Owen is asked what he knows about Dr. Nakasone. Owen says he has appeared on opposing sides as Dr. Nakasone before.

Mantei finishes his rebuttal.

4:13 p.m.
West objects to the questioning on hearsay.

Mantei says Owen only admitted he could not program the software. He says he should be allowed to respond to previous testimony.

Judge Nelson rules Mr. Owen cannot testify about a conversation because Mr. West can’t cross-examine him.

Mantei asks Owen about the testimony of Dr. Wayman.

West objects that Wayman’s testimony is being mischaracterized.

Mantei is allowed to clarify the document at issue which he says was referenced as a "Tom Owen Report."

4:08 p.m.
Zimmerman has waived his right to appear for the Frye hearing. He has been excused to leave.

Attorney Richard Mantei is questioning Tom Owen via video conference.

Judge Nelson asks if Mr. Owen is available.

Prosecutor Mantei says some set up is needed. Court is in recess for 15 minutes.

haha, god Owen is soooo unprofessional. He needs to realize there are procedural peculiarities and sometimes testimony does have to stop and start again.

of course, Nelson is being absurdly pro-Owen.

Owen says the year was 1999. He says voice ID was allowed, but it didn’t go to trial because the person took a plea. He adds that he did the test and the “person was guilty.”

West asks if he used the software used in this case.

Owen says no one used easy voice in 1999. “It wasn’t available,” he says.

West finishes.

Judge Nelson says by the rules of evidence the cross is limited.

West asks what case Owen has testified in that Dr. Nakasone did to.

Owen says the last case was in Florida before Judge Moore in Miami federal court. He doesn’t remember the date, but it was a while ago, he says.

Owen expresses frustration at not being able to finish his answer.

West says the answer is “not responsive.”

West asks the question again.

Owen says the Florida case was an admissibility hearing and preliminary.

Judge Nelson says he can finish his answer.

West wants to ask him the year of the case.

He says it was in the 1990s.

Mantei asks that Owen be allowed to finish the answer he was giving.

West objects because Owen has said he has only used the software for a year or so.

Judge Nelson says that was not the question and he may answer the question.
