Police Shooting Caught On Camera – Eye Witness Video Disputes Police Department Claim…
Posted on September 1, 2015 by sundance

This shooting is going to capture a LOT of attention.

There was a police shooting in Bexar Texas, a suburb of San Antonio, involving two police officers during a domestic disturbance call. The official version of the shooting is described by the Bexar County Sheriff’s office PIO Susan Pamerleau.

IMPORTANT – Watch the CNN affiliate KSAT report before proceeding:

One Person Dead In Officer Involved Shooting In San Antonio

What Pamerleau describes in that press statement segment is NOT what is shown in the video.

The video Officer Pamerleau describes is linked HERE –WARNING it is disturbing– and shows the actual moment the 41-year-old suspect, Gilbert Flores, was shot outside a home in the 24400 block of Walnut Pass.

Image

The video shows Gilbert Flores CLEARLY SURRENDERING with his hands CLEARLY EVIDENT in a non-threatening manner. The video also shows deputies Greg Vasquez and Robert Sanchez did not even attempt to render aid after shooting Mr. Flores.

This most certainly does not appear to be a justified use of deadly force. In addition, no-where in this video is any other method of “non lethal weapons” visible as claimed by the officers and the police Public Relations office.

According to the most recent reporting Officer Vasquez and Officer Sanchez are now on paid administrative leave pending the outcome of the investigation.

Will wait for all the facts before a claim murder. But with what is available thus far, the 1st video we see, does not show the initial confrontation or for how long. It does appear to show victim running from officers. He does appear to stoop down behind the parked cars (did he pick something up?). He disappears for a moment behind the police cruiser parked to the left. He paces in an agitated manner..right at 57/58 seconds, it looks like he drops his hands and then shots are fired. Real hard to tell from this video and angle, but with what is available thus far, I’m putting money on the shots being fired due to a rapid hands movement down to his waistband.

Other reports online indicate officers were messing with the guy upwards of 20 minutes before the video. Shields and Taser were reported to of been deployed. We do see a shield in one officers possession. It was also reported he had a knife, the knife was used on a female victim, and potentially a child. It is not clear or reported if he had the (a) weapon on him at the time of the shooting.

This is what I posted over yonder

Be careful about believing that the toddler was injured the spokeswoman used red flag language on that statement, about the baby she said who appeared to possibly have been injured .

At the 42 second mark it appears that Flores is doing something with his rear waistband, it appeared from the officer’s behavior that they were staying clear of him for a reason which may have been Flores had a weapon. It was stated that he had a knife when the confrontation began and that it was a long confrontation. Personally I can’t tell if Flores’ hand movement or the gun shots come first.

Too far away, blurry and out of context of the entirety of what preceded the shooting for me to make a call. It looks bad on first blush but so did the Slager video.

Reverberations of BLM;

James Keith is the media relations officer for Bexar County.

When asked about the tweet, Keith cited the case of Darren Goforth, a deputy who was shot from behind and killed while filling up his car at a gas station.

”After what happened in Harris County, we are not going to take any chances,” Keith said. “Now our deputies are coming to work in civilian clothes because of their concern for safety.”

Hours later, the Sheriff’s Office sent out a message with the following statement: “In regards to the deputy involved shooting, we’re asking for calm and patience. We are diligently working to complete the investigation so we can move to the next step. We want to get this right for the Flores family, our deputies and our community.”

IMO this one needs time and facts.

****

Time will tell and there is allegedely another video that is a closer view so that if it is released it should shed some light on the incident. If Flores had a knife on him, if it was in his left hand, if the officers after a "lengthy confrontation" where non lethal force was tried and failed to subdue a non compliant Flores or the officers believed that Flores was going for a knife in his waistband then Flores is 100% responsible for his own death. There is no reason for armed officers to try and fend off a knife wielding man who has been noncompliant for an extended period of time. There was no reason for them to chance getting their guns back in their holsters or some other imaginary point of inaccessibility for Flores and to meet him in a hand to hand combat.

Mano v mano is for the movies.

If there is clear evidence that Flores was surrendering (and I don't think the video shows conclusively that he was) then the officers suffer the consequences of their actions. It would be very unusual that both cops were in a defensive posture, both stepped backwards, both had their guns drawn, both shot almost simultaneously, and one had his shield up, if they believed Flores was being compliant at the time of the shooting. I think Flores either had a knife or that he dropped his hands toward his waistband and since Flores had wielded a knife earlier the officers reasonably believed he might have a knife concealed in said waistband and they acted in self defense.

Also one of the officers definitely kicks something away when he approaches Flores' corpse. A knife? A teddy bear? Time will tell.

Attorney: Texas man hit deputy with blunt end of knife
But was suspect a threat? attorney asks

WVTM13.com | September 3, 2015
By Steve Almasy & Pamela Brown, CNN

(CNN) —The man shot dead by police last week outside his Texas home had hit one of the officers with the butt end of a knife, the lawyer for the family of Gilbert Flores said Thursday.

But Thomas Henry said experts the family has working on the case have "serious concerns" about whether Flores was an imminent threat to two Bexar County deputies who had their handguns pointed at him and shot him.

If the threat was gone, he said, "you can no longer use deadly force."

Henry said Flores had a knife in his hand as police officers investigated a domestic disturbance call at the family's San Antonio home. Flores' wife had been injured earlier and the 911 call was warranted, Henry said. But Flores hadn't used a knife against her, the attorney added.

Henry also said a report that a baby had been injured was inaccurate.
[...]
The deputies, who are on administrative leave, are Greg Vasquez and Robert Sanchez, the sheriff's office has said. CNN's efforts to contact them have so far been unsuccessful.

Each has been with the sheriff's office for more than a decade, Pamerleau said. Neither deputy involved in the shooting was wearing a body camera.

Flores had previous run-ins with the law. He was cited for possession of marijuana in 1995, criminal trespassing and aggravated assault in 1999, and aggravated robbery in 2003.

Bexar County, deputies sued for fatal shooting of SA man

KSAT.com | By Cory Smith | Updated Sept. 17, 2015

SAN ANTONIO - A lawsuit has been filed against Bexar County, its sheriff's office and two deputies who fatally shot a man who appeared to have his hands raised in a video.

A lawsuit filed Monday, claims the deputies who shot and killed 41-year-old Gilbert Flores last month violated his civil rights.

"Mr. Flores, still in the front yard, stopped all resistance and proceeded to place both of his hands above his head ... surrendering with his hands raised, with or without a knife, reflected that there was no immediate danger of bodily injury to the officers or others," the lawsuit reads.

A partially obscured video shows Flores raised his arms before the deputies opened fire. Investigators said a second video shows Flores holding both of his hands up while still being armed with a knife.
[...]
On Wednesday, Bexar County District Attorney Nico Lahood said his office would take its time with the investigation. The sheriff's office recently handed over all the evidence to Lahood's office, which will decide whether to pursue criminal charges.

Bexar deputies won’t be indicted in fatal shooting in August
By Elizabeth Zavaala, John Tedesco | ExpressNews.com | December 9, 2015

A Bexar County grand jury Wednesday declined to indict two sheriff’s deputies in the fatal shooting of a man in August that was caught on two videos.

Gilbert Flores, 41, was shot Aug. 28 outside his parents’ home on the far Northwest Side following a confrontation with Deputies Greg Vasquez and Robert Sanchez that lasted several minutes.

The grand jury’s decision means the officers will not be charged.
