The way I see it......

There is no strict LEGAL definition of ""continuous event", as there is often no strict legal definition for things Juries have to consider.. That is the WHOLE POINT of a Jury system... a "human" input... not some sort of computer program based on every term rigidly defined.

So... this Jury has a "free hand" to see this as a continuous event or not.. it is their decision alone.. not subject to appeals or over-riding by learned Judges etc....

Nobody KNOWS if Colleen was dead, nearly dead, or alive and possibly with a chance to survive the injuries up to that point in time... when Chism got her to the woods... and it should not matter... HE certainly could not know himself even ( for sure).
The rape in the woods was CERTAINLY all part of a continuous act of barbarism in my mind.. it matters not at which precise point she was "dead".... We have seen that even Medical experts can disagree on what "dead" strictly means. Who is to say at which point medical intervention could have rescued Colleen... at least to the point of survival in hospital on some sort of heart-lung machine.. assisted breathing etc. It is a silly point to argue in this case anyway. The point is.... during a single act of barbarism... Chism did all the stuff that we can see was done to Colleen.

Hypothetically .... if Chism had done all that he did up to point of just abandoning Colleen in the woods... dead for minutes, or near dead, or quite alive.. and she had succumbed to her injuries.. then some other POS had come along and violated her dead body.... THAT would be an "after death" violation.. (and it seems not subject to any law in Massachusetts??) I put it to you that what Chism did in the woods is a TOTALLY different scenario to some other person coming along in the woods.. and on that basis Chism is culpable for the entire Continuous event.. from bathroom though all he did in the woods... no matter exactly which point in time Death COULD have been declared ( by a Dr)

There was a bit of a conflab.. ongoing... about credit card theft.. was it actually armed robbery?... and they announced all charges relating to credit card would be dropped. It was penciled in as armed robbery.. but I Guess it did not quite fit.. for instance.... it could have been taken off her after death etc... so they "let it go" and announced that before closing arguments ( I think)
