Pre-trial matters

Prosecutor Richard Mantei says a witness won’t be available.

O’Mara agrees to take the witness’ deposition, but has concern not all the relevant issues with his testimony will be addressed.

Judge Nelson says the motion is to perpetuate the witness’s testimony.

The witness will be gone from June 24 to the middle of August.

Judge Nelson says O’Mara would be taking the witness’s trial testimony.

She rules to perpetuate the witness.

O’Mara asks for any opportunity to depose him before that.

Defense attorney Don West addresses the judge.

She says she has an order from June 5, 2013 on state’s motion in limiting hearsay statements of the defendant.

West says at the time of the hearing, May 28, he told the court he agreed the self-serving hearsay statements would properly be excluded. West mentions res gestae statements. He says they are not excludable under the motion.

Judge Nelson it should only be fair that the other side know the statements being discussed.

She suggests West have a short conference with the state. West agrees.

Prosecutor Bernie de la Rionda and West move to a witness room.

O’Mara addresses the motion for sanctions against the state. He mentions a report given to the state by an employee. He says the judge reserved on the sanction thinking he only sought financial, but he says that if he had the information back in November…

“Just get to the point,” Judge Nelson says.

O’Mara says he is asking for relaxation of the authentication rules for what was on Martin’s phone.

Mantei says he disagrees with O’Mara’s representation. He says he doesn’t know that it was established that there was a report, but rather work product.

Mantei says there are barriers to such evidence.

O’Mara says he wants the state responsible for its actions. He should not be held to the strict authentication requirement.

Judge Nelson says she doesn’t know what the state intends to introduce. She says she will take the authentication issue up with other objections.
