Drew Peterson Jury Picked

It's the second day of jury selection for the Drew Peterson murder trial.

The 12 jurors who will decide Drew Peterson's fate have been selected.

Five women and seven men were picked for Peterson's murder trial, which is set to start July 31. One alternate juror also was chosen.

Judge Edward Burmila will preside over the selection of the other three alternates this afternoon.

Jury selection finished in Drew Peterson murder trial

Drew Peterson’s attorneys exulted over the composition of the seven-man, five-woman jury they finished selecting Tuesday to decide whether former Bolingbrook cop Drew murdered third wife Kathleen Savio.

“It’s a great jury, perfect,” defense attorney Joe Lopez said.

Among the four jurors added Tuesday morning were a soon-to-be retiree and a secretary who heard her co-workers discuss whether Hollywood star Rob Lowe looked like Peterson while portraying him in a TV movie earlier this year.

Four alternate jurors — one woman and three men — also were selected Tuesday.

Lopez and other members of Peterson’s legal team praised the diversity of a panel that represents a wide range of ages and ethnic groups, including two African-American jurors and a Hispanic juror.

“That’s an exact mirror of the people who live here,” Lopez said.

Jury selection complete in Drew Peterson murder trial

Jury selection is complete in the Drew Peterson trial.

A panel of 12 jurors and four alternates will decide whether or not Peterson, a former Bolingbrook police sergeant, is guilty of drowning his third wife, Kathleen Savio, in her bathtub in 2004. Opening statements are scheduled for July 31.

The jurors were picked over two days at the Will County courthouse in Joliet and the selection process finished this afternoon. The jurors include a former law school student, a grandmother who went to extreme lengths to avoid coverage about the case, and a woman who said she’s a regular consumer of tabloid magazines.

Jurors were identified only by number in the courtroom. Their answers to attorney questions provided a few other details. Some of the panel includes:

* A radio broadcasting major at Columbia College who lives with his parents.
* A Lockport man who has been married for 15 years.
* A male plant manager for a printing company.
* A man from Plainfield who once owned a construction company.
* A secretary who describes herself as an "avid poet." She divorced in the 1990s and wrote on her questionnaire "all divorces are unhappy" in response to a question about the nature of the breakup. She likes to read true crime stories.
* A crossing guard from Lockport who said she likes to read mysteries and usually is able to solve them before the end of the book. Asked if she would try to do the same in the Peterson trial, she responded, "No. You have to wait 'til the end."
* A Joliet bus driver who lives with his parents.
* A New Lenox woman who stated on her juror questionnaire that she reads the National Enquirer, but when asked whether she believes what's in the tabloid, she smiled and said, "No."
* A divorced man who was a law school student for about a year and a half before dropping out.

CHICAGO (FOX Chicago News) -

Drew Peterson's judge on Thursday said he will order the divorce attorney for Peterson's late third wife to testify - about a conversation Kathleen Savio allegedly had with a prosecutor before her 2004 drowning death - during Peterson's trial for murder next month.

Judge Edward Burmila met privately last week with attorney Harry Smith to discuss conversations Smith had with Savio before she died, and to determine which of those conversations should be allowed as evidence at Peterson's trial.

Defense attorneys said this ruling could help them even though they had fought against allowing the testimony. They acknowledged that the judge did not say specifically what the attorney would be ordered to testify to. But they said Will County Judge Edward Burmila's comment that Smith must testify about "inculpatory" statements that Savio made suggests to them Savio lied under oath.

Drew Peterson appeared with close-cropped hair and completely clean-shaven in court on Monday and Tuesday–the first time he’s been seen without the signature moustache in at least five years.
During a break in jury selection Monday, a Tribune reporter asked Peterson’s lead defense attorney, Joel Brodsky, if the sartorial change was so the defendant looks a little less like the Drew Peterson who has been in the news the last five years.

“Why would I do that?” Brodsky said with a smile. “Somebody would have to be thinking, on the ball to do something like that.”

Murder or accident? Jury finally to hear the evidence in death of Peterson’s third wife
BY DAN ROZEK Staff Reporter - July 20, 2012

Drew Peterson’s third wife, Kathleen Savio, was found dead in her bathtub on March 1, 2004, while she was involved in a bitter battle with her ex-husband over their financial assets after their divorce.
Her death initially was ruled an accidental drowning, but authorities opened a new investigation and exhumed her body in 2007, after Peterson’s fourth wife, Stacy, vanished.

This time, authorities classified Savio’s death as a homicide. Drew Peterson was arrested on May 7, 2009, and charged with murdering his 40-year-old former wife.

The Death
Though Savio’s body was found in a dry bathtub, authorities concluded she had drowned before the water emptied through a leaky drain. But bruises and an inch-long cut found on Savio’s head couldn’t have been caused by a fall in the bathtub, indicating instead that she had struggled with an attacker, prosecutors contend, though Judge Edward Burmila so far has balked at allowing them to bring the bathtub into the courtroom to show jurors who will hear the case.
Defense attorneys said Savio died in a simple slip-and-fall accident while bathing alone in her home while Peterson had custody of their two children for the weekend.

The Motive
Drew Peterson was determined to keep Savio from getting as much as half of his $72,000 annual police pension, prosecutors contend. Peterson, who retired in 2007 after 29 years as a police officer, also feared he would lose the family’s Bolingbrook home to Savio in the divorce settlement, prosecutors have argued.
Peterson, who already had been through divorce proceedings twice before, was willing to fight Savio in court over the former couple’s finances, defense attorneys have said, dismissing the divorce as a possible reason for Peterson to kill his ex-wife.

“It’s an easy copout,” defense attorney Steve Greenberg said. “It’s just wishful thinking because they can’t accept it was an accident.”

The Evidence
Prosecutors’ circumstantial case against Peterson rests largely on hearsay statements that Savio and Stacy Peterson reportedly made to other people about threats and actions Drew Peterson took against them.
Several statements from Savio seem certain to be used as evidence, including her handwritten account to Bolingbrook Police of a July 2002 clash with Peterson in which he allegedly threatened her, as well as statements she made to her sister and to a friend that Peterson warned he could kill her but make her death look like an accident.
Another crucial piece of evidence prosecutors likely will use is a purported statement by Stacy Peterson, in which she told her minister that Peterson ordered her to provide him an alibi by telling police he was home with her on the night Savio died. The Rev. Neil Schori also testified that Stacy Peterson described how she saw her husband return to their home late that night, dressed all in black.
But other statements allegedly made by Savio and Peterson that seemingly bolster those claims still might be barred from the trial by Burmila if he deems their reliability to be suspect.
Those include Stacy Peterson allegedly telling friend Scott Russetto a similar account of being ordered to lie by Drew Peterson that he was home the night Savio died, and a purported account she made to a co-worker and to another friend of being threatened by a knife-wielding Peterson inside her home.
Defense attorneys have long dismissed all the statements as unreliable or concocted by people who hate Peterson.

The Witnesses
Crucial witnesses are expected to be Schori, a clergyman who counseled Stacy and Drew about their marriage, as well as Anna Doman, Savio’s sister, who allegedly talked with her about being threatened by Peterson.
Dr. Michael Baden, a celebrity pathologist and Fox News consultant who conducted an autopsy of Savio, then announced she had been murdered, is expected to be one of several experts to testify Savio couldn’t have accidentally died in the bathtub.
Defense attorneys also will call pathologists to rebut that testimony, and may call one or both of Savio’s teenaged children with Peterson, who were with their father on the weekend Savio died

Thanks for all the links, Rumpole! I also read that the defense wants to put Stacy on their witness list. Why on earth would they want to draw attention to the fact that she's missing when she doesn't show up? :94

I thought they definitely HAD put her on the witness list.

I would say (obviously) they HAVE to keep up the pretence that she is alive and has run off... and not that Drew killed her as well.

I didn't have a link to confirm it. I heard on Judge Jeanine's show last night their explanation that they can't add her name once the trial starts so they put her on in case she shows up. Are they dreaming???!!! :11

They have no eyewitnesses, no confession and no DNA to show ex-Bolingbrook cop Drew Peterson killed Kathleen Savio — only disputed secondhand statements and conflicting autopsy reports.
That limited, sometimes contradictory, circumstantial evidence means Will County prosecutors are going to have a hard time convincing jurors the now 58-year-old Peterson murdered his third wife, legal experts say.

“I think it’s really going to be tough for the state,” said attorney Paul DeLuca, a former prosecutor in Cook and DuPage counties now in private practice.

“The prosecution is going to have an uphill fight,” agreed Sam Amirante, who defended serial killer John Wayne Gacy and later served as a Cook County judge.

Perhaps the biggest hurdle for prosecutors is that Savio’s 2004 bathtub drowning death — which occurred while she still was fighting with her ex-husband over their finances — initially was ruled an accident.

It was an interesting discussing on Fox News last night with Judge Jeanine and DP's lawyers. It seems the main point of their defense though is for the state to absolutely prove she was murdered in the first place.

The murder trial of former Illinois cop Drew Peterson could hinge on the statements of two women who won't be at that trial: his third wife he is accused of murdering and his fourth wife who has disappeared.
Kathleen Zellner, a Chicago attorney who has been following the case, noted that the prosecution is expected to try and use statements that Stacy Peterson made to her minister before her disappearance, in which she said that Peterson had admitted to killing Savio. If the judge admits the hearsay statements of Stacy Peterson, the testimony could be damaging to Peterson, she said.

"What the judge is going to do is he's going to wait and make individual rulings each time the prosecution tries to introduce hearsay, not give a blanket ruling, but listen to see if they open the door in some way that makes the hearsay admissible. He'll make this a day by day ruling on these different pieces," Zellner said.

"Essentially we've got Peterson confessing the murder of Savio to his fourth wife, but we still have the question of whether that will come in," Zellner said.

Prosecutors will also try to admit Stacy Peterson's statements to her minister that she saw Drew Peterson arrive home with women's clothing around the time of Savio's death.

Savio's sister may take the stand to describe Savio's statements that Peterson threatened her with a knife and said he could make her death look like an accident.

Drew Peterson loves to talk about himself, but the Will County jury that will decide his fate probably won’t hear a word from him during his murder trial.
While Peterson’s attorneys are publicly coy about whether he’ll testify, sources say the cocky, wise-cracking former cop likely will keep his mouth shut and let his lawyers do the talking.

That’s a smart, safe move, say legal experts not involved in the trial.

With prosecutors forced to rely on limited circumstantial evidence, there’s no reason for the often-abrasive Peterson to risk irritating the jurors chosen to determine whether he drowned Kathleen Savio in 2004.

“There’s no upside. If you put him on and they hate him, that could push it over the edge,” said attorney Brian Telander, a former Cook County prosecutor and DuPage County judge.

Nearly five years since the disappearance of his fourth wife, former Illinois police officer Drew Peterson will be tried for the murder of his third wife in a high-profile case that gets under way Tuesday.
An Illinois court will hear opening arguments Tuesday in the case against Peterson, 58, who is charged with the 2004 death of his third wife, Kathleen Savio. Her death was ruled accidental until police began investigating the 2007 disappearance of his fourth wife, Stacy Peterson.

Kathleen Savio's stepmother, Marcia Savio, seemed upset that Drew Peterson's defense attorney was attempting to make Peterson look like a victim at trial.
Defense attorney Joel Brodsky in his opening statement called Kathleen Savio "bonkers" and "crazy" and said "she lies and makes up stories to fit her purpose."

CHICAGO (FOX Chicago News) - Drew Peterson's murder trial began Tuesday with dueling stories.
Prosecutors gave jurors an account that could have come from a 1940s pulp novel, in which a man does whatever he must -- including murder -- to keep his ex-wife's hands off his money.
On the other side, Peterson's attorneys argued the former cop was a victim of something newer: a 24-hour news cycle and cable TV's talking heads, which together created a media frenzy that did not subside until prosecutors had charged an innocent man.
The former Bolingbrook police officer's murder trial began Tuesday.
