Case against Cliven Bundy, Nevada rancher involved in 2014 armed standoff, declared a mistrial A federal judge declared a mistrial Wednesday in the Nevada case against Cliven Bundy, his two sons and another man accused of leading a 2014 armed standoff with federal agents during a cattle grazing dispute. Chief U.S. District Judge Gloria Navarro in Las Vegas dismissed a jury seated last month for the long-awaited trial of Bundy, his sons Ryan and Ammon Bundy and self-styled Montana militia leader Ryan Payne. BUNKERVILLE STANDOFF: FRIDAY DEADLINE FOR WRITTEN ARGUMENTS, LEAD PROSECUTOR INVOLVED IN PREVIOUS MISTRIAL CASE Wednesday, December 27, 2017 This Friday (December 29th) is the deadline for written arguments to be submitted by prosecutors and defense attorneys to US District Judge Gloria M. Navarro. They are arguing whether Judge Navarro should make the mistrial she has declared in the third Bunkerville Standoff trial one with or without prejudice. A "with prejudice" ruling would mean that the government's charges against the defendants (Cliven Bundy, Ammon Bundy, Ryan Bundy and Ryan Payne) could not be refiled. A 'without prejudice' ruling would mean a new trial starting February 26th. Nevada judge dismisses case against Cliven Bundy and sons, says government cannot retry them By David Montero | Los Angeles Times | January 8, 2018, 10:20AM PT A federal judge ruled Monday that the federal government may not retry Cliven Bundy and his sons after rebuking prosecutors for withholding evidence during their felony trial stemming from an armed standoff four years ago. U.S. District Court Judge Gloria Navarro declared a mistrial in the case last month, saying federal prosecutors willfully withheld evidence that lawyers for the Bundys and alleged co-conspirator Ryan Payne should have had access to while mounting their defense. She said the attorneys were in violation of the Brady rule, which requires prosecutors to disclose evidence that could be favorable to a defendant, and told them it wasn’t possible to proceed with the case. On Monday, she dismissed the case “with prejudice,” meaning the government cannot retry the defendants. "A universal sense of justice was violated," Navarro said.
