“Admissibility”, that’s the key question behind the State of Florida attempting to keep the toxicology report on Trayvon Martin out of the courtroom. Bernie De La Rionda (prosecution) wants to keep the jury from hearing about young Martin’s stoner proclivities. Mark O’Mara (defense) feels the jury should know about Trayvon’s illegal drug use.

What’s more interesting, at least to me, is how O’Mara uses his response to share “NEW”, previously unknown, discovery evidence. Well played.

It is common in cases I have watched that DEFENSE try to block "prejudicial" evidence about their client.... naturally... especially when the guy is guilty... but usually stuff is "prejudicial" simply because it is EVIDENCE proving a guilty client "did it".

A bit of a reverse situation here... especially for the feeble minded Traybots who have already decreed that "little Trayvon" is the "Victim". In respect to drug use..... clearly Trayvon is the "perp", and so what is claimed to be "prejudicial is simple what is known in the "True Crime" trade as...... EVIDENCE!! :D

Weed could have made Trayvon paranoid and violent. Don't think Nelson can properly exclude toxicology in view of GZ's statement that Trayvon looked like he was on drugs.

Not sure why the defense didn't cite any case law. Perhaps because Diaz v. State, cited by the state, actually supports the defense position: toxicology evidence is admissible to bolster the defendant's perception that the victim appeared intoxicated.

We finally have a picture of the photo button Trayvon had on. Looks like CTH was right about who was on it.

Finally got to see the infamous Skittles bag etc.

The .zip file of the May 6 photographs is broken, for me anyway... let me know if anyone manages to get it working. I've downloaded it like thrice, and it just isn't opening. Faulty archive. Let's hope they fix it.

I don't think the toxicology results will come in if the only relevance is to show TM was impaired. Perhaps they should, but the DCA's have not indicated disfavor with the trial courts excluding 0.21 blood-alcohol levels except when some other relevant factor was shown. In one case it was the defendant testifying he knew the victim to be violent when drunk, which increased his apprehension of the victim. In the other, it was the prosecutor mocking the defendant's qualifications for testifying the victim appeared to be high. The court said the state couldn't withhold the toxicology results, and then use the denial to attack the defendant's testimony. The second case's analysis will, I think, apply if BDLR attempts to use GZ's NEN call comment that TM appeared to on drugs a evidence that GZ incorrectly profiled TM.

I think it may actually work. I thought it didn't work, but then noticed the PART file was getting bigger and bigger. Eventually, the whole thing was there. The download can take a while.

EDIT: I think I'm talking about the wrong file. I was referring to the large FDLE evidence photo file.

I agree MJW..... I tried to delete... but it was "being used" after quite some time it was transmographied into a working zip file... a LOT of large (hi res) pics... so takes a while to download.

I looked at the photos taken by defense at FDLE. Things I found interesting:

stains on Trayvon's pants perhaps consistent with straddling GZ and having knees in dirt / grass

ambiguous notation on evidence bag containing lighter, button, headphones, skittles as being found "in the victim's pockets or in close proximity"

Skittles are original flavor, not wild berry

GZ was wearing some kind of weird designer jeans with what look like intentional horizontal wrinkles and designs on the back pockets.

There is a white evidence tag with blue ink handwriting stapled to a grey shirt with two rusty staples which indicate that it might have been stored while wet.

The marked Google Map drawing - shortcut my azz, TM walked around approx 3 sides of a square instead of just walking across one side of the square.

I think the wild berry gave rise to the name "Purple drank"... but I am SURE that it would make no difference to the effect of the drug.. which would be from the cough medication

Viewed the 5 photos submitted in defense discovery 2 at Nettles. I knew O'Mara West would be showing a comparison of the height of Martin to the store clerk and assume he will be using it to compare Martin and Zimmerman height. I won't be surprised to see the clerk on the stand. I expect to see the clerk and Zimmerman's standing side by side in the Courtroom. That "little boy" myth is up in smoke. Hope Mary and Selma are testifying too particularly about the young little boy voice. Martin looks nothing like the face put on the TShirts.
