Pretrial hearing for Michael Dunn underway

JACKSONVILLE, Fla. -- Michael Dunn will be in court for a final pretrial hearing Monday morning, weeks before he is scheduled to face a jury in his murder trial.

The pretrial hearing concerns the question of public access in this high-profile case. The lawyers will also argue whether jurors should be sequestered during
the trial. That is not uncommon in cases where there is much media attention prior to the case going in front of a jury.

A judge previously ruled people in the court room will not be allowed to wear clothing showing support for Davis because it may prejudice the jury.

Fair trial issues surface in Michael Dunn case

JACKSONVILLE, Fla. -- Michael Dunn is accused of murdering local teenager Jordan Davis, with loud music triggering the fatal shots, according to investigators.

Now, as Dunn's trial is weeks away, focus is turning to what's needed to ensure Dunn gets a fair trial.

"Once in a while, you get a case that gets this kind of publicity. All of sudden becomes an issue," said Circuit Judge Russell Healy on discussions regarding disclosure of court records on the murder case.

Healy has restricted access, with local media including First Coast News appealing to a higher court for documents to be released.

Florida's 1st District Court of Appeals last month overturned Healy's decision to delay the release of public records.

On Monday, Healy scheduled a hearing to resolve access issues a week before the trial is scheduled to get underway.

In court, attorneys on both sides argued their points with the judge requesting more details from attorneys before the January 24 hearing.

JACKSONVILLE, Fla. -- Late Thursday, lawyers for local media, including First Coast News, filed an emergency motion with the First District Court of Appeals in Tallahassee asking that it enforce a previous order to unseal public records in the case.

In December, the 1st DCA ordered Duval County Court Judge Russell Healey to either open previously sealed public records or to hold hearings as to why the records should be sealed.

During a hearing Monday, lawyers for FCN and the Florida Times-Union asked Judge Healey to follow the DCA's order. Instead, Healey scheduled another hearing on the issue on Jan 24, just 10 days before the Dunn trial is scheduled to begin.

In Thursday's filing, lawyers for local media cited the "extraordinary urgency" of the trial's timetable. The motion added, "the non-compliance with this court's order has reached crisis proportions, and emergency relief is required by this court."

With about two weeks before a Brevard County man is scheduled to go on trial for killing a Jacksonville teenager in a dispute about loud music, the case appears to be riddled with uncertainty.

Whenever the trial for Michael David Dunn starts — currently scheduled for Feb. 3 — it’s also sure to be a media frenzy. Court and city officials are already bracing themselves.

The 47-year-old Dunn is charged with the first-degree murder of 17-year-old Jordan Davis at a Southside gas station.

Friday an appeals court ordered more information in the case to be released to the media and threatened sanctions if it’s not followed. At the same time, lawyers for Dunn said they wouldn’t be ready for trial and asked for a delay.

Dunn attorney Cory Strolla said he is still finalizing the defense and needs to make sure all investigations into the case have been completed.

The motion said the State Attorney’s Office is opposed to a delay. State Attorney Angela Corey did not answer questions Friday.

It would be a BONUS from an entertainment point of view for Corey get up on her hind legs for a live streamed trial :D

As always I temper my opinion with the knowledge I have NOT seen all the evidence and certainly not seen how it is presented in Court to the Jury.... but having said that he looks like a gonner :eek

And so... perhaps Corey will front up, expecting the win and wanting the glory? :69

Ya just KNOW all the Traybot Worriers will be hyperventilating... and claiming a guilty her somehow (in their twisted minds) PROVES GZ was guilty as well :slap

I haven't followed Michael Dunn case closely myself...too much too soon on the SYG issue for me....but what little I did read sounds like there's an off chance the kids ditched a gun. More angels with tilted wings? :64

Dunn is not a very likeable character ... hard to imagine they will be able to make him one.

:30 All I know is Dunn left the area, and so did the care with the people in it. So they very well could have ditched anything. IIRC one of the guys in the car was either on parole/probation or something of the sort. Too much other was going on, haven't kept up with it.

Suspect in loud music killing asks for trial delay

JACKSONVILLE, Fla. -- A Florida man will ask to delay his trial on a charge of first-degree murder in the death of a teenager following an argument over loud music.

An appeals court judge ruled last week that Michael David Dunn's trial judge must release more evidence to the public.

Dunn plans to argue Tuesday for another trial delay.
