O'Mara bows out of Zimmerman v. NBC libel case
That suit is pending but stalled.

SANFORD – Orlando lawyer Mark O'Mara today took another step away from his most famous client, George Zimmerman, by bowing out of a libel suit against NBCUniversal Media.

O'Mara was co-counsel for Zimmerman when the former Neighborhood Watch volunteer sued the network broadcaster just over a year ago, accusing it of falsely portraying him as racist in five reports.

At the time, Zimmerman had admitted killing Trayvon Martin, an unarmed black 17-year-old, but had not been arrested, and the investigation was a major national story.

A few weeks later Zimmerman was charged with second-degree murder, but a Seminole County jury acquitted him last year.

His libel suit has sat dormant for 11 months. Both sides agreed last February that they'd do nothing until Zimmerman's criminal case was closed.

Although his criminal trial is over, the case is still technically open. That's because O'Mara and co-counsel Don West asked Circuit Judge Debra Nelson to impose sanctions against prosecutor Bernie de la Rionda, accusing him of hiding evidence and creating delays.

Nelson presides over Zimmerman's libel case as well. She called today's hearing, saying she'd received a letter from Zimmerman's main libel lawyer, James Beasley Jr. of Philadelphia, saying there were no pending matters in the criminal case, so it was time to move forward.

O'Mara did not appear in court today, but a lawyer from his firm, Lorna Truett, took part by phone.

The judge asked her if her firm was withdrawing its motion for sanctions, and she said she was unsure.

Based on that, the judge ruled the libel case cannot move forward.

The one piece of business the judge was able to accomplish today was to remove O'Mara, at his request, as one of Zimmerman's libel lawyers.

O'Mara began distancing himself from Zimmerman a few months after his acquittal, announcing that he would not represent the former Neighborhood Watch volunteer following two separate domestic violence complaints.

I'm having some trouble with the non-logic behind judge nelson's ruling. The motion for sanctions was already made and nelson was the one who deferred ruling on it until after the criminal trial. Now nelson says nbc cannot move forward because the sanctions have not been addressed yet she is the one who deferred the ruling and never addressed it. Now once again she wants to make her negligence somehow the fault of mark omara and don west.

Sometimes :94 Not only is it amazing that there are such "games" played... but the people doing it are so blatant. Don't care that the game is up and they are exposed... they just bluff it out until it "goes away"

Any fool could see what Bernie was doing with discovery the cell phone stuff in particular. The hearing was even underway. It should have been dealt with before the trial proper. Given that things were proceeding with the trial.. another day or two to complete the santions hearing was unimportant. And even accepting the delay until after the trial... after the trial did happen... so why not the completion of Sanctions with Nelson presiding? And even if some delay is accepted (for sake of argument) and accepting it is a good idea for Nelson to recuse herself, since she is somewhat involved herself... then why not a new Judge and some urgency?
The answer to those (largely) rhetorical questions has got to be some level of corruption in the way things are dealt with by the very people involved. As I say not hard to imagine that happens, but you would expect it to be clandestine... once exposed the game is up. But its not? They just keep on with it. :wall

But... at least we know what the (nominal) excuse is for the NBC suit stalled.

could they still possibly be holding out for Ben K case? That is my hope. Would be kinda foolish in a way, maybe foolish isn't good word... but I believe after Ben K case resolved, then that would give better fire power against Ole Judge Nelson.. know what I mean? If Ben can prevail... Nelson aint got a snowballs chance in hell..
