HJC Ranking Member Doug Collins is running for a Georgia Senate Seat; within the republican House rules he must leave his ranking position on the committee. Today the House steering committee overwhelmingly picked Representative Jim Jordan to take over as the top ranking member on the Judiciary Committee to replace Doug Collins.

Mark Meadows will take over republican leadership of the House Oversight Committee for the remainder of the year replacing Jim Jordan. This is a smart move as Jordan will be in position to counter the efforts of Judiciary Chairman Jerry Nadler.

Federal judge indefinitely postpones sentencing of Michael Flynn


A federal judge on Monday indefinitely postponed the sentencing date for President Trump’s former national security adviser Michael Flynn on charges of lying to the FBI in the Russia investigation.

The move by Judge Emmet Sullivan comes a day after federal prosecutors filed a rare Sunday motion to delay a number of approaching deadlines that would ultimately make Flynn’s Feb. 27 sentencing unlikely. The delay also comes weeks after Flynn withdrew his guilty plea.

In their filing, prosecutors argued that Flynn’s former attorneys should testify after he claimed to have received ineffective assistance from them. Flynn had previously hired the premier D.C. law firm, Covington & Burling. Federal lawyers also asked the judge to order that Flynn has his attorney-client privileges in his communications with Covington & Burling waived.

“The government requests that the Court suspend the current briefing schedule concerning the defendant’s [motion] until such time as the government has been able to confer with Covington regarding the information it seeks,” prosecutors wrote. “While Covington has indicated a willingness to comply with this request, it has understandably declined to do so in the absence of a Court order confirming the waiver of attorney-client privilege.”

Flynn in January moved to withdraw his guilty plea for lying to the FBI in the Russia probe, citing "bad faith" by the government. That court filing came just days after the Justice Department reversed course to recommend up to six months of prison time in his case, alleging he was not fully cooperating or accepting responsibility for his actions.

"The prosecution has shown abject bad faith in pure retaliation against Mr. Flynn since he retained new counsel," Flynn’s attorneys wrote in the filing. "This can only be because with new, unconflicted counsel, Mr. Flynn refused to lie for the prosecution."

Lawyers representing Michael Flynn presented a strong argument today (pdf below) in reply to the governments’ continued efforts to refute prosecutorial wrongdoing.

Within the reply motion Sidney Powell highlights the conduct of prosecutor Brandon Van Grack and hypocrisy within the government arguments: “Mr. Van Grack’s contention that he satisfied the government’s obligations by providing this information before Mr. Flynn’s sentencing now proves the point that he suppressed it when it was most important to Mr. Flynn: before his guilty plea on December 1, 2017, and before what was scheduled to be his sentencing on December 18, 2018.”

Prosecutor Van Grack suppressed evidence to protect… “the prosecutors, his team, and the cadre of malfeasant FBI agents from the discovery of their negligence, crimes, and wrongs.”

WASHINGTON (AP) — The Justice Department on Thursday said it is dropping the criminal case against President Donald Trump’s first national security adviser, Michael Flynn, abandoning a prosecution that became a rallying cry for Trump and his supporters in attacking the FBI’s Russia investigation.

The move is a stunning reversal for one of the signature cases brought by special counsel Robert Mueller. It comes even though prosecutors for the last three years had maintained that Flynn had lied to the FBI about his conversations with the Russian ambassador in a January 2017 interview. Flynn himself admitted as much, and became a key cooperator for Mueller as he investigated ties between Russia and the 2016 Trump campaign.

In court documents being filed Thursday, the Justice Department said it is dropping the case “after a considered review of all the facts and circumstances of this case, including newly discovered and disclosed information.” The documents were obtained by The Associated Press.

The Justice Department said it had concluded that Flynn’s interview by the FBI was “untethered to, and unjustified by, the FBI’s counterintelligence investigation into Mr. Flynn” and that the interview on January 24, 2017 was “conducted without any legitimate investigative basis.”

Judge invites outside parties to weigh in on Flynn case, delaying DOJ effort to drop charges

A federal judge said Tuesday that he would allow interested parties to weigh in on Michael Flynn's case, delaying the Department of Justice (DOJ) effort to drop the charges against the former national security adviser.
In an unusual move for a criminal prosecution, Judge Emmet Sullivan of the D.C. District Court said in a brief order that "at the appropriate time, the Court will enter a Scheduling Order governing the submission of any amicus curiae briefs."

Flynn's lawyers moved to oppose the move Tuesday night, arguing that it would be inappropriate to allow third parties to weigh in on the prosecution.

"It is no accident that amicus briefs are excluded in criminal cases," Flynn's lawyers wrote in a filing. "A criminal case is a dispute between the United States and a criminal defendant. There is no place for third parties to meddle in the dispute, and certainly not to usurp the role of the government’s counsel. For the Court to allow another to stand in the place of the government would be a violation of the separation of powers."

The case was upended last week when the DOJ moved to dismiss its charge against Flynn for lying to the FBI about his conversations with the Russian ambassador to the U.S. in 2016.

The lead prosecutor on the case, who had been overseeing it since Flynn first pleaded guilty to the charge in 2017, withdrew shortly before the motion was filed last Thursday.

It's unusual for prosecutors to withdraw a case against a defendant who has already pleaded guilty. The move to allow amicus briefs offers critics of the DOJ's decision an opportunity to weigh in.

Sullivan, a Clinton appointee, still needs to approve the DOJ's motion to drop the charges. He has yet to schedule a hearing or ask for further briefing.

(CNN)Former Trump national security adviser Michael Flynn may not need to wait months for answers in court to the Justice Department dropping his case.

A three-judge appeals court panel ordered the trial judge overseeing Flynn's case, Emmet Sullivan, to explain by June 1 what the court should do with Flynn's emergency request to force the dismissal of his case.

The Justice Department, which is seeking to drop the lying charge to which Flynn pleaded guilty, is also allowed to chime in, the appeals court said.
