Manafort defense seems to be "Gates did it".... Gates did transactions to cover up his own misdeeds embezzling money from Manafort (company) (Gates) embezzled millions of dollars from his longtime employer. He abused his position of trust," Zehnle insisted. "Rick Gates had his hand in the cookie jar, and he could not take the chance his gig would be found out." That seems like an excellent defense, since Gates has turned RAT to sing (and compose) for Mueller's pit-bull... Wiesman. Whether true or not... it is fair to propose alternative explanations... reasonable doubt. |

Prosecutor: Rick Gates may not testify in Manafort trial By Jeff Mordock - The Washington Times - Wednesday, August 1, 2018 In a shocking admission Wednesday morning, federal prosecutors said Rick Gates may not testify in the trial of his former business partner Paul Manafort. Mr. Gates, who oversaw some of the financial dealings of Mr. Manafort’s consulting business, was expected to be a key witness for the government. But prosecutor Uso Asonye said jurors may not hear from Mr. Gates after all. “He may testify, he may not,” Mr. Asonye told Judge T.S. Ellis III. The revelation sent journalists and others out of the courtroom to report the disclosure. “That’s news to me and about 25 others who scurried out of here like rats on a sinking ship,” Judge Ellis shot back. Mr. Asonye attempted to backtrack, telling Judge Ellis that the evidence presented will determine if Mr. Gates‘ testifies. That drew a sharp rebuke from Judge Ellis. “You know who you are going to call,” He said. “If you are going to call him then this is a waste of time.” The exchange occurred during the testimony of FBI agent Mathew Mikuska, who raided Mr. Manafort’s Alexandria, Virginia condo last year. While discussing some of the financial records seized during the raid, Mr. Mikuska began describing a document put together by Mr. Gates. Judge Ellis interrupted the testing to say the agent’s testimony is unnecessary because Mr. Gates will testify. U.S. District Judge T.S. Ellis III specifically told prosecutors to stop using the word “oligarch” to describe wealthy Ukrainians, whose dealings with Manafort are at the heart of the fraud charges he faces in northern Virginia federal court. The judge said the term has a “pejorative” meaning and is not relevant in this case. Further, he cautioned that using it could suggest Manafort is associated with bad people – and guilty by association. “It’s not the American way,” the judge said. Earlier today, the jury sent a note to the court and asked four questions. They also indicated they will be deliberating tomorrow. 4 questions the jury just asked
How the judge responded to the jury's questions Judge T.S. Ellis told the courtroom Thursday he would instruct the jury to rely on their "collective recollection" regarding their questions on "shelf" companies and foreign banking filing requirements. He would give them no further answers on those points. Regarding their question about "reasonable doubt" — the legal threshold for acquitting a defendant — he said that the prosecutors had to prove their case not "beyond possible doubt," but beyond "doubt based on reason." The jury had also asked if the court could match exhibit numbers to indictments. Ellis said the court could not amend the exhibit list. |

The jury's note to Judge T.S. Ellis said jurors would like to finish their deliberations at 5 p.m. ET Friday because one of them has an event tonight. The jurors' note and Judge T.S. Ellis' brief comments today suggest the jury will be back for at least another day of deliberations on Monday. Judge Ellis will bring the jury back in at 4:50 p.m. ET today. He will ask them what time they want to convene on Monday — 11 a.m. or 1 p.m. (Ellis usually starts court at 1 p.m. on Mondays.) They are scheduled to return at 9:30 a.m. ET Monday. |

Ellis also held a short bench conference with the lawyers — making it the third bench conference of the day. It looks to me like a HUNG jury at least on 1 count, likely more.
