A Staten Island grand jury has voted not to bring criminal charges against the white New York City police officer at the center of the Eric Garner case, a person briefed on the matter said Wednesday.

The decision was reached on Wednesday after months of testimony including from the officer, Daniel Pantaleo, who used a chokehold to restrain Mr. Garner, who died after a confrontation. It came less than two weeks after a grand jury in Ferguson, Mo., declined to bring charges against a white officer who fatally shot an unarmed black teenager, Michael Brown.

For days, the New York City Police Department has been readying for a new round of protests, which began in the city after the Ferguson decision and which were expected to continue and possibly grow if the grand jury declined to bring charges against the officer.

A Grand Jury Did Indict One Person Involved In Eric Garner's Killing -- The Man Who Filmed It

On Wednesday, a Staten Island grand jury decided not to return an indictment for the police officer who put Eric Garner, an unarmed black man, in a chokehold shortly before his death. A different Staten Island grand jury was less sympathetic to Ramsey Orta, however, the man who filmed the entire incident.

In August, less than a month after filming the fatal July 17 encounter in which Daniel Pantaleo and other NYPD police officers confronted Garner for allegedly selling untaxed cigarettes, a grand jury indicted Orta on weapons charges stemming from an arrest by undercover officers earlier that month.

Police alleged that Orta had slipped a .25 caliber handgun into a teenage accomplice's waistband outside a New York hotel. Orta testified that the charges were falsely mounted by police in retaliation for his role in documenting Garner's death, but the grand jury rejected his contention, charging him with single felony counts of third-degree criminal weapon possession and criminal firearm possession.

In Garner's case, on the other hand, jurors determined there was not probable cause that Pantaleo had committed any crime. A medical examiner ruled Garner's death homicide in part resulting from the chokehold, a restraining move banned by the NYPD in 1993.

Newsmax is reporting 11 facts about the Eric Garner case that the media isn’t telling you, and they are crucial:

    1. There is no doubt that Garner was resisting an arrest for illegally selling untaxed cigarettes. Former New York City Police Commissioner Bernard Kerik put it succinctly: “You cannot resist arrest. If Eric Garner did not resist arrest, the outcome of this case would have been very different,” he told Newsmax. “He wouldn’t be dead today.

    “Regardless of what the arrest was for, the officers don’t have the ability to say, ‘Well, this is a minor arrest, so we’re just going to ignore you.'”

    2. The video of the July 17 incident clearly shows Garner, an African-American, swatting away the arms of a white officer seeking to take him into custody, telling him: “Don’t touch me!”

    3. Garner, 43, had history of more than 30 arrests dating back to 1980, on charges including assault and grand larceny.

    4. At the time of his death, Garner was out on bail after being charged with illegally selling cigarettes, driving without a license, marijuana possession and false impersonation.

    5. The chokehold that Patrolman Daniel Pantaleo put on Garner was reported to have contributed to his death. But Garner, who was 6-foot-3 and weighed 350 pounds, suffered from a number of health problems, including heart disease, severe asthma, diabetes, obesity, and sleep apnea. Pantaleo’s attorney and police union officials argued that Garner’s poor health was the main cause of his death.

    6. Garner did not die at the scene of the confrontation. He suffered cardiac arrest in the ambulance taking him to the hospital and was pronounced dead about an hour later.

    7. Much has been made of the fact that the use of chokeholds by police is prohibited in New York City. But officers reportedly still use them. Between 2009 and mid-2014, the Civilian Complaint Review Board received 1,128 chokehold allegations.

    Patrick Lynch, president of the New York City Patrolmen’s Benevolent Association, said: “It was clear that the officer’s intention was to do nothing more than take Mr. Garner into custody as instructed, and that he used the takedown technique that he learned in the academy when Mr. Garner refused.”

    10. In order to find Officer Pantaleo criminally negligent, the grand jury would have had to determine that he knew there was a “substantial risk” that Garner would have died due to the takedown.

    11. Less than a month after Garner's death, Ramsey Orta, who shot the much-viewed videotape of the encounter, was indicted on weapons charges. Police alleged that Orta had slipped a .25-caliber handgun into a teenage accomplice's waistband outside a New York hotel.

Eric Garner’s widow rejects NYC’s $5M offer to settle wrongful death suit

A $5 million settlement won’t satisfy the heartbroken family of Eric Garner.

A source familiar with ongoing negotiations between Controller Scott Stringer and the family of the Staten Island man killed by an NYPD cop say that his widow, Esaw Garner, turned down the hefty offer last week.

The source said the Garner family’s attorney, Jonathan Moore, is urging the family to accept the $5 million and then seek more money through a separate lawsuit against EMTs from Richmond University Medical Center.

They were captured on video failing to give Garner, 43, medical treatment — neither oxygen nor CPR — as he died at their feet July 17, 2014.

Negotiations are expected to continue until Friday, when a statute of limitations requires the family file a wrongful death lawsuit. The family has said it intends to sue the city for $75 million.

The $5 million offer would have been one of the largest wrongful death settlements stemming from a killing by NYPD cops.

NYC official: City settles with Eric Garner's estate for $5.9 million

CNN) - Almost one year to the day after he died at the hands of New York City police officers -- an episode that fueled months of racially underscored anti-police protests across the nation -- the family of Eric Garner accepted a pretrial settlement from the city Monday.

Garner's estate, which filed a claim against the city in October 2014 for damages related to his death, will be paid $5.9 million, according to a city official.

"Following a judicious review of the claim and facts of this case, my office was able to reach a settlement with the estate of Eric Garner that is in the best interests of all parties," said New York City Comptroller Scott Stringer, whose office is charged with settling claims against the city.
