9:25 a.m. Defense complains about coverage
TV news coverage of the case has chafed the defense team.
One of Drew Peterson's attorneys, Steven Greenberg, complained about "media pundits" who over the weekend "ripped" Judge Edward Burmila for siding with the defense. Greenberg noted Burmila ruled for the defense and prosecution throughout the first week of the trial.
"Unfortunately, people are used to judges who are pro-prosecution," Greenberg said. "The judge is supposed to be the umpire, he's supposed to go down the middle."

9:15 a.m. Defense files motion over second autopsy
The defense filed a motion about potential testimony from Dr. Michael Baden, who performed an autopsy on Savio's body when it was exhumed following the disappearance of Peterson's fourth wife, Stacy.
Defense attorney Steven Greenberg cited a television interview in which Mark Fuhrman, the former Los Angeles police detective who led the O.J. Simpson investigation, said he and Baden had discussed the case before the autopsy.
"He was on 'Judge Jeanine' and said how he and Baden decided this was a homicide before the exhumation and before they performed the autopsy," Greenberg said.
Another defense attorney, Joel Brodsky, said Baden was paid by Fox News to perform the autopsy. "If there's no murder, there's no story" for Fox News, Brodsky said.
It was not clear prosecutors plan to call Baden as a witness.
A spokesman for the prosecutors, Charles Pelkie, announced the witness list for today: Michael VanOver, a Will County deputy coroner who was at Kathleen Savio's house; Robert Deel, the Illinois State Police investigator who led the initial death investigation and ruled Savio's death an accident; Patrick Collins, who investigated the case with Deel; Will County Coroner Patrick O'Neil; and Bolingbrook police officer James Coughlin.

2:50 p.m. Pathologist said Savio wasn't murdered
Robert Deel testified that Dr Bryan Mitchell, the pathologist who performed the original autopsy, told him that Kathleen Savio’s death was not a murder.
"He told me her death was not a homicide," Deel testified.
Defense attorney Joel Brodsky asked Deel if Mitchell, who died two years ago, had ever wavered in his belief.
"No," Deel replied.

9 a.m. Defense awaits ruling on striking testimony

Entering the courthouse this morning, Peterson attorney Steven Greenberg downplayed the impact of Tuesday's testimony by Bolingbrook police Lt. James Coughlin.

Coughlin testified that he bumped into Peterson at the Will County Courthouse and the two talked about his divorce from Kathleen Savio. Peterson said, "My life would be easier if she was dead — or died, I don't recall which word," Coughlin testified.

Not sure if it's a Chicago area thing but I've heard a lot of people say things like they'd be better off if the spouse was dead, or even say things much worse but after years and years no. one was killed. But combining that with the so-called idea of trying to hire a hit man which the pros slipped in for the jury to hear throws up the red flags.

Heck if I had disappeared the law would have probably dug up the cement where my husband had enlisted contractors to do major construction. But uh then on second thought my family would probably not report me missing so as to enjoy freedom from nagging the rest of their lives. heh heh But combining that with the so-called idea of trying to hire a hit man which the pros slipped in for the jury to hear throws up the red flags.

Not just a Chicago thing... I can easily imagine a guy "jokingly" making a comment like that.. especially in the midst of a divorce or other attack by hungry lawyers. AND Drew Peterson is famous for joking around and making comments. As a single event it proves nothing, but as you say its one brick to be added to others (hit man etc) to build a circumstantial case.
Trouble is... some of those bricks are inadmissible. What there is does not look like proof beyond reasonable doubt to me.

August 8, 3:15 p.m. It would appear that many of the prosecution's witnesses never spoke up about any concerns or questions they may have had surrounding Kathleen Savio's death.

Testimony today from a state investigator indicated that he made some observations regarding Drew Peterson's demeanor in an interview but never put it in his report.

Yesterday, a Will County Deputy Coroner testified that he thought the scene was suspicious but again didn't mention his concerns, to his superiors or anyone else.

August 8, 4 p.m. A frustrated Judge Burmila telling Prosecutor Griffin that Judge White has already ruled on the hearsay statements: "You are telling me now that I can ignore all that." He reminded her that prosecutors asked for the hearsay hearing in the first place: "Who makes the decision on whether the wall is purple."
Fireworks in the courtroom. Will County State's Attorney James Glasgow stood up in the courtroom to his assist a member of his team in arguing for the hearsay statement. A usually mild-mannered Glasgow could not contain his anger and yelled loudly at the judge.
Saying the appellate court would have to be "morons" if the case was sent back automatically banning all statements under common law, Glasgow screamed: "It's you! Not the rulings of Judge White that determines whether Kristin Anderson should take the stand," screamed Glasgow.
Making a clear reference to James Glasgow loss of temper in the courtroom, Judge Burmila said "The volume of their argument is unpersuasive."

Drew Peterson trial updates: 'Why don't you just die?'



12:05 p.m. Witness admonished by judge

The trial recessed until 1:15 p.m. for lunch after the cross examination of Mary Parks.

Parks admitted she misspoke when she said she was taking a pharmacology class with Kathleen Savio in fall 2003 when Savio told her about the threats and showed her the marks on her neck.

She said she actually took the class the year prior, but stood by her testimony that Savio's remarks came just months before her death.

After several contentious back-and-forth questions with defense attorney Steve Greenberg, Parks was admonished by the judge that she was not to ask questions, only answer then.

Much of the cross-examination centered on differences between her testimony and her statements to a state police investigator in 2008, which do not record her making any mention of Peterson's alleged threats.

"I am not responsible for what she wrote in her report," Parks said. "I was not given an opportunity to review it for accuracy."

Parks will take the stand when the trial resumes for re-direct this afternoon.

August 9, 11:45 a.m. Under cross-examination, Steve Greenberg pressed Parks about her previous grand jury testimony where she said Kathleen "felt" Drew would kill her and make it look like an accident. "He never said it, did he?" said Greenberg. Parks said she couldn't remember exact words, but that is what Kathleen told her.

Savio and Peterson's son stops by courtroom

August 9, 2:09 p.m. The trial has not resumed as of 2 p.m. Attorneys in private discussions.

August 9, 1:55 p.m. State Pathologist Larry Blum, who conducted the 2nd autopsy on Kathleen Savio, the one after she was exhumed, is expected to take the stand shortly.

August 9, 1:42 p.m. Drew Peterson and Kathleen Savio's son Kristopher stopped by the courtroom after lunch and briefly chatted with his father. Drew was heard wishing his son a happy birthday and then told him he didn't want to stick around to "see these pictures."

Pathologist Larry Blum expected to testify next.
