What's ahead in Knox murder trial

FLORENCE, Italy — Former American exchange student Amanda Knox spent four years in jail in Italy, from her arrest to her conviction in her first murder trial through her successful appeal. She's now facing a second appeals trial, along with her former Italian boyfriend Raffaele Sollecito. Here's a road map to help understand where the Italian court system is going next:

FIRST TRIAL, SECOND TRIAL, THIRD TRIAL
Knox and Sollecito were convicted in 2009 of murdering British student Meredith Kercher, whose throat had been slashed the night of Nov. 1, 2007. Knox was sentenced to 26 years, including one year for a slander conviction for wrongly accusing a bar owner of the murder, while Sollecito received 25 years.

An appeals court overturned their murder verdicts, while confirming Knox's guilt on a slander charge and raising that sentence to three years. Knox, who had spent four years in jail during the investigation and the trials, was free to return to the United States, and she did.

In March, Italy's highest court vacated the appellate court in a scathing decision that blasted it for "deficiencies, contradictions and illogical" conclusions. It ordered the case back to appeal, noting specific weaknesses such as the failure to hear one witness or to test a minuscule trace of DNA on the handle of the presumed murder weapon.

The new appeals trial in Florence began in September.

THE THIRD APPEAL
Knox is now 26 and Sollecito is 29. She has remained in the United States, while Sollecito has attended some hearings and addressed the court in Florence. All the evidence is being weighed again at this trial.

Amanda Knox slammed for soliciting funds in victim's memory
AP 5:08 p.m. EST December 16, 2013

FLORENCE, Italy (AP) — A lawyer urged an Italian appeals court on Monday to convict Amanda Knox of murdering British student Meredith Kercher and denounced as "unbearable" that the American was soliciting donations in Kercher's memory.

Francesco Maresca, in his closing arguments on behalf of the Kercher family in the third trial of Knox and co-defendant Raffaele Sollecito, urged the eight lay jurors on the panel of 10 to disregard publicity over the case as well as Knox's own statements, including her criticism of Italy's judicial system.

Amanda Knox has declared her innocence of her roommate Meredith Kercher's 2007 murder in an unusual email submitted on Tuesday to the Italian court hearing the case against her.

"I didn't kill. I didn't rape. I didn't rob. I didn't plot. I didn't instigate. I didn't kill Meredith," Knox wrote, adding that she was staying away from the trial because she feared being wrongly convicted.

Judge Alessandro Nencini read into the record the email, written in Italian and submitted by Knox's lawyers before their closing arguments, noting it was not normal procedure given Knox's absence, and did not have the same legal standing as a spontaneous declaration made in person.

"Who wants to speak at a trial, comes to the trial," Nencini said, adding that he had to take the word of her lawyers that the email, printed over five pages, was by Knox. "I never saw her, I don't know her," the judge said.

Knox explained her absence was out of fear that she would be wrongly convicted, which she contends happened during her first trial and that of her Italian former boyfriend Raffaele Sollecito. The case against Knox and Sollecito is being heard for a third time.

Verdict in retrial of Amanda Knox for murder of Meredith Kercher scheduled for January 30

A VERDICT in the retrial of US student Amanda Knox for the 2007 murder of her housemate is expected on January 30, the Italian court hearing her case has said.

"I am hopeful, but afraid. Every time I've believed my innocence would be recognised I have been found guilty," Knox said in an interview with La Repubblica daily by Skype from her hometown of Seattle.

Knox has been in the US ever since an appeal court acquitted her and her former boyfriend Raffaele Sollecito in 2011 over the killing of British student Meredith Kercher.

Amanda Knox: 'I will become a fugitive if found guilty'

Amanda Knox has said for the first time that she is prepared to become "a fugitive" from justice if an Italian court upholds her original conviction for the murder of Meredith Kercher.

As one of the last hearings in her retrial was held on Thursday, Knox, 26, confirmed from the US that she would fight any extradition request from Italy if the appeals court in Florence finds her guilty of the murder and sexual assault of the British undergraduate in Perugia in 2007.

Italy could apply for her to be extradited but her lawyers in the US are expected to resist that on the basis of double jeopardy – the principle that a defendant cannot be tried twice for the same crime.

The appeals court is expected to hand down its verdict on Jan 30 after re-hearing the case since September.

FLORENCE, Italy (AP) — The defense lawyer for the former boyfriend of U.S. exchange student Amanda Knox told an appeals court Thursday that the young lovers were blamed by authorities for the murder of a British student to calm fears that a monster was loose in their Italian university town.

Defender Giulia Bongiorno said her client, Raffaele Sollecito, and Knox were identified as suspects by police in a "record" four days after the murder of Meredith Kercher in the central town of Perugia because authorities "did not want to think that a stranger, a monster, could have entered a house and murdered a student."

Bongiorno said much of the evidence later used to convict the pair in their first trial — including the presumed murder weapon found in Sollecito's kitchen drawer and a clasp that had been ripped from Kercher's bra — had not even been gathered by investigators at that point.

Bongiorno, on the last day of closing arguments in the pair's third trial, showed a court slides and videos in a bid to dismantle the prosecution's case. Sollecito sat at her side.

AMANDA KNOX could become a “virtual prisoner” in her own country if an Italian court upholds her original conviction for the murder of British student Meredith Kercher.

Her lawyer yesterday said that Knox, 26, would be unable to travel to any country that has an extradition treaty with Italy because she could be arrested.

She could then be returned to Italy and thrown in jail.

US authorities have made it clear they would not extradite Knox under any circumstances.
The Seattle student, who served four years of a 26-year sentence for murder before being freed on appeal in October 2011, has said she is prepared to become a “fugitive” if she loses her retrial.

If convicted of the murder, prosecutors have demanded that she be jailed for 30 years and would seek her extradition from the United States.

Her lawyer Anne Bremner told the Sunday Express: "If the court finds against her, it could make it very difficult for her to travel.

"She could be subject to arrest in a country that has such an arrangement with Italy and that would probably include most countries.

Knox previously provoked controversy when she told Italian newspaper La Repubblica: "If I am convicted then I will be, as they say, on the run."

She clarified the comment in a statement through her lawyers saying that if she is found guilty, "legally I'll be defined as a 'fugitive,' but I will continue to fight for my innocence. I will not willingly submit myself to injustice."

Italian court hears final rebuttals in Knox trial

FLORENCE, Italy (AP) — Defense lawyers for U.S. student Amanda Knox and her Italian former boyfriend get their final say in the defendants’ third trial for the gruesome 2007 murder of Knox’s British roommate.

The prosecution will also make their final rebuttals Monday, the last hearing day scheduled in the trial ahead of the verdict later this month. Judge Alessandro Nencini specified each team will get 30 minutes for their last word so that deliberations can start as planned Jan. 30.

Prosecutors Monday ruled out a sex-game scenario in the death of Amanda Knox's British roommate in Knox's retrial in Florence, Italy.

"I find no traces nor hints of this hypothetical erotic game," prosecutor Alessandro Crini said.

Defense lawyers in Florence wrapped up their closing remarks Monday in the retrial of Knox and ex-boyfriend, Raffaele Sollecito, in the 2007 death of British student Meredith Kercher. Knox and Sollecito have denied killing Kercher in what prosecutors in the original trial said was a sex game gone wrong. They were convicted in 2009 but acquitted on appeal two years later.
Crini has repeatedly argued the murder was sparked by a series of arguments over the cleanliness of the apartment after a third person, Rudy Guede, left the bathroom dirty, ANSA reported. Guede was convicted of the sexual assault and murder of Kercher, but the Italy's highest court, the Court of Cassation, said it was unlikely he acted alone.

The Court of Cassation overturned the appeal ruling of Knox and Sollecito and ordered the current appeals-level trial. Knox and Sollecito each spent four years in prison, including time before their first trial.


The attorney for U.S. student Amanda Knox in the retrial on the death of her British roommate in Italy says his client can't wait for the "nightmare" to end.

Sollecito was in court with his father while Knox remained at her home in Seattle, as she has since the retrial began. Knox and roommate Kercher were studying in Perugia in 2007.
A verdict is expected Jan. 30.

An Italian prosecutor in the retrial of Amanda Knox and Raffaele Sollecito pleaded with a court to take steps to ensure that their sentences would be served if they’re convicted again of killing British student Meredith Kercher.
The request came as lawyers began rebuttals on Monday as part of lengthy closing arguments in the case. Knox’s attorneys will get the final word before a panel of two judges and eight jurors begin deliberations on Jan. 30.

Prosecutor Alessandro Crini acknowledged his request is complicated by Knox remaining in the United States, while her former Italian boyfriend Sollecito has traveled abroad

As a precautionary measure, Sollecito could be arrested, put under house arrest or have his passport confiscated, the prosecutor said.

The defense and prosecution were both making their final rebuttals on Monday before the court begins deliberations on Jan. 30. A verdict is expected later that day.

Crini has requested guilty verdicts and jail sentences of 26 years for both defendants, and that the court increase to four years Knox’s three-year sentence for a slander conviction, which has been upheld.

In the case of Sollecito, who told reporters Monday that he intends to remain in Italy for the verdict, the precautionary measures could include immediate arrest, house arrest or the confiscation of his passport
Knox’s lawyer, Carlo Dalla Vedova, said during a break that any request for extradition could be made only after a possible guilty verdict is confirmed by Italy’s highest court — a process that can a year or more.

An Italian court has been urged to ensure that Amanda Knox and Raffaele Sollecito serve their sentences, if they are found guilty of the murder of British student Meredith Kercher.

Knox, 26, has stayed in Seattle while there is an Italian retrial for the murder of the Leeds University student, while Sollecito has been present in Italy.

She and her ex-boyfriend are accused of stabbing Miss Kercher, 21, to death and sexually assaulting her while the young women were studying abroad in Perugia, Italy, in 2007.

Prosecutor Alessandro Crini has requested guilty verdicts and jail sentences of 26 years for both defendants. Crini also urged that the court increase Knox's three-year sentence for a slander conviction to four years.

Knox and her one-time lover served four years in jail for the murder of Miss Kercher, who was found semi-naked with her throat slit in the flat she shared with Knox in.

A court in Italy has reinstated the guilty verdicts against Amanda Knox and Raffaele Sollecito for the murder of UK student Meredith Kercher in 2007.

American Knox and her Italian ex-boyfriend Sollecito - who had pleaded not guilty - now face long jail sentences.

The latest verdict overturns the pair's successful 2011 appeal, which freed them after four years in jail.

Ms Kercher was stabbed to death in the flat she shared in Perugia with Knox.

Thursday's fresh appeal hearing in Florence was ordered by Italy's highest court, the supreme court in Rome.

It had found that the 2011 appeal - which acquitted the pair - was flawed.

Ms Knox, who along with Mr Sollecito had denied all the charges, did not return to Italy for the case.

Ms Kercher's brother Lyle and sister Stephanie were present when the verdict was read out.

Will we fight extradition? I sure hope so. I don't think she is guilty and I think their system is corrupt.

Not sure how it works but this statement in the CNN article is interesting.

I admit that I don't know all the evidence but based on what I have heard and seen I tend to believe she is guilty.

However I do believe the US must fight the extradition due to the bad precedent it would set for others if something similar were to happen.

I hope she has changed for the better and stays out of future trouble.

I'm with you about setting that precedent, SheStone. Since they overturned her conviction it would seem to me that there was reasonable doubt. Hopefully appeals will work because she may have a hard time fighting extradition if it comes to that.

Could it be that they're just totally mad about the slander she has been charged with.

I have little interest in this case, but clearly the Italians were going to convict her again for their honor or lack thereof sake. Keep out of jail Amanda.
