Philip Chism found guilty of killing, raping his high school math teacher

SALEM — A jury has found Philip Chism guilty of first-degree murder, aggravated rape, and armed robbery in the death of Danvers High School math teacher Colleen Ritzer.

Chism will receive a life sentence for murder, but because he is a juvenile, he can seek parole in 15 years. With the two years of time he's already spent in custody, he could go before the parole board before he's 30.

Sentencing will likely be next month. A status hearing is scheduled for Dec. 22 to set a specific date.

The defense attorneys had no comment leaving court. Jurors were escorted to their cars and declined comment.

Jurors had 140 exhibits, including medical records and more than an hour of video, and had to consider the testimony of more than 50 witnesses. The defense claimed Chism suffered from mental illness.

Chism, now 16, was in his second month at Danvers High School, a student in several honors classes.

Ritzer, 24, was in her second year of teaching math at Danvers High School.

Their paths came together in the freshman math class Ritzer taught.

According to the article above... Chism could be out of prison aged 29. I hope THAT doesn't happen? I hope that there will be CONSECUTIVE sentences served in this case.. and he gets ANOTHER long stretch tacked on when he is found guilty in his next set of charges.
ANYBODY who does not buy into the "insanity" excuse (almost everybody) should see that this animal needs to be locked up until he dies.

JULIE MANGANIS was a great reporter updating via twitter.. but I hope she is mistaken about the sentence for Murder being life, reduced to 15 years because he is a minor. :doh

I accept that he is treated as an "adolescent" for the charges of Armed Robbery and even rape... but he was tried as an ADULT on the murder charge and is GUILTY of 1st Degree... on both theories proposed.. both Premeditated and "Extreme atrocity/cruelty" I would hope that he is SENTENCED as an adult as well.. and it's LWOP?

I still hope all three sentences are CONSECUTIVE.. just in case some bit of appeal daftness negates any of the sentences

Philip Chism Under Extra Security At Juvenile Detention Center

BOSTON (CBS) – Philip Chism was convicted of crimes more serious than most adult inmates, but since he’s only 16, he can’t go to a maximum security prison like other murderers.

“It’s a constant watch on someone like that,” said Essex County Sheriff Frank Cousins. “He’s a very dangerous person.”

Chism remains a county inmate until his January sentencing, at which point he will be turned over to the state. But he will stay at the same secure juvenile detention center in Worcester where he’s been throughout the trial, until he’s 18. Then he’ll move to a state prison.

Chism’s attorneys were back in court Wednesday, one day after a jury convicted him of raping and murdering his Danvers High math teacher Colleen Ritzer. This time, they were in a Boston courtroom dealing with an accusation that he similarly attacked a female staffer at a less secure facility a year after Ritzer’s murder. It looks like a frightening pattern.

“You’re not going to have him in the general population,” says Cousins. The sheriff says Chism eats meals in isolation, and has limited visitors. Since he regularly refuses visits from his own mother, he only meets with his attorneys under heavy supervision. He has to wear leg irons, shackles, or cuffs when he goes for walks in the yard outside.

Judge has wide leeway in Chism sentencing

Philip D. Chism’s punishment for the murder and rape of his Danvers High School math teacher in 2013 will come with a chance for parole. The question for the judge is how much time should the teenager serve before he gets a shot at freedom.

Timing and Chism’s age play significant roles in the potential penalties facing the teenager, who was convicted Tuesday of first-degree murder, aggravated rape, and armed robbery for killing Colleen Ritzer on Oct. 22, 2013, several legal experts said Wednesday.

Judge David A. Lowy, who presided over Chism’s trial in Essex Superior Court, must sentence him. A sentencing date has not been set, but lawyers for both sides are scheduled to meet with Lowy next week.

Under a retroactive Massachusetts Supreme Judicial Court ruling about juveniles convicted of first-degree murder, Chism, 16, cannot be sentenced to life in prison without the possibility of parole. He was 14 when he killed Ritzer.

The SJC decision was rendered two months after Ritzer, 24, was killed. The Legislature later enacted new punishments for juveniles convicted of first-degree murder, but that law does not apply to Chism, according to Chapman and the office of Essex District Attorney Jonathan W. Blodgett, which prosecuted the case.

“You can’t punish him under the current statute because it didn’t exist at the time Philip Chism committed the crime,” said Chapman, a former prosecutor and past president of the Massachusetts Defense Lawyers Association.

Blodgett’s office has said Chism faces a life sentence with the possibility of parole after 15 to 25 years for murder.

For the armed robbery and aggravated rape convictions, prosecutors said, Chism could be given a life term with a chance for parole after 15 years.

Lowy has the authority to order Chism to serve sentences for each of the crimes concurrently or consecutively, Blodgett’s office said.

My reading of that sentencing info is....

He could be given THREE lots of 25 years before eligible for parole (and not get parole).. run consecutively... Image

I can't even begin to speculate how Judge Lowy is going to sentence the offenses, but I DO believe they warrant to be imposed consecutively.

There is a chance in USA they will be consecutive... but unfortunately I can see the argument that its all one incident on single victim... but fingers crossed.

But the Judge will consider the gravity and circumstances of the crimes for imposing consecutively. Hope the murder and bathroom rape will cause him to lay it on him. It's really a shame that Chism wasn't convicted of the rape in the woods.
