NEW YORK - Trayvon Martin shooter George Zimmerman is suing NBC over the network’s botched editing of his 911 tape, Page Six can exclusively reveal.

We hear Zimmerman’s attorneys are about to file a complaint against NBC and its top executives, naming news president Steve Capus and correspondent Ron Allen, who was the reporter on the scene for the broadcast on “Today” on March 27. He also remained the reporter for the story on “NBC Nightly News.” A source tells us, “The suit will be filed imminently against NBC and its news executives.

The network’s legal department has put everybody in the news department involved with this incident on notice, telling them not to comment.” NBC launched an internal probe after producers misleadingly edited the 911 call placed by Zimmerman just before he shot the unarmed Florida teenager.

The edit made it appear that Zimmerman had immediately told police that Martin was black, when the full tape reveals the neighborhood watch captain only did so when responding to a question posed by a dispatcher. Combined sections from two different parts of the tape gave the false impression that Zimmerman had said: “This guy looks like he’s up to no good or on drugs or something. He’s got his hand in his waistband. And he’s a black male.”

NBC News brass reportedly interviewed more than half a dozen staffers during its internal investigation, and at least three employees were let go. They determined that a “seasoned” producer was to blame for the clip and news executives did not know the 911 call had been misleadingly edited until reports about it surfaced days later.

An unidentified NBC executive previously told Reuters the “Today” show’s editorial control policies missed the selective editing of the call. It is not known if any other “Today” execs or anchors will be named in the suit. NBC declined to comment last night. Zimmerman’s lawyer Mark O’Mara said he was unable to get us a comment before deadline.

NBC Fires Lilia Luciano Over George Zimmerman Tape Edit

In the continuing saga of NBC's prejudicial editing of George Zimmerman's call to police to report a suspicious person, Trayon Martin, TV Newser reports NBC reporter Lilia Luciano has been fired. But keep reading, I have additional information and transcripts with sourcing to NBC shows.

The March 20 version of the clip played in Luciano's Today Show segment had a different line out of sequence than her March 22 segment. But it was also unfairly prejudicial to Zimmerman.
According LexisNexis, the March 20 version of the clip that aired during Luciano's segment was:

While the March 22 version of the clip that aired during Luciano's segment was different than the March 20 version, it was the same as the clip that aired on the Today Show on March 27 with Ron Allen. It was the March 27 version that caused the initial furor.

From my April 9 post:
In checking LexisNexis last night, I noticed the March 27 Today Show segment was the second time the Today Show used the inappropriate edit. The first was on March 22, 2012, in a segment titled "Fallout from the Trayvon Martin shooting includes calls for Sanford police chief to resign". The segment featured a live report by NBC reporter Lilia Luciano in Sanford. The video, which was linked to by Luciano that day on her Twitter Feed, has been removed from the Today Show Website (although part of the transcript is still there, racial quote and all). From the transcript on Lexis:

According to the actual transcript of the call, here's what Zimmerman and the dispatcher actually said:

Zimmerman: Hey we've had some break-ins in my neighborhood, and there's a real suspicious guy, uh, [near] Retreat View Circle, um, the best address I can give you is 111 Retreat View Circle. This guy looks like he's up to no good, or he's on drugs or something. It's raining and he's just walking around, looking about.

Dispatcher: OK, and this guy is he white, black, or Hispanic?

Zimmerman: He looks black.

Dispatcher: Did you see what he was wearing?

Zimmerman: Yeah. A dark hoodie, like a grey hoodie, and either jeans or sweatpants and white tennis shoes. He's [unintelligible], he was just staring…


But, we're not done. These three Today Show airings were not the only, or even the first time, NBC aired one of the mis-quoted versions.

According to Lexis-Nexis, the first airing was on NBC Nightly News on March 19, with Pete Williams reporting. Luciano was not on the show. It was the Nightly News version that was played during Luciano's March 20 segment (that TV Newser found and says contributed to her firing.) Here's the Nightly News transcript for March 19 and the clip that was played:

NBC have already had an internal inquiry.. admitted the "mistake"

I am sure there will be an out of court settlement.... great news.

Money for GZ and his defence.. also (perhaps) slow down some of the outrageous false reporting on the case.. as well as comments from many quarters.

I just heard an otherwise smart voice on FOX News say that George can't sue NBC for what one reporter did. Well wait a minute, that's absurd! Remember when 'one worker' sold an 'over the top' too hot cup of coffee to a woman who in turn won a billion-dollar lawsuit against McDonald's and won?

I'm surprised this otherwise normally smart reporter made such an absurd statement. We all know that if someone offends us, we can sue every single entity affiliated with that offender. And that's not to mention that every attorney goes after every deep pocket he can.

It is MORE than one reporter. The NBC inquiry and sackings have already shown that.
And this IMO is just one of MANY law suits that could be filed. I hope George and his team go after a lot more people.

George Zimmerman Update: Mark O’Mara Files Defamation of Character Suit Against NBC News?

In the latest development, Mark O'Mara says that he plans to file suit against NBC News for defamation of character of his client George Zimmerman, who is being charged for the murder of Trayvon Martin.

O'Mara is suing the broadcast network for airing an edited version of the 911-call Zimmerman made after shooting the 17-year-old. O'mara claims that the phone call was edited deliberately to make his client look bad.

"NBC intentionally edited George Zimmerman's non-emergency call to make it appear he is a racist, then they repeatedly broadcast that edited tape to the nation...What NBC did is outrageous. Due in large part to NBC's actions, George has had to live in hiding, in fear for his life," as reported by Fox News.

NBC spokeswoman Megan Kopf declined to comment. But three reporters involved in editing/airing the call have been fired.

The time to file this lawsuit is after George is convicted and executed. Then someone can PROVE he lost the case (and incidentally his life) because of NBC's testimony against him. Right?

I agree with others... that just contemplating this suit is an indication that O'Mara (and George) are more comfortable about the criminal case.

It is a good move to do it now.. it might make people at least pause before defaming GZ...

I do hope a few more suits follow :24

It shows a complete lack of understanding about scientific and logical investigations.
As well as a lack of understanding of what GZ has said about the gun (He never said TM got a hand on it or the holster)

As I have said before... finding evidence such as a finger print, DNA etc is an inclusive finding... If you find DNA you have a link with a person, but......

NOT finding DNA proves very little... other than you did not find DNA.
Perhaps you failed to collect what was there, or what was there was washed or wiped off, or even a person handled the evidence but did not leave any detectable DNA.

Such claims about time saving etc were thrown out, but clearly it's not. I think the sackings show that the individuals did "wrong".
IMO there is little doubt it was part of the common hysteria about GZ being a racist and at least fanned those flames.. and is part of what many people still think about GZ. I would say it did real damage to his reputation, and potentially might have some effect on this case (we hope not)... my guess is large 7 figure settlement out of court. I would hope that in addition to money... GZ will get some sort of public apology, explanation from NBC.. perhaps some REAL reporting on the case? Though I think that is expecting a bit much.

Hearing set for George Zimmerman's request to subpoena Trayvon Martin's school, social media

A new hearing has been set in George Zimmerman's second-degree murder case, during which his attorneys will ask a judge to allow them to subpoena the school and social media records of Trayvon Martin

Zimmerman's defense is also asking for a continuance. In a motion, the defense team writes that "at least 50-75" witness depositions must be completed in the case before it will be ready for trial.

The defense team also submitted its response to a filing by the state which referred to the requests for Trayvon's school records as a "fishing expedition." In one of several new filings, defense attorney Mark O'Mara writes that the requests are part of a "well thought out plan to focus on potentially relevant and admissible information."

O'Mara also noted that the state has gathered Zimmerman's high school records from Manassas, Va.

"Yet, when the same exact documents are requested regarding Trayvon Martin, the State denigrates the request as a fishing expedition," O'Mara writes. "The irony is rich."
