Parole application can be renewed every 5 years.

They are saying first one is in 38 years (40 years from crime and arrest)... so they are NOT in agreement with the tweet above that opined about 40 years being only 27-30 years with time off for good behavior.

The 40 year sentences (rape and robbery) are finite... not "40 years to life" or anything like that. It's 40 years and you are free.. and I too imagine there would be the usual reduction for "good behavior".. but even if those sentences run for the full 40 years, the way it was described in the Presser... they don't have first parole hearing after 25 years..when it is due... they hold off until the end of 40 years (or less), by which time I am SURE some bleeding heart liberal will opine that Chism has already exceeded the 25 years to first parole hearing by 15 years (3 potential parole application opportunities), and so opine that Chism has done enough time and in effect missed out on 3 potential grantings of parole.. after the extra 15 years it is equivalent to a 4th parole application. I can just see an activist parole board, in the absence of any media or public coverage, GRANTING parole :roll

Peggie and Tom Ritzer and their two remaining children have 38 years before they will have to face Philip Chism again.

They say that’s too soon.

In an emotionally charged day in Salem Superior Court, the Ritzers spoke about the loss of their daughter Colleen, killed at 24 years old at the hands of one of the students she taught.

Chism, then 14, raped, murdered and robbed Ritzer in the bathroom of Danvers High School on Oct. 22, 2013, leaving her body posed in the woods just outside the school.

The judge presiding over Chism's murder trial (Lowy) was appointed to the state supreme court by the Governor. If Chism wins his appeal (years from now) or something major happens, I will update. Otherwise, this type of litigation is going to be pointless to even mention - and will go on and on.

Lowy is expected to recuse himself from a hearing scheduled for Wednesday related to the 2015 murder trial of Philip Chism, over which Lowy presided.

Chism was convicted in December of raping and murdering Colleen Ritzer, his 24-year-old math teacher at Danvers High School. Chism’s lawyers are challenging Lowy’s denial of a motion to impound video and a transcript of an interview in which Chism confessed to killing Ritzer.

Though Lowy denied the motion, the video and transcript have not been released to the public. The publishers of the Boston Globe, Salem News and Lawrence Eagle Tribune are asking the SJC to affirm Lowy’s original denial and make the documents public.

Philip Chism turns 18 next Saturday.
He will then be transferred to an adult prison system.

I don't know if turning 18 will affect his attempted murder case in juvenile court (to a district or circuit court).
The next hearing in that case isn't until end of March.

LAWRENCE — It has been nearly two years since the family of slain Andover math teacher Colleen Ritzer filed a civil lawsuit against the town of Danvers and two businesses, looking for answers as to how her rape and murder could have happened at Danvers High, a school that boasted state-of-the-art security.

So far, they have not received them.

Instead, on Thursday, Tom and Peggie Ritzer watched from a courtroom gallery as lawyers for the town and school department, DiNisco Design Partnership, and SJ Services asked a Lawrence Superior Court judge to throw out their lawsuit.

Then, at the end of the hearing, Judge Jeffrey Karp urged all of the parties to consider court-supervised conciliation – something that could give them answers without the trauma of lengthy litigation.

Karp said that he’s read all of the motions, filed more than a year ago, but needs time to consider the case law on each of the issues raised by the lawyers.

He also acknowledged the length of time it has taken for the case to get a hearing, citing a shortage of judges that forced numerous postponements since last year.

Judge rules against family of murdered Danvers teacher

DANVERS — A Lawrence Superior Court judge has dismissed two of the three counts in a lawsuit brought by the family of a Danvers High School teacher killed by one of her students nearly five years ago.

While calling the Oct. 22, 2013, rape and murder of Colleen Ritzer "heartbreaking," Judge Jeffrey Karp concluded that under the circumstances of the case, he could not find that the defendants — the town of Danvers, the school's architect and a cleaning firm — were liable for emotional distress suffered by Ritzer's parents and siblings.

The ruling leaves standing only a wrongful death claim against the architect, DiNisco Design Partnership.

The 24-page decision was filed Friday, a month and a half after a hearing in Lawrence Superior Court.
