Would not the prosecution (& all who responded to the writ) have to formally waive any appeal of the DCA Opinion before the defense can even consider scheduling the deposition prior to July 2?

Right off the bat this trial is unfair. Neither side had a completed copy of the jury questionaire this morning. Judge Nelson was still adding to it, according to Pipitone. Someone is in a big rush to get this trial over and done irregardless of one's rights.

Nelson is the Judge... she can do anything.

So long as Crump is deposed, nothing in DCA opinion said anything about a stay of proceedings, while they get around to it.

Going on two hours now, and all that's been accomplished is 21 potentional jurors have questionaires.

Did they do any sort of obvious elimination I wonder?

Like ask the whole 500 (or however many are there today)..." have you posted on any blog or forum or comments section about this case?" That would filter out a LOT of time wasters.

Then the reality is that in many cases the DISCOVERY could come after the trial is over, the same DISCOVERY that DCA ruled cannot be addressed post-trial. Imagine that happening in this case!

Wonder how much has been wasted on the extra security?

I think the security will be needed once the sides have rested and the jury is deliberating on whether or not the state met it's burden of proof.
