Nel: 'Would new love have impacted on his emotions?'

Prosecutor Nel asked Dr Hartzenberg whether it was important that Pistorius may have found a new love?

Dr Hartzenberg: "It would have been important if it impacted on his emotional and psychological functioning."

Nel: "Why did you not follow up on it?"

Hartzsenberg: "Because it wasn't brought up in the therapy session.

"I deal with what he brings to the session and we work around that."

Nel: "You thought it was important that he found a new love, why didn't you deal with it?"

Hartzenberg: "I don't know what sort of relationship he had with the person. I'm not even sure of her name."

Nel: "Would it have impacted on his emotions?"

Hartzenberg: "We never discussed it so I do not have an opinion on it."

10:35 am
Hearing restarts with Dr Hartzenberg back in the box

Prosecutor Gerrie Nel is questioning Pistorius' psychotherapist Dr Hartzenberg.

Nel: "Was Pistorius in another relationship.

"Have you read that he was involved with someone else.

"As a trauma counsellor your client has now found a new lady friend."

Hartzenberg: "I think this trial has prepared me when I read the media to ask myself some questions while I read it.

"But I did read it in the media.

"He did not discuss it with me. As a psychotherapist, what your client brings to the session is what you deal with."

Nel: "You did not discuss it with Pistorius that he is in another relationship?"

Hartzenberg: "No I did not discuss it with him. I had gained knowledge of it, but it was not something we discussed."

Gerrie Nel questions social worker Joel Maringa

Prosecutor Gerrie Nel questions social worker Joel Maringa.

Maringa: "If someone doesn't comply with the conditions of correctional supervision then the accused can be subjected to any other sentence.

"Culpable homicide is a lesser conviction to the initial charge.

"The conviction is on a lesser charge therefore I considered correctional supervision to be appropriate."

11:07 am
Social worker recommends Pistorius be placed under 'house arrest'

The social worker said Oscar Pistorius "be placed under house arrest for the duration of his sentence."

He said, however, that one condition is that he should be declared unfit to possess firearms.

"The accused's behaviour generally is socially acceptable," he said.

He recommended that Pistorius be made to service 16 hours of community service a month.

This would involve 'general work' at the Transvaal Museum.

Nel: 3 years of house arrest 'shockingly inappropriate' for crime

Prosecutor Gerrie Nel described Maringa's recommendation of 3 years house arrest for Pistorius was 'shockingly inappropriate' for the killing of Reeva Steenkamp.

Nel: "Have you had any thought for the family of the deceased.

"Would the family not think that the courts are not giving us what they should?"

Maringa: "The accused is convicted of culpable homicide."

Maringa said correctional supervision is an applicable sentence for culpable homicide.

Maringa: "He [Pistorius] unintentionally fire a shot."

Nel: "You are wrong."

11:22 am
Nel accuses Maringa 'misreading' the court's judgement on Pistoris

Addressing social worker Joel Maringa on his report, prosecutor Gerrie Nel said: "You base your recommendation on a judgement you have wrong.

"You know that the accused used a 9mm pistol?

"That's important. It's a high calibre pistol.

"You haven't even thought about it. Why sir?"

Maringa: "The court has already convicted him of culpable homicide, I'm not going back to the merits of the case."

Nel: "Sentence should really be imposed based on the finding of the court, shouldn't it?

"You have to look at the culpable homicide. That is something you didn't do."

Maringa: "His personal circumstances are what should be considered as well and the interests of the community."

Nel: "I am just dealing with the seriousness of the crime still. That's why I'm testing it. You cannot tell the court what you took into account.

"You know that the court found the accused armed himself and walked down a passage with the intention of using his firearm. Did that change your view."

Maringa; "As far as I recall he had no intention to shoot - that's what's stated in the judgement."

Nel: "You are wrong. How can you base your report on a misreading of the judgement?

"There is nowhere in the judgement that he didn't have the intention to shoot."

Defence calls third witness - Pistorius' manager Peet van Zyl

Defence lawyer Barry Roux has called the third witness, Peet van Zyl - Pistorius' long-time manager.

He is reeling off a list of charitable work that Pistorius has done.

These include supporting the British Leonard Cheshire disability charity.

van Zyl: "He was very active in these events and attend various events in South Africa for local charities and for global charities like Unicef.

"Mr Pistorius has always been a very proud person and didn't want people to know that he was donating some of his own funds to people need prosthetics.

"We would have a mother sending an email to Mr Pistorius' website and Mr Pistorius would then take it upon himself to offer them advice and guidance."

He said Mr Pistorius would instruct van Zyl to use his funds to make prosthetic legs for those who needed them.

Van Zyl gave an example of Pistorius' commitment to helping disabled children.

He said: "In Italy Mr Pistorius did an event for a young girl who lost both her legs and arms to meningitus.
