I can't find anything either. Chris asked what his sentence was in the murder verdict and I couldn't remember :roll so looked it up. While I was at it, I searched everywhere (Friday) for an update on this case. Can't even find a court or case number to call the clerk. Because this one is in juvenile court.

Lawyers seek to resolve Chism's other case
Teen, convicted of murder, still faces charge for attack on female DYS worker

BOSTON — Prosecutors and the attorneys for convicted teen killer Philip Chism will meet in private with a Suffolk Juvenile Court judge to discuss a possible plea in his still-pending attempted murder case.

Chism, 17, is now serving a 40-years-to-life term in prison for the October 2013 rape and murder of Danvers High School teacher Colleen Ritzer of Andover.

While awaiting trial in that case at a Department of Youth Services facility in Dorchester in June 2014, Chism allegedly crouched out of view of staff, then crept along a wall, following a female employee into a locker and restroom, where prosecutors say he punched, strangled and stabbed her with a pencil.

The attack, which an Essex County prosecutor called "chillingly similar" to the Danvers murder, was thwarted when other employees heard the woman's screams.

During a status hearing in that case Wednesday in Suffolk Juvenile Court, prosecutor Mark Zanini told Judge Terry Craven that the two sides want the judge to conduct a "lobby conference."

Such meetings, which usually take place in a judge's office (or "lobby"), are where lawyers and a judge can attempt to hammer out a resolution of a case short of trial.

The lawyers are expected to meet with Craven next month.

Defense lawyers Denise Regan and John Osler also filed another motion, however, for funds to prepare their defense of Chism should the case go to trial.

Chism did not appear at Wednesday's hearing.

The case is scheduled to be back in a public session on Sept. 16.

I sorta hope, Chism will plea guilty and the attorneys can figure out a deal to add a few more years to his current sentence. Probably won't happen but that's my 2-cents. It's in juvenile court (which I'm not familiar with at all) and IMO the state should save some money and settle for something. :40

Out of four articles I found that the state Supreme Judicial Court ruled (yesterday) that Chism's 2013 videotape of police interrogating him can be unsealed, I found this in one of them.

He’s serving at least 40 years in prison and is scheduled to appear next week in Suffolk Juvenile Court on accusations that he attacked a state Department of Youth Services worker in June 2014.

I have Chism down for a hearing last Monday. :40
No idea where that came from. Nothing new on him in news.

I googled his attorney Denise Regan. No recent news.

The other attorney, Susan Oker, is now a judge
in a juvenille court so she won't be on the case.


And I have emailed the reporter who does the articles for The Salem News, asking if there are any updates since Chism was moved to an adult facility. @SNJulieManganis

Defense in 2nd Chism case wants competency evaluation

BOSTON — Philip Chism, the Danvers man now serving 40 years to life for the rape and murder of teacher Colleen Ritzer, will try again to mount an insanity defense when he stands trial in an attack on a Department of Youth Services worker three years ago.

Attorneys for Chism, who turned 18 in January, asked a Suffolk Juvenile Court judge on Monday to have him undergo a new competency evaluation.

Lawyer Denise Regan also told the judge that she anticipates filing a notice of a mental health defense by July 24 in the case.

Monday's hearing before Judge Terry Craven came following a series of lobby conferences in the case — informal, closed proceedings during which the potential for resolving the case without a trial are typically discussed.

It appears now, however, that the case is headed to trial, with Craven granting requests to set dates for pretrial motions.

Chism, who is being held at the maximum-security Souza Baranowski Correctional Center in Shirley, did not appear in court for the brief hearing.

The competency evaluation, which will be conducted by a Juvenile Court clinician, will take up to 12 weeks to complete. Craven noted it could take longer than usual because the person conducting the evaluation will have to travel to the prison.

Regan also asked to be present during the evaluation.

Chism continues to dodge the courtroom like he did in his first trial. The excuse of "added security needed" is ridiculous. Take his ass to court for every hearing. :roll

Chism excused from attending pre-trial proceedings in jail assault case

DANVERS — Philip Chism, the former Danvers teen convicted of raping and killing his math teacher, won't have to attend pre-trial hearings in a pending attempted murder case.

On Wednesday, John Osler, one of Chism's attorneys, asked Craven to excuse his client from attending an upcoming hearing on a motion by the defense to dismiss the case.

At that hearing, Chism's attorneys plan to argue that the Suffolk County grand jury that indicted Chism as a "youthful offender" three years ago heard insufficient evidence to support the charges.

Defendants are typically expected to be present for substantive hearings in pending criminal cases.

But Chism's case poses special circumstances. He is a high-profile inmate who is currently being housed at the Souza Baranowski Correctional Facility in Shirley, a maximum-security prison. Bringing him to the Juvenile Court creates a need for extra security.

Prosecutors in the Suffolk District Attorney's office say they believe Chism not only has a right to be present, but that if he chooses to waive that right, he'll have to first be questioned by the judge to ensure he understands what he is doing.

Such questioning also took place during Chism's murder trial in Salem Superior Court, on a day when Chism wanted to return to his cell.

While prosecutor David Bradley acknowledged that the law is not clear on the issue, he requested the questioning "out of an abundance of caution."

Motions to dismiss, he argued, are a critical proceeding in a case, regardless of whether witnesses are called or, as in the pending motion, they are based on legal arguments.

Bradley expressed concern that Chism's absence from any significant part of his case could be grounds for a future appeal.

Osler, meanwhile, suggested that a written affidavit would be adequate for Chism to waive his presence.

Craven said she was unable to find any case law to clarify whether a defendant has the absolute right to attend a hearing. She also said she does not believe Chism's absence from a non-evidentiary hearing would deprive him of his rights.

Absent an appeal by the district attorney, the hearing on Osler's motion is expected to proceed without Chism's presence on Sept. 8.

Chism lawyer wants some Boston charges Tossed

BOSTON — More than three years after he allegedly attacked a Department of Youth Services employee inside a restroom, Philip Chism's lawyers are asking a Suffolk Juvenile Court judge to dismiss some of the charges. 

The move comes after efforts to resolve the case short of trial apparently broke down earlier this year.

While awaiting trial at a DYS detention center in Dorchester, prosecutors say, Chism attacked a second young woman, a staff member, in what one has called a "chillingly" similar attack, on June 2, 2014. 

Chism is still facing charges of attempted murder by strangulation, assault with intent to murder, kidnapping and two counts of assault and battery with a dangerous weapon, a wall and a pencil. 

Some new details of that crime emerged Thursday during a hearing on a motion to dismiss two of the charges. 

Chism's lawyer, John Osler, referred to some of those details in his argument, as a means of suggesting that the testimony of witnesses — including the victim and another employee who went to her aid — did not support the charges of assault and battery with a dangerous weapon. 

Prosecutors have described during prior proceedings how Chism, holding a sharpened pencil, allegedly crouched below a wall to follow the worker as she headed to the restroom/locker room area. 

When the worker pulled the door open to leave the tiny restroom, Chism suddenly appeared in the doorway and put his hands around her throat, forcing her back toward a wall, according to the testimony cited by Osler. 

The victim recalled that she was able to get one of Chism's hands off her neck, and that she heard her own screams get louder as a result. Within seconds, another worker arrived and saw Chism holding the woman against the wall by her throat with one hand as he punched her with the other. 

That worker was able to knock Chism off balance so that he fell. 

Nowhere in that description, argued Osler, was an indication of Chism stabbing the woman with the pencil. 

And, he argued, the wall cannot be considered a dangerous weapon. 

Prosecutors David Bradley and Mark Zanini disagreed. 

Bradley argued it was reasonable for the grand jury to infer that the hole in the worker's blouse and the scratched skin beneath were caused by Chism because she did not have any injury when she entered the restroom. 

And as for the wall, Bradley argued, it became a weapon when Chism shoved her against it.
