I have been listening but doing other things. The main thrust seems to be Discredit Kat.... which is fair enough.

A lot depends on Kat's evidence.. and she is LESS than creditable... especially with the vested interest of a plea deal. Reasonable doubt at the very least about her version.

Barth is presenting a list of claims that he wants the jury to think about... in the analysis of the night that Lizzi died. He asks if they have doubts that it was a ligature homicide, and brings up the dualing testimonies of the medical examiners.

Ward says this was a deliberate, premeditated murder. WARD: the conspiracy is part and parcel of his murder.. evidence that he was trying to get away with this murder ... the cover-up … there was no accident the defendant who makes plans to kill witnesses was not involved in an accident ...he’d taken cpr courses including treating seizures… yet gave no assistance to a dying victim, instead dumps her body in the river and destroys evidence and escape jail is not someone involved in an accident.

Ward says Kat's story to the defense was ridiculous, open-ended, never admits being the one to kill Lizzi Marriott. "Meanwhile the defendant is creating his escape plan. Upset about evidence.. why would someone be willing to kill or murder [referencing his plan to do something to Roberta and Paul]…why would you be willing to become a murderer if you’ve been involved in an innocent accident ... that's why the conspiracy charges are so important."

Today Jury Instructions and then Jury retire to deliberate.

Watching the last few trials I have become alert to the IMPORTANCE of Jury instructions. Despite all the effort that goes into deciding on the detail of what the instructions are, it seems to me that they are often not precisely clear to Jurors and/or Jurors are too thick to follow them to the letter
Multiple charges and "lesser included charges" tend to complicate all that. I am wondering IF Justice would be better served if Prosecutors had to decide what charge was really appropriate, rather than "overcharging" almost as a "gamble" (worth a crack) but really expecting a lesser charge to be decided on.

The judge is leaving the courtroom.
Charging the jury has been a bit delayed, attorneys met for a sidebar conversation and the judge left... Peter Hinckley went over to explain things to the family... Mr. Marriott actually just left the courtroom .. perhaps for a moment. Seth Mazzaglia has just left as well. May be a bit longer of a wait than we thought.

Seth Mazzaglia is back in the courtroom, his mother is in the front row behind him. Normally he looks straight ahead when he comes and goes, but now he glances her way. His leg is bouncing wildly as he sits leaning in his chair, facing the front of the court. The Marriott family members are chatting, Mr. Marriott leaning with his back to the bench in front of him conversing with Lizzi's Mom and Grandmother. Can't imagine how families cope with this.
