All eyes on Shrien Dewani trial
South Africa, Sunday 5 October 2014 - 8:24am
by Annika Larsen

CAPE TOWN - It’s taken judicial authorities more than three years to get British murder accused Shrien Dewani to South Africa to stand trial.

On Monday, Dewani will plead guilty or not guilty to his wife’s murder.

Anni Dewani’s body was found slumped in the back of a VW Sharan in Khayelitsha in November 2010.

The case has sparked international interest, not only for Dewani’s fate but for how the South African judiciary will handle the case.

When former police commisioner Bheki Cele called Shrien Dewani a ‘’monkey‘’ who had taken South Africans for fools by coming here to allegedly have his wife murdered, South Africa’s justice officials must have cringed,

Especially as they were trying so hard to have Dewani extradited from England, fighting assertions that he was unlikely to get a fair trial in South Africa.

Now South African justice officials feel they have something to prove, given that they’ve made several undertakings to the UK’s legal authorities.

Leading the prosecution is advocate Adrian Mopp. He’s the former Western Cape head of the now defunct crime-fighters, the Scorpions.

Mopp will be assisted by Shireen Riley, the lead prosecutor in the trial of Najwa Petersen, who masterminded the murder of her husband – the famous singer and playwright – Taliep Petersen.

For the defense is Senior Counsel Francois van Zyl. He’s one of the most experienced criminal lawyers in the country.

The Attorney General of the former Transkei has acted for convicted fraudster Shabir Shaik and the son of a former British prime minister, Mark Thatcher.

Van Zyl is a tactician rather than a showman.

They will be arguing before the deputy Judge President of the Western Cape High Court, Jeanette Traverso.

She has a reputation for being tough – running her court with military precision and with no tolerance for theatrics or the badgering of witnesses.

Once again, the world’s eyes will turn to a South African court – this time in Cape Town and so judicial authorities can be expected to be particularly vigilant.

A trial-related mishap will be viewed as bad PR and if Shrien Dewani is convicted, it will only serve to be used as grounds for an appeal.

Analysis: The killing of Anni - Undercurrents will expose social pressure and fear of rejection

Marianne Thamm, South Africa
06 Oct 2014 01:30 (South Africa)

While it will be Western Cape Deputy Judge President Jeanette Traverso’s job to determine whether there is enough legal evidence to convict Shrien Dewani of masterminding the hijacking and killing of his wife Anni, the trial is certain to focus acute attention on the secret world of sadomasochistic sex as well as highlighting the socialisation of men and women in relation to traditional notions of romance, marriage and respectability. By MARIANNE THAMM.

If there is one consistent and overarching thread or theme in the series of SMSes between Anni Hindocha and Sneha Hindocha, her cousin and confidante, it is that Anni was entering into the marriage with Shrien Dewani in October 2010 reluctantly and with considerable trepidation and anguish.

Just as Oscar Pistorius’ trial exposed an underlying tangled matrix of guns, violence, celebrity, fame, money, male entitlement and white fear, so Shrien Dewani’s murder trial, which starts in the Cape High Court today, will cleave open the clandestine world of sadomasochistic sex as well expose why a young woman might reluctantly but willingly enter into a relationship with a man she clearly doubted from the start.

Shrien Dewani, the millionaire British businessman accused of having his wife Anni killed in a staged carjacking during their honeymoon in Cape Town, has denied any involvement in her murder but admitted leading a double life in which he visited male prostitutes as he planned their wedding.

Mr Dewani, 34, said he considered himself to be bisexual and acknowledged using the services of a man known as The German Master, who is expected to give evidence as a prosecution witness and say that the Bristol businessman told him he had to get married or his family would “disown” him.

“My sexual interactions with males were mostly physical experiences or email chats with people I met online or in clubs, including prostitutes such as Leopold Leisser,” he said.

“My sexual interactions with females were usually during the course of a relationship which consisted of other activities and emotional attachment.”

Mr Dewani made the dramatic revelations as part of a statement read at the opening of his trial at Cape Town’s High Court for the kidnapping and murder of his new wife, a 28-year-old Swedish engineer.

Shrien Dewani has come face to face with the man he allegedly hired to murder his wife during their honeymoon in Cape Town for the first time since the night of the shooting four years ago.

Mziwamadoda Qwabe, 29, is one of two prosecution witnesses who have claimed that Shrien Dewani paid them to kill his wife Anni in an allegedly staged carjacking.

Both he and Zola Tongo, the couple’s taxi driver, were given reduced sentences in return for their guilty pleas and are now both due to testify against their alleged paymaster. A third man who helped broker the deal, Monde Mbolombo, was granted immunity from prosecution on the same grounds.

Qwabe told the court Tongo confirmed the hit shortly before the shooting by texting him that “the husband wanted the job done that night”.

Shrien Dewani 'surfed gay websites day after wife's body found'
Court documents show British businessman looked at a homosexual dating website as he and his new wife waited to board their honeymoon plane and later gay and fetish websites after she was killed
By Aislinn Laing, Cape Town
8:17PM BST 08 Oct 2014

Shrien Dewani, the British businessman accused of having his wife Anni murdered in a fake carjacking during their honeymoon in Cape Town, surfed gay and fetish websites the day after his wife's body was found, court documents suggest.

Mr Dewani, 34, also looked at the homosexual dating website Gaydar as he and his new wife waited for a connecting flight to Cape Town from Johannesburg after spending the first part of their honeymoon at a luxury safari lodge.

The revelations came in a dossier of admissions made by Mr Dewani as part of his trial for the murder and kidnapping of Mrs Dewani, 28. The state alleges he co-opted his taxi driver to hire two criminals to carjack them and kill his new wife for R15,000 (£1,300).

Prosecutors are expected to argue it was because he was a closet homosexual who wanted out of his marriage.

On Wednesday, Mr Dewani came face-to-face with one of the two men who attacked the newly-weds for the first time since the fatal shooting the night of November 13, 2010.

Interesting if they show evidence of attempted rape.

Honeymooner Anni Dewani was shot accidentally as a carjacker tried to pull her out of the taxi she was travelling in to rape her, it was claimed in a Cape Town court on Monday.

Although this was not an arranged marriage which, so often would be the case, I think both of these from what we hear over here in the UK wanted out of the marriage, but went ahead anyway. According to her sister the deceased was having second thoughts, even after the wedding when she spoke to her parents, which apparently she did almost on a daily basis while on honeymoon telling them that she had much to speak to them about as things were not right.

But, at the end of the day arranging a hit on his new wife (if he did) is certainly a very extreme way of fixing the problem.

Explicit evidence showing Shrien Dewani is gay or bisexual 'doesn't matter', says judge
In a massive blow to the state’s case, Judge Jeanette Traverso throws out evidence after questioning whether Mr Dewani’s sexuality could have any bearing on his guilt
By Aislinn Laing, Cape Town

Explicit emails exchanged between honeymoon murder suspect Shrien Dewani and an unnamed man have been thrown out of court after the judge questioned whether Mr Dewani's sexuality had any bearing on his guilt.

In a massive blow to the state's case, Judge Jeanette Traverso said whether Mr Dewani is bisexual or gay "doesn't matter" and that "many, many people" were conflicted about their sexual orientation, but it did not make them murderers.

Judge Traverso made her ruling after prosecutor Adrian Mopp sought to have the emails read in court.

Dewani case ballistics expert admits he may have misled trial
South African Police ballistics expert in Dewani case forced to admit he might have misled court
By Aislinn Laing, Cape Town
9:29PM BST 22 Oct 2014

A South African Police ballistics expert was yesterday forced to admit that he might have misled the trial of a hitman convicted of the fatal shooting of Anni Dewani in Cape Town four years ago.

Warrant Officer Pieter Engelbrecht told the 2012 trial of Xolile Mngeni, one of two men who hijacked Mrs Dewani and her husband Shrien’s taxi, that the gunman had been sitting in the front passenger seat of the car.

But yesterday under cross examination by Mr Dewani’s lawyer he admitted that it was possible the shooter might have been standing outside an open rear door of the car when he fired a single bullet at close range into the 28-year-old’s neck.

Mr Dewani’s lawyers have suggested that Mrs Dewani’s killer could have been the second assailant, Mziwamadoda Qwabe, since gunshot residue was found on a pair of yellow rubber gloves he admitted he wore to the scene, and a print from the gloves was recovered from the back door.

Qwabe was handed a reduced sentence, along with the Dewani’s taxi driver Zola Tongo, in return for giving evidence against Mr Dewani, a wealthy businessman from Bristol. They have both claimed that 34-year-old Mr Dewani paid them to kill his wife and make it look like a carjacking.
