, the judge scheduled the trial in Clayton’s killing for Jan. 14, 2019. Loyd faces the death penalty.
