No....remember when Judge Lester took forever to decide whether or not to give George bail? He just took himself a little vacation and came back with less than real good news. He knew what he was going to do his first vacation day. I don't think Lester is going to back down on anything related to his adjudicating this case. He's there to stay....to help the prosecution.

Trying to think positive......

At least it is on record that GZ team think he is biased.. so... maybe he will have to try hard to not prove them right.... and get the whole mess aired at an appeal hearing.

So he will grant SYG?

Defence have 9 DAYS to file a response to O'Mara's Petition

The due date is August 23. It says the the case will not be stayed between now and August 23.

The order says "writs" rather than "writ." I think that means two writs issued, one to Judge Lester and one to the state. I assume the "w/o reply" means the defense cannot file a reply to whatever Judge Lester or the State files in response, but I'm not entirely clear on that.
The Orlando Sentinel reporter says the state was directed to reply, but I'm not convinced the court wasn't also so directed.


So... perhaps Judge Lester gets to make a submission to the appeals Court as well?

The appeal curt response stipulates:

On or before Thursday 23rd August 2012 by 5:00 PM

Of course the actual ruling by 5dca will be some time after that.

George Zimmerman: State Files Response on Recusal of Judge

The state has filed its response in the 5th Circuit District Court of Appeals to George Zimmerman's request for a Writ of Prohibition seeking to have Judge Lester removed from the case.

Shorter version:
The judge gave Zimmerman a well-deserved tongue lashing, but his fear he won't get a fair trial from the judge is not objectively reasonable, and thus his motion to recuse was not legally sufficient and Lester was right to deny it.

The state says Zimmerman's fear was not objectively reasonable. Put yourself in Zimmerman's shoes: The issue is how he feels, and whether his fear is reasonable. Would you, if you were George Zimmerman, fear not getting a fair trial before Judge Lester? I think any reasonable person would have that fear. We'll see what the 5th Circuit says.

GZ is not invoking SYG.. simply because it does not apply... it is a case of simple self defence (as I said from the outset).

GZ can still seek an "Immunity hearing" ... which he should win without any bother.

There is no evidence to refute his version of events. He should never have been charged.

Judge Lester is clearly biased against GZ??? I think he should recuse himself and the Appeal Panel should tell him to do just that.
But....... I have learned not to bet on Judicial decisions in Florida.
