DA wants Chism to spend at least 50 years in prison

DANVERS — Prosecutors are asking for Philip Chism to spend at least 50 years in prison before he can seek parole, according to a sentencing memorandum filed this morning in Salem Superior Court.

Chism, 17, is facing sentencing Friday in the rape, robbery and murder of teacher Colleen Ritzer, 24, in October 2013.

In a memorandum, prosecutors ask Judge David Lowy to impose consecutive life sentences for the murder and rape charges, with parole eligibility after 25 years on each charge. They're seeking a third, concurrent 25-year term on the robbery charge.

The district attorney's office expressed "grave concerns about public safety" in the 35-page memorandum.

Prosecutors say Chism, in contrast to a teen acting impulsively, was "purposefully cruel" and the evidence showed that he planned the crime.

I dont know... I am just guessing.... and I hope I am wrong... but the rape and murder were part of the same act of violence. Two charges (rightly so) but I can see a judge lumping the sentences together to run concurrently :eek

Regardless... I hope he gets another 25 years for his next crime (attempted murder)/Trial

He was not reckless and indifferent, but purposefully cruel.”

Had Chism killed Ritzer before 2012, he would have no chance of parole. But a 2012 U.S. Supreme Court decision (and a subsequent Mass. Supreme Judicial Court decision) made life without parole for juveniles unconstitutional.

So it will be up to Lowy to decide when Chism will be able to go before a parole board and argue for his freedom. It doesn’t mean he will ever be released, but he will have the chance.

Chism still has pending charges against him in Suffolk County. He is awaiting trial on attempted murder charges after he allegedly attacked a female detention worker with a pencil, circumstances prosecutors say are disturbingly similar to the attack on Ritzer.

Lowy says he will try and announce decision on Friday... recess after hearing to write a ruling... but it MIGHT be delayed to Monday :eek

Lowy says they can't refer to the rlae for which #PhilipChism was acquitted.

Defense also trying to bar use of psych reports - but only those parts that refer to what #PhilipChism told evaluators.

DA says defendants sentencing memo "carefully selected" bits and pieces of reports. Says reports also show #PhilipChism manipulative.

Now the big issue - defense wants to prohibit #PhilipChism from receiving consecutive terms. The DA wants consecutive life terms.

Defense says if parole denied on first life sentence, he might never starts serving the next life sentence. He #PhilipChism

Says that would deprive #philipchism for any meaningful opportunity of parole.
