Swedish Court Injects Some Sense into the Assange Case

When, eight years late, the European Arrest Warrant request for Julian Assange was finally put before a Swedish court, the court refused to issue it.

Readers of this blog are amongst the very few people who have had the chance to learn that the original European Arrest Warrant for Julian Assange from Sweden was not issued by any court but by a prosecutor; that this was upheld in the U.K. Supreme Court despite the court’s open acknowledgement that this was not what the U.K. Parliament had intended by the phrase that the warrant must come from a “judicial authority;” and that the law had been changed immediately thereafter so it could not be done again.

Consequently, in seeking a new European Arrest Warrant against Assange, Swedish prosecutors had finally, eight years on, to ask a court for the warrant. And the court looked at the case and declined, saying that the move would be disproportionate. It therefore remains the case that there is no Swedish extradition warrant for Assange. This is a desperate disappointment to the false left in the U.K., the Blairites and their ilk, who desperately want Assange to be a rapist in order to avoid the moral decision about prosecuting him for publishing truths about the neocon illegal wars that they support.

Assange's father reunited with his son in emotional prison visit

The WikiLeaks founder was moved into a medical ward in prison several weeks ago after a sudden and dramatic weight loss due to an undisclosed illness, following his April arrest at the Ecuador embassy in London.

And concern for Assange’s mental state rose when his colleagues reported him unable to communicate with them during a prison visit.

Shipton said his son had undergone a “considerable change” since he last saw him: when they shared a Christmas dinner at the embassy at the end of last year.

Julian Assange extradition case 'outrageous assault on journalism'

Julian Assange's legal team have branded the US extradition case against him "an outrageous and full-frontal assault on journalistic rights", as a court ordered him to face a full extradition hearing next year.

The WikiLeaks founder is fighting being sent to the US to face charges related to the leaking of government secrets.

The case was opened at Westminster Magistrates' Court on Friday.

It came after an extradition request was signed by the home secretary.

By certifying the request on Thursday, Sajid Javid allowed it to be considered by the court.

WikiLeaks co-founder Julian Assange will face a new, full US extradition hearing in February that is expected to last five days, Westminster Magistrates' Court in London has ruled.

The hearing date was set after British Home Secretary Sajid Javid revealed on Thursday that he had signed and certified the US extradition order papers.

Assange's lawyer, Mark Summers, said the case represents an “outrageous and full-frontal assault on journalistic rights.''

Responding to the new hearing date outside the court, another lawyer representing Assange, Jennifer Robinson, said that Assange is "in a healthcare ward in Belmarsh Prison due to his ill-health."

The US Justice Department has filed 18 charges against the 47-year-old Australian journalist, including one count of conspiring with Chelsea Manning, the former intelligence analyst and whistleblower, to gain access to the US Pentagon network.

Sweden says it won’t appeal decision not to detain Assange over rape allegations

Top Swedish prosecutor says rape allegations against Julian Assange will continue to be investigated despite court ruling.

A Swedish prosecutor has decided to accept a court’s decision not to detain WikiLeaks founder Julian Assange, but warned an investigation into rape allegations will continue.

A Swedish court ruled this month that Australian national Assange, who is now jailed in Britain and accused of rape in Sweden, should not be detained. Assange has denied the 2010 allegation.

Sweden cannot request his extradition from Britain without a detention order and a European Arrest Warrant.

The ruling means that while Assange will not be extradited from Britain at this time, Swedish investigations can continue and he can be questioned in Britain.

New bar to all US extradition attempts (including Assange) - The Epstein Defence

Here is another angle on the Epstein suicide/murder/disappearance debacle:

If the US can't keep Epstein safe in prison, they can't keep anyone safe!

Thus no country should extradite non-US citizens to the US - it is a potential (or likely if you are high profile and disliked by authorities like Julian Assange) death sentence.
Nations without the death penalty cannot extradite to the US, were merely being held in jail prior to trial is a death sentence.
It is a severe human rights breach.

I expect to see the "Epstein Defence" being made to block every extradition attempt of non-US citizens to the US, including in the Julian Assange case.
Frankly, everyone with an extradition treaty with the US should be suspending it until the US can prove that it can fulfil its basic obligations to protect prisoners put into its care.

This episode reflects so badly on the US, it is almost impossible to overstate the damage done to its credibility as a nation with Rule of Law.

Swedish authorities have discontinued an investigation into a rape allegation against the WikiLeaks founder, Julian Assange, after a review of the evidence.

The deputy chief prosecutor, Eva-Marie Persson, said the complainant’s evidence was deemed credible and reliable, but that after nearly a decade, witnesses’ memories had faded.

“After conducting a comprehensive assessment of what has emerged during the course of the preliminary investigation I then make the assessment that the evidence is not strong enough to form the basis for filing an indictment,” Persson said. An appeal against the decision could be made to the office of Sweden’s attorney general, she added.

Group’s open letter calls for Wikileaks founder to be moved from London high-security jail to hospital

More than 60 doctors have written an open letter saying they fear Julian Assange’s health is so bad that the WikiLeaks founder could die inside a top-security British jail.

The 48-year-old Australian is still fighting a US bid to extradite him from Britain on charges filed under the Espionage Act that could see him given a sentence of up to 175 years in a US prison.

In the letter to the British home secretary, Priti Patel, the doctors called for Assange to be moved from Belmarsh prison in southeast London to a university teaching hospital.

They based their assessment on “harrowing eyewitness accounts” of his 21 October court appearance in London and a 1 November report by Nils Melzer, the United Nations special rapporteur on torture.

MADRID — This much has become clear in recent weeks: When Julian Assange, the WikiLeaks founder, was living in Ecuador’s embassy in London, someone was spying on him, recording his private conversations. The question is: Who ordered the surveillance?

Mr. Assange — in jail in Britain and facing prosecution in the United States — is scheduled to testify remotely later this month before a Spanish judge in a criminal case accusing a Spanish security company of eavesdropping on him illegally.

The Spanish court case has revealed a new set of secrets in the international saga of Mr. Assange, 48, showing that his claims of being spied on were not just paranoia or a publicity stunt. But as with all things related to someone who has been labeled a villain and a hero, a prophet and a crank, the revelations are subject to conflicting interpretations.

The prosecutor and Mr. Assange’s allies argue that the C.I.A. was behind the spying. A spokesman for the agency declined to comment.
