Manafort defense seems to be "Gates did it"....

Gates did transactions to cover up his own misdeeds embezzling money from Manafort (company)

(Gates) embezzled millions of dollars from his longtime employer. He abused his position of trust," Zehnle insisted. "Rick Gates had his hand in the cookie jar, and he could not take the chance his gig would be found out."

That seems like an excellent defense, since Gates has turned RAT to sing (and compose) for Mueller's pit-bull... Wiesman.

Whether true or not... it is fair to propose alternative explanations... reasonable doubt.

Prosecutor: Rick Gates may not testify in Manafort trial

In a shocking admission Wednesday morning, federal prosecutors said Rick Gates may not testify in the trial of his former business partner Paul Manafort.

Mr. Gates, who oversaw some of the financial dealings of Mr. Manafort’s consulting business, was expected to be a key witness for the government.

But prosecutor Uso Asonye said jurors may not hear from Mr. Gates after all.

“He may testify, he may not,” Mr. Asonye told Judge T.S. Ellis III.

The revelation sent journalists and others out of the courtroom to report the disclosure.

“That’s news to me and about 25 others who scurried out of here like rats on a sinking ship,” Judge Ellis shot back.

Mr. Asonye attempted to backtrack, telling Judge Ellis that the evidence presented will determine if Mr. Gates‘ testifies.

That drew a sharp rebuke from Judge Ellis.

“You know who you are going to call,” He said. “If you are going to call him then this is a waste of time.”

The exchange occurred during the testimony of FBI agent Mathew Mikuska, who raided Mr. Manafort’s Alexandria, Virginia condo last year.

While discussing some of the financial records seized during the raid, Mr. Mikuska began describing a document put together by Mr. Gates.

Judge Ellis interrupted the testing to say the agent’s testimony is unnecessary because Mr. Gates will testify.

On Tuesday, Mr. Manafort’s attorneys accused Mr. Gates of being the mastermind behind the crimes lodged against their client.

Mueller team lectured by judge in Manafort case

Special Counsel Robert Mueller’s prosecutors were lectured by a federal judge on Wednesday for the language they’ve used in the courtroom and more, as the trial of former Trump campaign chairman Paul Manafort entered its second day.

U.S. District Judge T.S. Ellis III specifically told prosecutors to stop using the word “oligarch” to describe wealthy Ukrainians, whose dealings with Manafort are at the heart of the fraud charges he faces in northern Virginia federal court.

The judge said the term has a “pejorative” meaning and is not relevant in this case. Further, he cautioned that using it could suggest Manafort is associated with bad people – and guilty by association.

“It’s not the American way,” the judge said. He noted that wealthy donors like George Soros or the Koch brothers also could be considered oligarchs.

The judge is now hearing the standard “Motion to dismiss” from the Defense. (no case to answer)
I have never been watching a case where the Judge dismisses… but there is always hope :)

Prosecution case involved 10 days of testimony from 27 witnesses


Lead defense attorney Kevin Downing asked to have until tomorrow morning to put together his motion for acquittal, and Ellis agreed.

The jurors were called back to the courtroom shortly after 1:30 p.m., when they heard Manafort’s attorneys rest their case and say they would not be calling any witnesses. The defense lawyers had announced their intentions earlier with the jury out of the courtroom.

Lawyers from both sides are expected to reconvene at 3:30 p.m. to hash out jury instructions.

Closing Statements tomorrow.

Earlier today, the jury sent a note to the court and asked four questions. They also indicated they will be deliberating tomorrow.

4 questions the jury just asked

  1. They asked if Judge T.S. Ellis could "redefine" for them "reasonable doubt."
  2. They also asked two questions related to Manafort's tax filing and foreign bank account disclosure charges. The first question was whether a person is required to file a foreign banking disclosure if he or she owns less than 50% of a company and does not have signature authority over the account but does have the authority to disburse the accounts' funds.
  3. The second tax-related question was about the definition of a "shelf" company.
  4. Their last question was if the court could match exhibit numbers to indictments.



How the judge responded to the jury's questions

Judge T.S. Ellis told the courtroom Thursday he would instruct the jury to rely on their "collective recollection" regarding their questions on "shelf" companies and foreign banking filing requirements. He would give them no further answers on those points.

Regarding their question about "reasonable doubt" — the legal threshold for acquitting a defendant — he said that the prosecutors had to prove their case not "beyond possible doubt," but beyond "doubt based on reason."

The jury had also asked if the court could match exhibit numbers to indictments. Ellis said the court could not amend the exhibit list.

Manafort jury delivers note to court..... stand by...

The jury's note to Judge T.S. Ellis said jurors would like to finish their deliberations at 5 p.m. ET Friday because one of them has an event tonight.

The jurors' note and Judge T.S. Ellis' brief comments today suggest the jury will be back for at least another day of deliberations on Monday.

Judge Ellis will bring the jury back in at 4:50 p.m. ET today. He will ask them what time they want to convene on Monday — 11 a.m. or 1 p.m. (Ellis usually starts court at 1 p.m. on Mondays.)


They are scheduled to return at 9:30 a.m. ET Monday.

Paul Manafort's attorney Kevin Downing asked Judge T.S. Ellis to give the jury a new verdict form, after the jury said "we will need another form please" in their Tuesday note.
Ellis said he would not.
Downing said he wished jurors would be given a third option on the form -- a hung jury option for each count. The jury verdict form gives jurors only the options of not guilty or guilty for each of the 18 charges against Manafort.

Speaking for about five minutes, Judge T.S. Ellis told the jury: "You should not surrender your honest conviction" simply to reach a verdict.

A supplemental instruction given by the trial court when a jury has reached an impasse in its deliberations and is unable to reach a consensus.

The jury in the Paul Manafort trial has reached verdict on eight counts, but it can't reach consensus on 10 counts.

Manafort judge to interview jurors individually
Judge T.S. Ellis said he will ask each juror their feelings about reaching a verdict.
If they all say they cannot reach a verdict: Ellis says he would likely declare a mistrial on 10 counts and have the verdict read on the remaining 8 counts.
Both sets of attorneys said they agreed with this plan.
