IMO once the Jury was "hung" on the murder charge.. they should have not even considered the other charges. How could they? They in effect said they could not decide if Dunn's self defence claim was valid. If it is valid, then the entire volley of shots was a legitimate response to a perceived threat to his (and his girlfriend's) life.. and so IMO should NOT have been regarded as "attempted murder" of the other car occupants. If The jury do reject Dunn's Self defence claim and find him guilty of the Murder of Davis.. then all bets are off. They should also have considered the attempted Murder charges. However, I posted a vid of Alan Dershowitz opinion back in this thread. His opinion is that you can not find Dunn guilty of attempted murder. It requires specific intent to KILL a specific person... it is NOT the appropriate charge in these circumstances where Dunn fired into a car, perhaps without due regard. A crime perhaps (if self defence is not accepted) but the crime is NOT "attempted murder"

JACKSONVILLE, Fla. — The man accused of killing 17-year-old Jordan Davis appeared in court Monday morning.

Michael Dunn had a pretrial hearing scheduled for 9 a.m. at the Duval County Courthouse. Dunn's pretrial hearing was moved to August 4.

The deadline to file motions will be July 28.

The first-degree murder retrial is scheduled for September 22.

In June, a judge ruled that Dunn would not be sentenced on three attempted murder convictions until after the retrial.

State releases more Michael Dunn jail letters
4:53 p.m. EDT July 23, 2014

First Coast News has obtained more letters written by Michael Dunn from jail. The letters were released by the State's Attorney's Office to FCN on Wednesday. The letters include two letters to his daughter Rebecca and and show how involved Dunn was in his own defense. There is also a letter from his fiance Rhonda Rouer.

Michael Dunn retrial remains on schedule

JACKSONVILLE, Fla. -- The man accused of killing a Jacksonville teenager was in court briefly Monday for a routine pretrial hearing.

Duval County Circuit Court Judge Russell Healey set a deadline of Tuesday, September 2 at 5 p.m. for any new motions in the upcoming retrial of Michael Dunn, 47.

If any motions are filed by attorneys, Healey said they will be taken up at Dunn's next scheduled hearing on Monday, September 8.

Final pretrial hearing set for Michael Dunn
Jacob Long, First Coast News 10:43 a.m. EDT September 15, 2014

JACKSONVILLE, Fla. -- The last pretrial hearing for the man accused of gunning down a Jacksonville teenager over loud music has been scheduled.

Michael Dunn, 47, will appear in Duval County Court on Thursday at 10:30 a.m., which is just four days ahead of the scheduled start of jury selection for his retrial.

Attorneys said Monday during a brief scheduling hearing that they will need about an hour to go over issues concerning testimony by a medical examiner and photographic evidence.

JACKSONVILLE, Fla. — Action News law and safety expert Dale Carson said we can probably expect Michael Dunn to testify in his retrial.

After all, he's the only one who can tell a jury how much he feared for his life that November night in 2012 when Dunn claims he shot 17-year-old Jordan Davis in self-defense after they argued over loud music.
"You have to convince the jury that you feared for imminently, which is immediately, for death or great bodily harm if you didn't act." said Carson.

At Dunn's first trial, he was found guilty of the attempted murders of three of Davis' friends. He faces 60 mandatory years in prison for that -- essentially keeping him up locked up for the rest of his life.

But if Dunn is found not guilty of the murder of Davis, Carson said there's a chance he could walk.

"There is a possibility, a small possibility, that it would affect the earlier convictions -- might have them thrown out, if you will. And if they are thrown out, there's a minor possibility that he could be set free," he said.

Carson said the attempted murder convictions could be overturned in appeal or Dunn could be retried on those charges as well.

Dunn is somewhat unappealing, but Angela Corey is so awful I find myself rooting for Dunn.

Not so much I want him to "win" especially. But I would LOVE Corey to lose :cool

I found his claim of "Self defense" to be plausible. Very plausible and NOT disproved by State. Mainly because the Cops "dropped the ball" in regards CSI, but also later I dont think the ME or ballistic experts were totally believable. Since the BURDEN is on the State I think Dunn should have been found Not Guilty. The Jury was "hung" as we know. I think Jury instructions were unclear, perhaps misleading. I think the Jury SHOULD have been instructed to resolve the Murder charge, and the Self Defence claim before considering other charges. IF SD is accepted and Dunn is found NG of murder1 then the volley of shots involved can hardly be regarded as an act of attempted murder. They would after all be the shots fired legitimately in self defence.

I do see some room to regard the last 3 shots as car sped away as PERHAPS separate.. but even they can hardly be regarded as ATTEMPTED MURDER since that charge requires a specific target and specific intent.(for each of 3 people) At WORST I see Dunn might have been guilty of some sort of "reckless discharge of firearm" for those last 3 shots. But even that is debatable in my mind. I am not sure the incident can be split up like that. IF it is accepted that Dunn acted in SD while in fear for his life then that applies to the entire short period that he fired shots. It is not uncommon for police, for example to unload multiple shots into a perp. Once in "use lethal force" mode. It is not uncommon to unload a complete magazine.

I find Alan Dershowitz argument appealing..
